The Council of the City of San Luis Obispo do resolve as follows, t.o wit: That whereas 'u`here has been filed wjth the Council of the City of San Luis Obispo a p••etition signed by certain qualified electors of said City numbering n•ot less than tventy -five per cent. of the number of votes cast for all c•andidatep fT governor in said City at the last preceding election for e of the State of California, ask- ing said Couneillto call an election in, said City to vote upon the auestion " shall the sale of alcoholic, liquors be licensed in this City ", which petition has beer duly certified to be sufficient and correct by the City Clerk of this City; a-rid said certificate being filed with said petition, That, therefore, a special election be and the sane is hereby called within said City to be held on Saturday, the 21st day of October, 1911, at which said question shall be submitted to the qualified elect- ors of said City, and said election is hereby called for such purpose and such proposition submitted. And if he shall fail to make such deposit immediately, then and in that case, his bid shall not be received, and shall be considered as void,, and the said franchise shall be then and there again offered for sale to the bidder who shall make the highest cash bid therefor, subject to the same conditions as to deposit as above mentioned. Said procedure shall be had until said franchise is struck off, sold and awarded to a bidder who shall make the necessary deposit of at least ten per cent, of the amount of his bid therefor, as herein-provided. "The successful bidder and his assigns must during the life of such franchise pay to the said City of San Luis Obispo two per cent, of the gross annual receipts of the person, partnership or corporation to whom the said franchise is awarded, arising from its use, operation or possession, provided that no percentage shall be paid .for the first five years succeeding the date of the fran- chise, but that thereafter such percentage shall be paid annually, and in the event "said payment is not, made said franchise shall be forfeited. "The successful bidder for such franchise shall file a bond running to said City of San Luis Obispo, with at least two good and sufficient sureties to be approved by said Council, in the penal sum of 4&L Dollars, condi,. tioned that such Igdder shall well and truly observe, fulfill and perform each and every term and condition of such franchise and that in case of any breach of condition of such bond the whole I 40 amount of the penal sum therein named shall be taken and deemed to be liquidated damages and shall be recoverable from the principal and sureties upon said bond. Said bond shall be filed with the City Council of said City within five days after such franchise is awarded. ".All pipe and mmEddLom connections shall be buried and main- twined at a sufficient depth below the surface of any street or way along or across which the same shall be laid, as not to inter- fere with the free use of the street or way by the public; and in case of any alteration in the grade line of any:street or way, said pipe shall be relaid so as to conform to such change. "All excavations made in streets, roads or ways in the work of constructing, laying, maintaining, repairing or-replacing said pipe lines and connections, shall be made in strict accordance with such regulations as the said City shall from time to time provide; said all excavations shall be properly refilled after the completion of such work,. and the surface of the street properly repaired and restored as near as possible to its condition before such excavation. "The work of laying said pipes shall be commenoed in good faith within not more than four months from the date of granting said franchise and shall be .completed within not more than three years thereafter, and if said work be not so commenced or com- pleted within the times specified said franchise shall be forfeited. "The, said City of Sari Luis Obispo shall have the right at the expiration of the aforesaid period of thirty-five years to purchase in its entirety the pipe lines property and plant of said grantee or his or its Successors in interest laid, constructed or acquired under the said franchise or used in the' exercise thereof, at a fair valuation. The valuation of the property covered by the 4P V aforesaid option or right to purchase shall be determined by a board of three arbitrators, of whom one shall be-appointed by the City, one by the said grantee or his or its successors in interest, and the third by the two.arbitratore so appointed. Said arbitrators shall be appointed within thirty days after the declaration by the City of its opt -ion to `purchase said property. In case said arbitrators fail to make and file an award within the time herein- after limited, a new board of three arbitrators shall be appointed in the same manner as hereinbefore prescribed, to determine the valuation of said property. The board of arbitrators shall imme- diately upon the appointment of its members enter upon the die- charge of its duties. Any vacancy in the board of arbitrators shall be filled by the party who made the original appointment to the vacant place. The award of the arbitrators mast be made and filed with the City Clerk of said City within three months after their appointment, and a majority of the arbitrators who agree thereto may make such award. The amount of the valuation of said property determined by the arbitrators as hereinbefore: provided shall be paid by the City to said grantee or his or its successors or assigns, in lawful money of the United States, upon the expir- ation.of the aforesaid period of thirty five years or if the award of the arbitrators shall not have been made and filed at the date of the expiration of said period then within after the filing of said award. Upon the making of said payment the title and right of possession_ of all of said property shall pass to the said City of San Luis Obispo. The option to .make such purchase shall be declared by Resolution of the City Council of said City passed not more than one year prior to the expiration of said period of thirty .five years., The value of. this franchise (exclusive of the amount originally paid this City therefor) shall not be considered or taken into account in fixing the aforesaid valuation. r "In the event of any breach, or failure to comply, by the grantee of said franchise, his or its successors or assigns, with any of the terms, limitations- or. conditions thereof, said franchise shall terminate and be forfeited. Lawsof 1917 of the State of California, and this 11 Council having heard all the parties appearing at said hearing both for and against said petitiong now, therefore; the said 12 City Council ordains as follows: - 13 (1) That public convienienoe and necessity require the operation by the Pickwick Stages, Northern Division, a corporation 14 of an automobile service as a common carrier of passengers and express packages over the city streets of the City of San Luis 16 Obispo hereinafter mentioned, and between the termini ofnIos Angeles, California, and San Franeieeo.0aliforntaA°�ROVI3) 16 HOWEVER that the rights and pr.iviledges herein granted may not be $:signed unless the written consent thereto of the Railroad 17 Commi88IDon of the State of California and of this City Council is first had and obtained; 18 (2) That the Pickwick Stages, Northern Division, a corporation, 19 be and they are hereby granted the right to operate the cars and equipemtn set forth in Exhibit "B" annexed to their petition on 20 file herein PROVIDED HOWEVER, that the grantee may substitute one car for another upon filing a deveription of the substituted oar 21 with the City Clerk of the City of San Luis Obispo, AND PROVIDED FURTHER that at all times the said substituted oar is covered by 22 the bond hereinafter provided for; 23 (3) All motorbusses operated under the permit herein granted shall be covered by a bond furnished by a solvent and responsible 24 surety company authorized to do business in the State of California in the sum of ten thousand ($10,000.00) dollars conditioned that 26 the grantee herein shall pay all loss or damage that may resultto . any person or property from the negligent operation of, or 28 defective construction of said motorbus, or which may arise or result fromlany violation of the'•.provisions of any of the ordisancsei 27 of the City of San Luis Obispo or of the laws of the State of California.
