McCluskey, Director of Public Wo RSA Prepared By: Barbara Lynch, Civil Enginee SUBJECT: HIGUERA STREET BRIDGE RECONSTRUCTION PROJECT— CONSTRUCTION MANAGEMENT CAO RECOMMENDATION 1. Authorize the CAO to execute an amendment to the agreement with Martin, Rivett& Olson (formerly Martin&Kane)to increase environmental monitoring services. 2. Appropriate $ 142,000 from the unappropriated balance of the General Fund to support the increased level of environmental monitoring. DISCUSSION On June 1, 2000, construction began on Higuera Street Bridge project. At that time, staff had arranged for contract construction inspection and environmental monitoring services. Both of these functions are to some degree dependant upon the operations of the contractor and the conditions of the work site. The contractor has installed a stream diversion to protect the creek from falling debris and accidental spillage. This entails building a temporary dam and laying a pipe in the creek bed to cavy the water through the work site. The contractor has been unable to seal the stream diversion completely. Ongoing monitoring for fish, present in the deep pools of the channel, has become necessary. Containment of the drilling spoils has also been a challenge requiring ongoing monitoring to ensure that any spoils leaking from the walls during drilling are contained or the operation is shut down and the problem rectified. The original work scope for the environmental monitoring did not foresee the need for constant monitoring. Generally, the monitors are on site full time at the beginning of a project until the work methods are set up and refined to meet the environmental constraints. At that time, the monitors can move to periodic checks during the day. With the numbers of fish and the difficulty with drilling spoils, an environmental monitor has been required at all times. At the current monitoring level, the monitors will run out of funding prior to the work being completed. There has also been a small additional cost to retain the services of a bat specialist in conjunction with the work. Monitoring is a required condition for our creek work and must be funded. FISCAL IMPACT The 1999-01 Financial Plan, Appendix B, page 204 provides $4,100,000 for the Higuera.Bridge construction in year 2000-01. The budget included $450,000 for Construction Management. That $450,000 has already been obligated for the construction inspection and the environmental monitoring anticipated at the time of award for construction. With full time monitoring now a potential need, the consultant has estimated an additional $172,000 will be required to provide C4-1 Council Agenda Report—Higuera Bridge Reconstruction Construction Management Page 2 full time observation, including overtime, through November 1, 2000. If the situation improves, the monitoring will be reduced to an appropriate level and the costs will be less. This additional funding is not currently approved for Federal participation; however, it is eligible for funding as a necessary part of the construction project. Staff will request participation from the Federal Highway grant program at the time of project completion. Funding reimbursement is not guaranteed as the additional cost will be subject to approval and available funds in the grant progtam. At this time we are requesting the additional funding come from the General Fund. The Grant funds for the Bridge Replacement and Rehabilitation Program are not a set amount but rather a percentage reimbursement of eligible costs. With a decreased anticipated construction cost, the Federal grant funds dropped as well. Impact on Fund Balance. Based on the 1999-01 Financial Plan Supplement and Council- approved changes since then, the recommended appropriation of $142,000 will result in an ending General Fund balance that is 21.7% of operating expenditures compared with our policy minimum of 20%. ATTACHMENTS Amendment to agreement glamem pmiemtmlgasgW Ngmalmg mpmWOR affms.dm C4-2 AMENDMENT FIVE TO AGREEMENT THIS AMENDMENT TO AGREEMENT is made and entered in the City of San Luis Obispo on this day of , 2000, by and between the CITY OF SAN LUIS OBISPO, a municipal corporation, herein after referred to as City, and Martin, Rivett & Olson (formerly Martin & Kane Inc.,) Consulting Engineers hereinafter referred to as Consultant. WITNESSETH: WHEREAS, on November 4, 1997 the City entered into an Agreement with Consultant for design and environmental services for the Higuera Street Bridge; and WHEREAS,the City desires to amend the scope of environmental monitoring services as outlined on the attached proposal; NOW THEREFORE, in consideration of their mutual promises, obligations and covenants hereinafter contained,the parties hereto agree as follows: 1. The scope of services and related compensation is hereby amended as set forth below: a. Consultant's Obligation: The Consultant will provide the following additional services: i. Provide a full time monitor for the construction project including overtime and double time costs through November 1, 2000 unless determined by the City to be unnecessary. ii. Provide a bat specialist and additional bat habitat in alternate areas of the culvert to accommodate bats. b. City's Obligation: Reimbursement for providing additional environmental monitoring services at the hourly rates including employee benefits, overhead and fee. The Consultant shall be reimbursed in an amount not to exceed$172,000. 2. All other terms and conditions of the Agreement remain in full force and effect.
