CAO RECOMMENDATION
Grant final passage of Ordinance No. 1354 (1999 Series).
DISCUSSION
On August 17, 1999 the City Council introduced Ordinance No. 1354 (1999 Series) to print,
approving the requested amendment to the site's C-S-S zoning. The approved rezone eliminates
the previously approved master list of allowed and conditionally allowed uses at 791 Orcutt
Road and adds "wildlife-impacts as a result of human activity"as an issue to be addressed as part
of the site's Special Consideration zoning. Ordinance No. 1-354 is now ready for final passage.
The new zoning designation will become effective on the 30th day following final passage.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
AMENDING THE ZONING REGULATIONS TO ELIMINATE THE PREVIOUSLY
APPROVED MASTER LIST OF ALLOWED AND CONDITIONALLY ALLOWED USES AND
TO ADD "WILDLIFE IMPACTS AS A RESULT OF HUMAN ACTIVITY" AS AN ISSUE TO
ADDRESS AS PART OF THE SITE'S SPECIAL CONSIDERATION ZONING AT 791
ORCUTT ROAD
(R 62-99)
WHEREAS, the Planning Commission conducted a public hearing on July 28, 1999, and
recommended approval of the amendment to the site's zoning; and
WHEREAS, the City Council has held a public hearing on August 17, 1999 and has considered
testimony.of other interested parties, the records of the Planning Commission hearing and action, and the
evaluation and recommendation of staff, and
WHEREAS, the City Council finds that the proposed revisions are consistent with the General
Plan, the purposes of the Zoning Regulations and other applicable City ordinances; and
WHEREAS, the City Council has considered the Negative Declaration approved by Council for
the site's previous rezoning for its adequacy in evaluating this request; and
BE IT ORDAINED by the Council of the City of San Luis Obispo as follows:
SECTION 1. The City Council finds and determines that the previous Negative Declaration for
the rezoning of the property from Manufacturing (M) to Service-Commercial with Special Consideration
(C-S-S) adequately addresses this amendment to the site's zoning.
SECTION 2. The City Council makes the following findings:
1. The proposed amendment to the site's C-S-S zoning is consistent with the General Plan,
including policies regarding the location of services and manufacturing uses. Further, the
proposed amendment to the site's C-S-S zoning corrects an existing inconsistency with the
General Plan by eliminating the master list of allowed and conditionally allowed uses which
allows retail sales of groceries, liquor and specialized foods at the site.
2. The Special Consideration"S"zoning will continue to ensure that future development adequately
addresses traffic, circulation, creek preservation, downstream drainage and wildlife as a result of
human activity.
3. The proposed amendment to the site's C-S-S zoning is appropriate and will be compatible with
surrounding land uses through the required processing of an administrative use permit and
architectural review.
4. The proposed amendment to the site's zoning will not be detrimental to the health, safety or
welfare of persons residing or working in the vicinity because the elimination of the master list of

allowed and conditionally allowed uses will result in the requirement for administrative use
permit approval before any use may be established.
SECTION 3. The elimination of the site's master list of allowed and conditionally allowed uses
and the addition of`wildlife impacts as a result of human activity" as an issue to be addressed as part of
the site's Special Consideration zoning(R 62-99) is hereby approved.
SECTION 4. A summary of this ordinance, together with the names of Council members voting
for and against, shall be published at least five (5) days prior to its final passage, in the Tribune, a
newspaper published and circulated in this City. This ordinance shall go into effect at the expiration of
the thirty (30) days after its final passage.
