DISCUSSION The Council reviewed this proposed amendment on March 17. At that meeting, Council held and closed a public hearing, conceptually approved the amendment, and continued final action to May 5, believing that would be the date for approval of a batch of Land.Use Element changes. (Proposed Land Use Element changes are acted on in batches, to comply with limits on the number of amendments that can be approved in a year.) That action was affirmed at the May 5 meeting,when this item was continued for the same reason to May 19. ALTERNATIVES The only action consistent with previous Council direction is to approve the amendment. However, for this particular proposal, continuance or denial would not have immediate, tangible effects. Not approving the amendment would require that the recommended prezoning for the open space annexation area be postponed(separate item on this agenda). Attachment Draft Resolution je-1 RESOLUTION NO. (1998 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO AMENDING THE GENERAL PLAN LAND USE ELEMENT CONCERNING THE MAINO FAMILY OPEN SPACE(GP 136-97). WHEREAS, the City Council conducted a public hearing on March 17, 1998, and has considered testimony of interested parties, the records of the Planning Commission hearing and action, and the evaluation and recommendation of staff, and WHEREAS, the project is categorically exempt under CEAQ Guidelines sections 15307 (actions to protect the environment)and 15325 (acquisition of open space). BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. Finding. The proposed changes are consistent with the rest of the General Plan. SECTION 1. General Plan Amendment The Land Use Element map and text are amended as shown in the attached Exhibit A and Exhibit B. SECTION 3. Document Revision. The Community Development Director shall cause the amendment to be reflected in documents which are available for reference in City Hall and which are available to the public. SECTION 4. Effective Date. This amendment shall take affect at the expiration of 30 days following approval. Land Use Element: Resource Protection -Hillside Policies (6.2.6.1) and Optional Use& Special Design Areas (8.9) The Maiae-Madonna area includes land west of Highway 101 on the lower slopes of San Luis Mountain and the northeast slopes of the foothill bordering Laguna Lake Park (1) A specific plan or development plan for the whole area should be adopted before any part of it is annexed, subdivided,or further developed. Development locations and building forms should respect the area's extraordinary visual quality and natural slopes, and should maintain views of the mountain from the highway and nearby neighborhoods. , .
