SUBJECT: Purchase of 883 Marsh Street-Parable Parking Lot Section
CAO RECOMMENDATION
1. Authorize the purchase of property(10 feet)located at the rear cf 883�arsh Street for$50,000.
2. Authorize the CAO to sign purchase documents and the deed.
3. Appropriate$55,000 from the unreserved parking fund balance for the land purchase.
4. Adopt resolution designating city-owned property at 871 Marsh Street as a public way.
DISCUSSION
Following Council direction, staff has successfully concluded negotiations with the property
owners of 883 Marsh Street (Parable Bookstore) for purchase of sufficient area (10 feet) to allow
the expansion of the Marsh Street Parking Garage. The expansion project was first discussed by
the City Council in November of 1995 and received formal budgetary authority in January of
1996. Since 1996 the Council has continued to direct staff (11 Council meetings approving
various components of the project)to proceed with the expansion project. Furthermore, the City
Council, in two separate closed sessions, authorized staff to begin negotiations (February 2,
1999)and continue,negotiations(July 6, 1999)with the property owners of the Bookstore.
In order to facilitate the land purchase, staff contracted with Hammer, Jewell and Associates to
negotiate with the property owners. Ms. Lillian Jewell conducted all negotiations and kept staff
informed of all issues. Via staff direction, Ms. Jewell responded to all issues and was able to
resolve many details necessary to make the purchase possible without the necessity of eminent
domain procedures. The final purchase agreement was a joint effort between Ms. Jewell and
City staff.

In August of 1999 Council approved the use permit to allow the proposed design to proceed as
planned, which included the acquisition of the 10 foot section of land. With acquisition of the
property, all major properties needed to fulfill the Council goal of expansion of the Marsh Street
Parking Garage will be acquired. As of tonight's meeting, the project has received final approval
of design plans at the ARC meeting on October 4, 1999. The project Architect is finalizing the
plans and specifications with plan check scheduled to begin by late November. Assuming all
stays on track, construction should begin in mid-March of 2000 and new parking spaces should
be available in time for Christmas shoppers in 2000.

Purchase Agreement- key issues
Key issues of the agreement were: providing a staging area for the planned second story
addition of the bookstore, pedestrian bridge access, public way designation, and the final
purchase price. The property owners felt it was imperative that adequate staging be available to
them during the simultaneous construction of their addition and the garage expansion. They also
wanted direct access to the pedestrian bridge from their second story addition via a public way
designation of the existing parking garage entrance lane from Marsh Street. Finally, the property
owners asked for additional compensation beyond the appraised land value to help offset the loss
of future lease revenue as a result of the reduced square footage for the second story addition.
To address the above issues staff has agreed to the following provisions: provide a 40 x 8 foot
staging area in front of the Post Office on 800 Marsh, allow direct access to the pedestrian bridge
per current Building Codes, designate the garage entrance lane as a public way to allow zero
setback for their second story, and pay$50,000 for the 10 foot section of land.
CONCURRENCE
The City Council approved the finding that the proposed property acquisition conformed with the
General Plan as part of the supplemental EIR in August of 1999.
FISCAL IMPACT
In April of 1996 the Council approved $720,000 from the Parking Fund for appraisals, acquisition
of two properties, design and environmental studies. To date, this approved budget has been
depleted because costs for the Post Office land purchase, environmental review and design work
exceeded original expectations. Therefore, an additional $55,000 is needed from the unreserved
Parking Fund balance (currently in excess of$2.2 million)to complete this final land acquisition.

A RESOLUTION OF THE COUNCIL OF`31JE CITY OF SAN LUIS OBISPO
DESIGNATING CITY-OWNED PROPERTY A''871MARSH STREET AS A PUBLIC WAY
IN CONNECTION WITH THE MARSH STREET GARAGE EXPANSION PROJECT
WHEREAS, the City of San Luis Obispo desires to complete the expansion of the Marsh
Street Garage; and
WHEREAS, the.existing entrance lane to the Marsh Street Garage is used as a public
access for entering the garage and private property owners gaining access to their property; and
WHEREAS, the expansion of the Marsh Street Garage will maintain the current entrance
lane as the only ingress to the garage and adjoining private property; and
WHEREAS, the designation of the entrance lane to the Marsh Street Garage as a public
way will benefit adjoining property owners and the City.
NOW, THEREFORE,BE IT RESOLVED by the Council of the City of San Luis Obispo
that the area shown and described in Exhibit A is hereby designated as a public way.
