SUBJECT: Request by appellants to hold a continued hearing regarding an appeal of
sidewalk requirements for a building project at 1480 Ella Street. (Philbin)
CAO RECOMMENDATION
BY MOTION, SET CONTINUED HEARING ON THE APPEAL OF SIDEWALK
IMPROVEMENT REQUIREMENTS FOR 1480 ELLA ST. TO MAY 18, 1999.
DISCUSSION
On December 15, 1998, the City Council held a hearing to consider an appeal to postpone the
sidewalk requirement for a major remodeling project at 1480 Ella Street. The City Council
continued the hearing to January 19, 1999 to allow staff to evaluate impacts on existing trees and
report back to the Council at that meeting. The appellant subsequently requested an "indefinite"
continuance of this matter, due to their uncertainty in pursuing the project. However, the City
Council ordered a continuance only for ninety (90) days.
Staff received a new request to hear the item within the 90 day period, which expires on April 17.
The appellants have decided to proceed with their project. . However, because of full agendas,
pertinent staff absences and other priorities, it was not possible to reschedule the hearing item
until after that date. Therefore, the City Clerk has scheduled the hearing for the May 18`h agenda.
Staff believes that, since the appellants submitted their written request to hear the item "prior to
the 90 day expiration date" established by the Council, that the actual hearing could be held after
the expiration date and still meet the intent of the Council direction. (See attached letter)

SUBJECT: RESOLUTION OPPOSING PACIFIC BELL'S 411 RATE INCREASE
CAO RECOMMENDATION
ADOPT A RESOLUTION OPPOSING PACIFIC BELL'S
411 RATE INCREASE AND SUBMIT IT TO THE CALIFORNIA
PUBLIC UTILITIES COMMISSION.
DISCUSSION
Californians for Telecommunications Choice has requested the City to adopt the attached
Resolution opposing Pacific Bell's proposed 411 rate increase. (Please see March 12, 1999
letter.) This increase could potentially raise the price of a "411" call.from $.25 to $1.10. Chiefs
Neumann and Gardiner indicate that this would have an adverse impact on their Departments,
and the proposed increase is generally opposed by safety and law enforcement agencies because
they are frequent users of 411 services. Therefore, it seems appropriate for the City to take a
position in opposition to the increase.
FISCAL IMPACT
There would be no fiscal impact to the City as a result of adopting this resolution.
ALTERNATIVES
Do not adopt resolution.
