SUBJECT: Memorandum of Agreement with the San Luis Obispo City Police Officers'
Association for the period of July 1, 1998,through June 30,2000
CAO RECOMMENDATION
Adopt a resolution approving the Memorandum of Agreement.
DISCUSSION
The Memorandum of Agreement (MOA) between the City and the San Luis Obispo Police
Officers' Association(POA) expired on June 30, 1998, after a tern of two years. As provided for
in that agreement,the City's negotiating team(Bill Avery,the City's chief negotiator, Karen Jenny,
Risk Manager, and Ann Slate, Director of Human Resources) entered into negotiations on April
28, 1998,with the Association's negotiating team, led by Police Officer Gary Nemeth, to develop a
successor agreement. The team met with the Association again on May 28,June 8, and June 26,
1998. Of the numerous proposals originally presented to the City by the POA, several issues still
remained unresolved.
On July 10, 1998, the Association declared impasse. After meeting with the City Administrative
Officer, who is designated as the Employee Relations Officer in the City's Employee/Employer
Relations Resolution,the City and the POA were still unable to reach agreement and mediation was
requested. Mediation sessions were held on October 10 and 26, 1998, and were unsuccessful. In
accordance with our impasse procedure,the parties moved on to fact-finding.
A fact-finding session was held on February 23, 1999. After meeting with the fact-finder,the POA
and the City's negotiating team began discussing options that could lead to settlement. The City
Council, in closed session,was briefed on February 26, 1999, on the various outstanding issues and
provided direction to staff regarding economic considerations.
A tentative agreement has been reached which was ratified by a majority of the Association
membership. The agreement reflects and strengthens the continued cooperation between the
Association and the City to address issues of mutual concern in a productive manner. The
agreement is within the economic guidelines previously discussed with Council. Following is a
summary of the significant changes and cost items included in the agreement:

Salary: July 1998 - 2.00/a increase for all employees in the unit
January 1999 - 2.5%increase for all employees in the unit
July 1999-2.01/o increase for all employees in the unit
January 2000-.2.0%increase for all employees in the unit
In addition, the Communications Technicians and the Field Service Technicians
will receive a 2.5% salary increase effective the first day of the first full pay period
following July 1, 1999. Job descriptions shall be modified to include the
requirement of emergency medical dispatch certification.
Retirement: • The PERS program currently available to Police Officers will be amended to
include:
4'Level Survivor Benefit(no cost to City).
Military Service Credit(no cost to the City).
• Convert city-paid retirement contributions (9% for sworn employees; 7% for
non-swom employees) into salary for the purposes of calculating retirement,
effective January 1,2000.
• . Establish a reopener to meet and confer on other enhancements to the police
retirement plan, i.e., annual cost of living allowance increase for safety
employees and 2%at 55 for non-safety employees. Any amendments will be at
no cost to the City and fully funded by the employees.
Long Term Disability Insurance(LTD): Convert the amount the City pays for LTD to salary and
discontinue LTD coverage for members of the unit upon notification by the POA.
Fitness Reimbursement for SWAT Team: Provide SWAT team members (12 officers) with up to
$375 per year to be used toward membership in an approved fitness facility upon
proof of regular and ongoing participation.
Compensation Restructuring: Add a lower step to the salary ranges for each classification in the
bargaining unit and eliminate the 5% step increase after six months at the initial
hiring and second steps,which results in some limited savings to the City.
There are several non-economic provisions in the agreement covering issues like vacation sign-ups,
Traumatic Critical Incident policy,work schedules and light duty assignments. We believe this is a
fair and equitable agreement that is consistent with previous Council direction and with recent
settlements with other employee groups.
FISCAL EWPACT
The cost of this agreement is approximately$104,600 in year one and $122,900 in year two. The
ongoing annual cost increase at the end of the two year contract will be approximately $318,000.
Funding is available in the existing fiord balances for the first twelve months of the agreement that

fall in the 1998-99 Financial Plan. Funds will be appropriated in FY 1999-00 as part of the current
two-year financial planning process in accordance with the agreement.
ALTERNATIVE
Do not approve the resolution and direct staff to negotiate a different successor agreement. This
alternative is not recommended as the agreement is consistent with the Council's previous direction
and the City's employer-employee relations policies.

PLEASE NOTE: A copy of the MOA will be provided to each of the Council members and
available for public review in the City Clerk's office. At the time of this report deadline, minor
editorial changes were being finalized and appropriate signatures were being obtained.

OBISPO ADOPTING AND RATIFYING THE MEMORANDUM OF AGREEMENT
BETWEEN THE CITY OF SAN LUIS OBISPO AND THE SAN LUIS OBISPO POLICE
OFFICERS' ASSOCIATION FOR THE PERIOD OF JULY 19 1998-JUNE 309 2000
BE IT RESOLVED, that the City Council of the City of San Luis Obispo hereby resolves
as follows:
SECTION 1. The Memorandum of Agreement between the City of San Luis Obispo and
the San Luis Obispo City Police Officers' Association(POA), attached hereto as Exhibit"A"and
incorporated herein by this reference,is hereby adopted and ratified.
SECTION 2. The Finance Director shall adjust the Personnel Services appropriation
accounts to reflect the negotiated compensation changes.
SECTION 3. The City Clerk shall famish a copy of this resolution and a copy of the
executed Memorandum of Agreement approved by it to: Gary Nemeth, San Luis Obispo Police
Officers' Association,and Ann Slate,Director of Human Resources.

At its meeting of 5/5/99,the SLOCOG received a lengthy presentation from a representative of
the U.S. Census Bureau indicating the importance of an accurate count when the census is taken
in April 2000. The representative offered many suggestions for community participation in order
to assure that every person is counted. The federal government and COG will be working
closely with city managers in local cities to prepare to carry out a comprehensive program which
will take place over the next year.
To give the Council an indication of the importance of this item, it is estimated that an under-
count represents a loss of revenue of$250/person per year of an aggregate state and federal
funding. A 5%under-count could mean a loss of$5,331,250 for the City over the next ten years.
CUESTA GRADE PROJECT
The Board received an extensive report from staff and Caltrans representatives regarding the
Cuesta grade project. Barnett&Cox will commence their public information program in the
very near future, with construction work tentatively scheduled to begin in August.
Approximately 1/6 of the project cost is dedicated to traffic management. The hope is that with
all the alternative transportation measures to be taken, peak-hour travel on the grade can be
reduced by 12%during the construction period. The City Council is scheduled to receive a
similar Caltrans report at the meeting of May 18te.
ROUTE 46
With the recent deaths on Highway 46,there is an increased emphasis to expedite the preliminary
planning for improvement of this route from east of Paso Robles to the Highway 46-41 wye.
There is a particular effort being made to attempt to expedite the federal environmental review
process. In addition,there are some emergency funds available to construct a temporary median
barrier near the location of the recent fatal accidents (which is also near where the Jeff Fairbanks
• accident occurred). Sen. Jack O'Connell has been able to obtain an additional $70,000
appropriation for increased Highway Patrol surveillance for the next several months.

The items of special interest discussed at the Facility Committee meeting are as follows:
I) Acoustic Clouds
The committee agreed to recommend that a contract be awarded to a consultant to study
all aspects of the sound conditions in the main hall and make recommendations as to
those items which would result in improvements. The study would provide a matrix of
alternative improvements,with specific costs,thus allowing the partners to decide what
level expenditure would be appropriate for each item. This may result in a
recommendation for acoustic clouds, or an adjustable canopy above the stage , or
reorientation and modification to the sound system. The study is expected to cost
approximately $30,000,with the City of San Luis Obispo to pay a share which will be
recommended in budget submittals.
2) Parking Structure
The parking structure earthwork is largely complete, foundation pours are being made
and steel is being erected. Progress has been excellent,and it now appears the structure
may be completed by Christmas, somewhat ahead of schedule.
3) Spanish Ceiling
The Committee received a report on two alternatives to improvements of the presentation
of the Spanish ceiling,hung in each of the entries of the main hall. At this point,costs
appear to be in the $55,000-60,000 range, and there is little likelihood of the major
modification proceeding.

SUBJECT: INTEGRATED WASTE MANAGEMENT AUTHORITY
At its meeting of 5/12/99,the IWMA received a report that additional worm bins are now
available. If you are interested in obtaining one for$39.00 (subsidized price),they are available
at Farm Supply on Tank Farm Road..
The Board was also informed that the grading permit will be available any day for the
construction of the Material Recovery Facility(MRF)at Cold Canyon Landfill. It is expected
that this facility will be in operation by late fall 1999. This operation will go a long way toward
meeting our mandated diversion goals.
In a Board action there was agreement to-hire a consultant to conduct a new base year study of
waste generation. It appears that the original figures developed in 1990 are seriously flawed in
that they under-estimated green waste due to the drought and did not appropriately consider
construction debris. These two erroneous figures make it practically impossible for the County
as a whole to meet state mandated diversion goals by 2000. The consultant will review our base
year information,perhaps recommending a base year that is more indicative of a normal
condition. If this information is to our benefit,the local Board will submit this report to the state
Board with a request that our base year information be modified,thus more easily meet our
mandated diversion.
