DISCUSSION Mary Jane Duvall was a secretary to the Mayor at the time that the Mission Plaza was being developed. Upon her passing, she left her entire estate to the City of San Luis Obispo to be used in carrying forward the basic intentions of the Mission Plaza This condition was accepted by the City and the Trust Fund is currently maintained by the Finance Department. The trustee of the Trust Fund has offered the City a gift of up to $25,000 ($20,000 for design and production of the sculpture and up to $5,000 for site design and installation)to be used for creation of a sculpture to be placed along the proposed San Luis Obispo Creek Walk. The artwork must be a free standing, life sized sculpture of an animal or animal grouping which represents the type of creatures that would be or would have been found along the San Luis Obispo Creek corridor. The terms of the gift also limit the eligibility of artists to residents of San Luis Obispo County and establish procedures for the request for proposals and selection of the artist, including the selection jam'• At the public working sessions held to discuss the proposed conceptual design of the Creek Walk, there was strong feeling on the part of community members present that the Creek Walk should be a major focal point for public art. At its October 20, 1998,meeting,the Council approved a request for proposals for artwork that would establish entry features to the walk on either side of Broad Street. The addition of the generous Mary Jane Duvall Trust Fund gift will compliment these entry features,and move the Creek Walk one more step toward becoming a significant public art site. CONCURRENCES The San Luis Obispo County Arts Council is very supportive of the City accepting this gift. FISCAL IMPACT There is no fiscal impact. An animal or animal grouping that would be(or would have been) found in the San Luis Obispo Creek corridor. Fish to be excluded. Note: this theme is established in the Bear&Chumash Child sculpture found at the Mission Plaza fountain. Character. Free standing,three dimensional and sufficiently realistic/impressionistic to portray the animal(s). Note: reference Bear&Chumash Child Paula Zima, artist. Scale: Lifesize Materials: Durable, e.g. stone,marble, concrete, ceramic,metal or combinations, etc. Location: Precise location within the Creek Walk as well as the setting(hardscape, so8scape, or water)to be deterred in consultation with Creek Walk landscape architect David Foote and approved by the Architectural Review Commission. General parameters: To be above level of likely flood damage;to be visually prominent;to be accessible to children for touching or climbing depending on scale;to be night lighted for security. Artist Eligibility: Artists must be residents of San Luis Obispo County. Procedures: City Request for Proposal(RFP)procedures modified as necessary to include conditions of this offer. Submittals: 1. Renderings or models of sufficient size and detail to clearly convey the essence of the proposed sculpture in its setting. 2. Six to ten 35mm slides of the renderings or models to be used in presentations to large audiences. 3. Written declaration warranting that the sculpture is original work created for this specific project and that,upon completion and installation the work becomes the property of the City of San Luis Obispo. (1998 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO ACCEPTING A GIFT FROM THE MARY JANE DUVALL TRUST FUND FOR THE CREATION OF A SCUPTURE ALONG THE SAN LUIS OBISPO CREEK WALK WHEREAS, the Mary Jane Duvall Trust Fund was established to carry forward the basic intentions of the Mission Plaza; and WHEREAS, the trustee believes that a financial gift to the City for the creation of a sculpture to be placed along the San Luis Obispo Creek walk meets the intentions of the trust; and WHEREAS, the trustee has offered the City a gift of up to $25,000 ($20,000 for the design and production of the sculpture and up to $5,000 for site design work and preparation) to create such a sculpture; and WHEREAS, the trustee has established preliminary conditions of the offer of the gift which the City finds to be acceptable. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. That the City is extremely pleased to accept the offer of a gift of up to $25,000 from the Mary Jane Duvall Trust Fund for the creation of a sculpture to be placed along the San Luis Obispo Creek Walk. SECTION 2. That the City agrees to follow the preliminary conditions of the offer shown in Attachment A to the best of its abilities. Should the City be unable to follow those conditions for any reason, it will work with the trustee to develop mutually agreeable alternatives.
