A RESOLUTION ACCEPTING THE OFFER OF MAINO CONSTRUCTION COMPANY TO RENT ON A TEMPORARY BASIS FOR STORAGE OF MATERIALS THE NORTHWEST PORTION OF THE CITY'S PROPERTY LOCATED BETWEEN PALM AND MILL STREETS AND ADJACENT TO OS.OS STREET. BE IT RESOLVED by the Council of San Luis Obispo as follows: That pursuant to the offer made by the Maino Construction Company, the City hereby accepts said offer and agrees to rent, on a temporary basis, for the purpose of storing materials by the Maino Construction Company during the construction by it of a building for the Pacific Telephone & Telegraph Company, the Northwest portion of that certain parcel of real property owned by the City and located between Mill and Palm Streets and adjacent to Osos Street, at a monthly rental of $40.00 per month, to,be due''and payable monthly in advance; and BE IT'FURTHER RESOLZTED.:that'said rental of said premises to said Maino Construction Company by the City.may be, terminated upon the giving of thirty days' written notice by either party, with said property to be restored to -its original condition by the Maino Construction Company. Mayo 6 M RESOLUTION N0. 832 (New Series) A RESOLUTION PROVIDING FOR THE ENFORCEMENT OF LAGTS 'AND REGULATIONS RELATING'TO7, PUBLIC HEALTH BY THE COUNTY HEALTH OFFICER WITHIN THE CITY OF SAN LUIS OBISPO WHEREAS, basic public health services are necessary to protect and promote the health of'the people in counties and cities; and, WHEREAS, the majority of such services can most efficiently be rendered by local departments-of public health; and, THER 01i' these services are not now available to the people of the City of San Luis Obispo; and' WHEREAS, the development of a city health department capable of rendering such services is not economical or practicable for a city the size of the City of San Luis Obispo; and, WHEREAS, the City of San Luis Obispo, because its population is less than 50,000, is not eligible to.receive funds from the State for this purpose under terms of the State Public Health Assistance Bill ( Chapter 1562, Statutes of 1947 ) passed at.the last session of the Legislature; and, WHEREAS, the Health and Safety Code of the State of California, Section 476, provides that "when the governing body of a city in the county consents by resolution or ordinance the county health officer shall enforce and.observe in the city all of the following: a) orders, quarantine regulations', and rules prescribed by the State department; b) statutes relating to.the public health ". NOW, THEREFORE BE IT RESOLVED that the City of San Luis Obispo consents and by this resolution does hereby consent to such enforcement in the City of San Luis Obispo of such statutes, orders, regulations and rules by the health officer of San Luis. NOV1 THEREFORE, BE IT RESOLVED by the City Council of the City of'San Luis Obispo, as follows: That it is the intention of said City Council to call a Special Election and to submit to the qualified electors residing within.said territory, at such election, the question whether said w r territory shall be annexed to, incorporated in, and made a part of the City of San Luis Obispo and that the property within said territory be, after such annexation, subject to taxation equally with the property within said City of San Luis Obispo, to pay all of the bonded indebtedness of said City for the acquisition, construction and completion of various municipal improvements ,.incurred and outstanding at the time of the filing of said petition, and all bonded indebtedness reretofore authorized and to be represented by bonds of said City hereafter to be issued. The territory herein referred to is situated in the County of San Luis Obispo, State of California, is contiguous to the City of San Luis Obispo., and the boundaries thereof are specifically described as follows: Beginning at the point of intersection of the east and north City Limit boundary lines of the City of San Luis Obispo said point of beginning also being the northeast corner of the City Limits of said city; thence northerly and along the northerly prolongation of 1 the east City Limit boundary line of said City to a point of inter- section with the easterly prolongation of the northerly boundary J/ line of Slack Street said northerly boundary line of Slack Street being as shown and delineated on the map of the Phillips Addition as recorded and filed r,ugust 27,1902 in Volumn A page 162 of San Luis Obispo County Records; The estimate for this project was made as accurately as possible to adequately cover the proposed work, and it is usually possible to perform the work within such estimates, resulting in a saving to the Municipality involved, However, an occasion might arise due to conditions beyond our control where es- timated cost may be slightly exceeded, and in that case, we would expect the City to make up the differ- ence between actual cost and the estimate. In these matters, the Railroad is not in position to act as a contractor and make a firm bid, as it is our practice to perform work at actual cost without profit, -and if we were to increase our estimate to a figure that we would be absolutely sure would not be exceeded, it would be detrimental to the City. We have arrangements with,the State of California in connection with crossing protection in- stallations of this nature, where the State agrees to reimburse the Railroad for the actual cost of the project, based on estimates as in this case, and these arrangements have worked out to the satisfaction of all concerned. 2- 321 -3 Mr.-G.
