Walker, Streets Supervisor SUBJECT: SIDEWALK CONSTRUCTION PROJECT NO. 98-20 CAO RECOMMENDATION 1. Approve plans and specifications for "1998 Sidewalk Improvement Project: Various Locations." 2. Authorize staff to advertise for bids and authorize the CAO to award the contract if the lowest responsible bid is within the engineer's estimate. DISCUSSION On July 21, 1998 City Council authorized the CAO to approve plans and specifications to install new sidewalks at 27 various locations in the City. Staff has prepared plans and specifications for 24 of those projects and is ready to bid those projects for construction. The remaining three projects require engineering design and will be accomplished separately within this fiscal year. L In the course of preparing plans for the 24 projects, staff contacted each of the affecting properties informing them of the City's intention to construct sidewalks. While most properties indicated pleasure with the Council's decision, a few indicated the undesirability of sidewalk construction regardless of who was funding the construction. Rather than proceed directly to the CAO for authorization (per the 7/21/98 direction) staff felt that those citizens who wished to protest the construction of sidewalks in front of their residence should be afforded the opportunity to do so. Therefore tonight the Council will hear protests, if any, and determine if the list of approved projects should be modified. The City does not have any established appeal procedure for construction of facilities for the public good in the public right-of-way and funded by public funds. Normally, any protests made are made at the meeting approving the construction documents and thus tonight's meeting is the appropriate venue for the Council to approve the project. CONCURRENCES Community Development Department has given this project a categorical exemption. Council Agenda Report—Sidewalk Construction Project Page 2 FISCAL IMPACT This project was budgeted for in the 1997-98, and 98-99 financial plans, Appendix B, page 126. The engineers estimate for the 24 projects is$111,311.00 including 10 percent contingency.
