SUBJECT: Prefumo Arm-Dredging Project
Specification No. 90026.
CAO RECOMMENDATION:
1. Adopt Resolution Approving a Mitigated Negative Declaration (ER 91-97) for Creek Bank
Repair Projects,City Plans 90026.
2. Approve plans and specifications for Prefumo Arm-Dredging Project, Specification No. 90026.
3. Authorize staff to advertise for bids for "Prefumo Arm-Dredging Project" Specification No.
90026.
4. Authorize City Administrative Officer to award a contract to the lowest bidder if bids are within
budget.
DISCUSSION:
This project is a maintenance project to remove sediments carried from Prefumo Creek and
dropped by the flowing water as it enters Laguna Lake. This work was last done in 1995. Last year
the City received a permit from the Corps of Engineers to do this work every three years if needed.
There has been deposited in the Prefumo Arm of Laguna Lake about as much sediment as existed
prior to the 1995 clearing project. If this work is not periodically carried out the material will be
washed into the main body of the lake and will gradually fill it.
The material is typically removed from the arm by a contractor and used as fill material for a project
some place in the County. The material removed is granular, containing a large amount of gravel
and sand.
This project is one of 11 different sites covered in the attached City environmental document. In
1997 the City advertised the environmental document and received public comments. A public
hearing was held on projects at 8 of the 11 sites in September 1997. This particular project was not
included in the hearing since plans had not been completed for the work at that time. The hearing
tonight is to consider the portions of the environmental document related to this project, receive
public testimony regarding the adequacy of the document and to adopt a resolution approving the
mitigated negative declaration with any appropriate changes. In addition to the mitigation activities
described in the City document the project includes mitigation required by the Corps of Engineers.
The Corps mitigation includes restoration of riparian areas and 5 years of maintenance at a 2:1 ratio
along waterways and the placement of a low flow channel in the Prefumo Arm along the easterly
side of the area of work. The Corps must approve the mitigation plan and work on the plan must
begin immediately after the project.
This fall the City will be using the remaining funds in this account to perform mitigation required as
a condition of the Corps permit. This mitigation will be in the form of planting native plants Vni

Prefumo Creek in the golf course and at locations along San Luis Obispo Creek. The planting will `
cover an area equal to twice the area disturbed by the project and be under the direction of the
City's Natural Resources Manager, Neil Havlik. The Corps permit allows the City to remove
debris every 3 years for the next ten years. The area of mitigation required was established at this
amount because the City would be disturbing the channel on a somewhat regular basis.
CONCURRENCES:
This project has received permits from the Corps of Engineers,a biological opinion from National
Marine Fisheries and Fish and Wildlife Service, an agreement with California Fish and Game and a
water quality certification from the Regional Water Quality Control Board. The project plans as
proposed for approval are consistent with the requirements of the City's mitigated negative
declaration and the terms of the Corps permit.

RESOLUTION NO. (1999 Series)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
APPROVING A MITIGATED NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT
FOR CREEK BANK REPAIR PROJECT, CITY PLAN 90026.
WHEREAS, On July 26, 1997 the City published and made available for public review a
mitigated negative declaration based on an initial study of environmental impact, "San Luis Obispo
Creek Corridor Management and Enhancement Plan: Selected Phase 1 Improvements" (ER 91-97),
in accordance with the California Environmental Quality Act and the City's Environmental Impact
Procedures and Guidelines; and
WHEREAS, On July 20, 1999, the Council conducted a public hearing, which included
consideration of comments on the published initial environmental study and changes to the project
since it was first proposed, to further mitigate adverse impacts; and
WHEREAS,The Council has considered the initial study.
BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
SECTION 1. The potential impacts of the project will be mitigated to an acceptable level due to
features incorporated into the project design and construction. These mitigation measures
and monitoring responsibilities are identified in the initial study, on file in the Community
Development Department,and within the Permit issued by the United States Army Corps of
Engineers. The City Council fmds that the Negative Declaration adequately addresses the
potential environmental impact of the proposed project, and reflects the independent
judgment of the City Council.
SECTION 2. The Council hereby approves a negative declaration.
