CITY OF SAN LUIS OBISPO n FROM: Mike McCluskey, Director of Public Works \ Prepared By: Keith Opalewski,Parking Manager SUBJECT: COMMERCIAL LOADING ZONE ORDINANCE CHANGE CAO RECOMMENDATION a) Introduce an ordinance to print amending sections 10.44.020 (Curb Markings-Meanings- Authority to Place) and 10.44.030 (Yellow Loading Zone-Time Restriction for Loading and Unloading). b) Adopt a resolution establishing the requirements for issuing commercial loading zone permits to authorized passenger vehicles and setting the fee at$25 for an annual permit. c) Direct staff to return after one year of operation with a status report regarding the impact of the proposed ordinance change. DISCUSSION Background On February 17, 1998, the City.Council approved an ordinance change to the Code governing the use of commercial loading zones. Specifically, new wording was added stipulating that vehicles using commercial loading zones must be commercially registered and display a commercial vehicle license elate. This change was implemented to dispel the confusion of business vehicles using the zone without commercial license plates. Shortly after the approval of the ordinance change, the City received a request (see Attachment 1) from a local business owner (Mr. John Troutner, owner and operator of Entree Express) to allow access to commercial loading zones by signed passenger vehicles. Specifically, Mr. Troutner was seeking a Code change to allow passenger cars displaying a food delivery sign to be allowed to use commercial loading zones for up to an eight minute period. This request, along with several alternatives, was considered by staff and Mr.Troutner but with no final solution. During the July 21, 1998, City Council meeting, Council acknowledged Mr. Troutner's access needs and referred the matter to staff to attempt to find a solution that would be agreeable to all concerned parties. Given this directive, staff has continued to work with Mr. Troutner and the Downtown Association to develop a staff recommendation towards a final resolution. Request for Ordinance Change Mr. John Troutner, owner and operator of Entree Express, is proposing the City change the recently modified ordinance governing the authorized use of commercial loading zones—yellow curbs. Council Agenda Report—Use of Loading Zones Page 2 Specifically, Mr. Troutner has requested the following changes: 1. allow passenger vehicles that display a food delivery sign to be able to use commercial yellow zones without a commercial vehicle license plate. 2. change the current 5-minute activity requirement to an 8-minute activity in order to better meet his particular needs for lunch time pick-ups. Request Analysis The California Vehicle Code (CVC) allows local agencies to enact local parking regulations that establish the requirements for "use of yellow zones" and it is to this area that Mr. Troutner's request is applicable. The requested changes are shown below. Current 2e 'ulations " Re uested`Re ulations Commercial vehicles Passer er vehicles Commercial plates Commercial signs - Food services 5 minutes 8 minutes Commercial vehicles vs. Passenger vehicles The City's Municipal Code requires that vehicles engaged in commercial activity (which would include delivery or pick-up of foodstuff, must be commercially registered in order to use a commercial loading zone. The Code was recently modified to emphasize this point by including language which clarifies that the appropriate commercial vehicle license plate must be displayed. The Municipal Code also clearly stipulates that passenger vehicles cannot use commercial loading zones during hours of enforcement. Given that the CVC allows cities to adopt local regulations, staff contacted other cities (Santa Barbara, Ventura, Monterey, Santa Cruz and Santa Rosa) to determine their requirements for use of commercial loading zones. Some of the survey cities had similar requirements of commercial plates only (Santa Barbara), while others had more flexible requirements ranging from use by non- commercial vehicles at non-signed commercial zones (Monterey) to any vehicle conducting business activity (Santa Rosa). In the City's case, the combination of polices (Parking Management Plan) and the need to solve existing problems (traffic circulation and abuse) led to the current ordinance requirements for commercial vehicles. Mr. Troutner has indicated that he began his business with a commercially licensed vehicle, which has subsequently become inoperative. Currently, Mr. Troutner's fleet of delivery vehicles does include one commercially licensed vehicle. However, Mr. Troutner does not want to purchase an additional vehicle that can be commercially registered, nor do his employees, who are typically students that do not have the appropriate vehicle type to be eligible for commercial registration. �—Z Council Agenda Report—Use of Loading Zones Page 3 Commercial plates vs. Commercial advertising The proposal is to allow an exemption from the commercial plate requirement only for food service pick-rip and delivery businesses that adequately display commercial advertising of that business. If modified as requested, other businesses would request the use of the yellow loading zones under similar circumstances (passenger vehicles with business signs). Thus staff cannot recommend that the existing ordinance be modified as requested (only food delivery businesses) unless it was applicable to all businesses that have a need to access commercial loading zones. This more broad based approach has been endorsed by the Downtown Association. 10 minutes vs. 8 minutes vs. 5 minnies The current time period for use of commercial zones is a maximum of 30 minutes along with a 5 minute activity requirement. The 5-minute time frame was established to help enforcement personnel curtail abuse of commercial loading zones. It requires that enforcement staff continuously observe a vehicle for at least 5 minutes to insure no one has returned to the vehicle before issuing a citation for non-activity. Extending the activity period by a few minutes (3 more as proposed) may not be sufficient to meet the needs of all businesses. Thus, staff would recommend extending the activity period to ten minutes in order to provide a more realistic time frame for all businesses. However, the time extension could affect staff s efficiency by lengthening the observation time frame for loading zone activity and obviously affect the vacancy rate of these zones for others wanting to use them. .Retial Loading Zone Permits In discussions with Mr. Troutner, merchants and the Downtown Association, the most equitable solution appears to be one where the City would issue special permits that would allow non- commercial vehicles access to loading zones and an annual fee of $25.00 would be charged to off-set the cost of registering that vehicle. In addition the following permit requirements would apply: • must possess a valid City of SLO business license • be issued only to the business owner or authorized representative • passenger vehicles must display a professional business sign (painted, magnetic, roof, window or other city approved) • permits will be transferable and must be displayed from the rear view mirror • permits will be issued annually without being prorated and full value to replace a lost or stolen permit • unlimited number of permits issued to a specific business, but permits will not be valid for use by other businesses There are obviously advantages and disadvantages to this type of program. On the plus side J -3 Council Agenda Report— Use of Loading Zones Page 4 would be increased parking revenue and improved access for all businesses without commercial vehicles. On the negative side it could impact existing loading zones and increase enforcement and administration time. It also could create abuse problems along with the unknown long term impact based upon the potential number of applicants. Since the full impact of this change is unknown, staff is also recommending that the changes be monitored for the first year of operation and report back to Council with a status report. Given the need to find a solution to this issue, it is staff's opinion that amending the ordinance and establishing a permit program that is evaluated after one year is the best course of action at this time. No solution is perfect. The solution that is recommended is equitable for all businesses. It will not guarantee Mr. Troutner close access to the restaurants he does business with. It will provide access to many business owners previously denied because they did not own a commercial vehicle as a part of their business. It will increase competition for commercial loading zones and most likely will have some negative impact on the ability of true commercial delivery vehicles to access their business customers in the downtown. CONCURRENCES The Downtown Association Parking Committee has supported the concept of issuing permits to non-commercial vehicles if it applied to all businesses and not just food pickup/delivery. The Board of Directors will be meeting on September 8, 1998, to make a formal recommendation of the proposed ordinance change. The Council will be advised of the results of that meeting prior to tonight's meeting. FISCAL IMPACT Any changes to the existing Code could have a negative financial impact to the parking fund as more time would be required to monitor the loading zones for compliance. This, in turn, could impact parking meter revenues and a corresponding reduction in parking citations. There would also be costs incurred for necessary sign changes at the loading zones if a Code change was implemented. Although the precise number of permit sales is unknown, some or all of the revenue loss could be off-set by the sale of the permits. Conversely, there would be no fiscal impact if the Municipal Code is maintained status quo. Attached herewith is a copy of that code section and our suggested language; also a petition signed by the management or owners of all our effected downtown restaurants. We have two basic issues: 1. Use of the Yellow Zones in the absence of commercial plates 2. Abolition or extension of the"5 minute activity." We believe we have strong arguments for each of our positions. Should it be necessary for me to elaborate on this,I stand ready. I believe,however,that you will find that the arguments are clear and the positions are reasonable and thus we beg your immediate attention to this issue. We suggest that the very nature of their business results in a positive impact on downtown parking and traffic. We feel it is in the best interests of all that the city develop a workable plan which allows Entree Express to use these commercial zones in the course of conducting their business. It is our experience,that with very few exceptions,they are in and out of our restaurants within 5 minutes. In so doing,they are quickly and efficiently taking dozens of meals daily from the crowded downtown core to the less congested balance of the city; thus saving dozens of trips into the core at a time when parking and traffic is at its worst. The City Traffic Engineer is authorized, subject to the provisions and limitations of this chapter, to place, and when required herein shall place, the following curb markings to indicate parking or standing regulations, and the curb markings shall have the meanings as set forth in this section. A. "Red" means no stopping, standing or parking at any time except as permitted by the Vehicle Code, and except that a bus may stop in a red zone marked or signed as a bus zone. B. "Yellow" means no stopping, standing or parking at any time between seven a.m. and six p.m. of any day, except Sundays for any purpose other than the commercial loading or unloading of materials by a commercially registered and licensed vehicle or a professionally signed passenger vehicle that displays an authorized commercial loading zone permit The commercial loading zone permit requirements and fee shall be established by resolution. C. "White" means no stopping, standing or parking for any purpose other than loading or unloading of passengers, or for the purpose of depositing mail in an adjacent mailbox, which shall not exceed three minutes, and such restrictions shall apply between seven a.m. and six p.m. of any day, except Sundays, and except as follows: 1. All passenger vehicles using a permit must display a professional business sign (painted,magnetic, roof,window or other city-approved sign). The Director of Public Works will have final approval for the type of approved sign. 4. Permits will be transferable and must be displayed from the rear view mirror of the vehicle. 5. Permits will be issued annually at the rate of$25.00 per permit. Permits will not be prorated and full value will be charged for any lost or stolen permit. Permits will be renewed each November 1. 6. Permits will only be valid for the business that purchases the permit(s) and there will be no limit to the number of permits issued to a qualified business. 7. Any misrepresentation or misuse of the permit will disqualify the business from future use of the permit. At today's Board of Director's meeting,the Downtown Association voted to endorse staffs recommendation of a formal ordinance change. Specifically,the Board is supporting the change to allow signed passenger vehicles that display a commercial loading zone permit to use yellow zones without a commercial vehicle license plate. Furthermore, the Board has also endorsed the ordinance change to increase the commercial loading zone activity period from five minutes to ten minutes.
