A RESOLUTION SELECTING AND DESIGNATING CERTAIN
CITY STREETS IN THE -CITY OF SAN LUIS OBISPO TO
BE THE SYSTEM OF MAJOR CITY STREETS PURSUANT TO'
PROVISIONS OF SECTIONS 2050 TO 2054, INCLUSIVE,
OF THE STREETS AND HIGHWAYS CODE OF THE STATE
OF CALIFORNIA.
i
WHEREAS, pursuant to provisions of Sections-2050 to
2054, inclusive:, of.the Streets and Highways Code, the Council
of the City of San Luis.Obispo shall select a.system of major
City Streets."
AND WHEREAS, the city Council desires to revise and
redesignate the existing..-system of major City Streets to effect
certain extensions, additions and.exclusions'therein.
NOW THEREFORE, BE IT RESOLVED, by the Council of the
City of San Luis Obispo that the following named City Streets
be designated as the system of major City Streets within the
meaning of the above Sections of the Streets and Highways Coder
SOUTH STREET from Brook Street to Broad Street.

A RESOLUTION1WARDING TEE CONTRACT FOR THE RE-
SURFACING OF SOUTH BROAD STREET FROM ISLAY STREET
TO THE SOUTH CITY LIMITS. PROJECT NO. 18
WHEREAS, the.Gity Council of the City of San Luis Obispo

did heretofore advertise for bids for the resurfacing of Broad Street
in said City in accordance with plans entitled, "City of San Luis
Obispo"Plan.s and Profile Broad Street" and contract documents and
specifications entitled, "City of San Luis Obispo`, California, Pro-
posals Requirements for Broad Street from Islay .Street to South City
limits. Project No. 18", said.pla.ns, contract documents and specifi-
cations being on file in the office of the City Clerk of the City
of San Luis Obispo.
AND WHEREAS, said City Council fixed Monday, the 18th day of
July, 1949, at the hour of 7:30 o'clock P. M. as the time when.bids
would be 'received, opened and read.
AND WHEREAS, several bids were received by said City Council

and, at the time fixed, were publicly opened, and read.
AND WHEREAS all bids received were carefully examined and
considered by said City Council, and it appearing to said City Council
that the bid'of Valley Paving and Construction Co., Inc., a corporation,
was the lowest and best bid received. and the bid most advantageous to
the City of San Luis Obispo; and it also appearing that said Valley
Paving and Construction Co., Inc., a corporation, was the lowest, regular,
responsible bidder to file a bid.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of San Luis Obispo that it award, and it does hereby award the contract
for the resurfacing of Broad Street in said City to the Valley Paving
and Construction Company, a corporation, at the base amount named in
its bid, received as aforesaid and. now on file, to -wit: The sum of
$15,062.6.5.
This award,
however,
is subject to the final approval of
the State of
California,
Division
of Highways.
AND BE IT FURTHER. RESOLVED, that, upon such approval, the
Mayor 'of the City of San Luis Obispo is hereby authorized to execute
said contract for and on behalf of said City, which execution shall be
attested by the City Clerk.

G;THEREAS, the City Council of the City of San Luis Obispo did in
oben session] on the 18th day of July, 19497 publicly open, examine
and declare all sealed bids for the'contract to,be entered into by
said City for the grater main extension on Ferrini Road from Foothill
Blvd, to Felton Way; and
I�THEREAS, several bids were received, which bids were taken under
advisement by said City Council until its adjourned meeting on the
19th day of July, 1949.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
San Luis Obispo that it does hereby award said contract to Affel R.
Johnson,.Contractor; said bidder being deemed by said City Council
.to have filed the bid most advantageous to the City of San Luis Obispo.
AND.,. BE IT FURTHER RESOLVED that the-Mayor of the City of San Luis

ObisAO, be, and he is hereby authorized to` execute said contra'ct.for and
on behalf of said City, whack execution shall be attested by the City
Clerk; the form of said contract being in accordance with the form here-

A RESOLUTION DECLARING A PUBLIC HEALTH HAZARD
EXISTS IN PORTIONS OF THE PHILLIPS ADDITION
LOCATED IN THE CITY OF SAN LUIS OBISPO AND PRO
VIDING FOR THE NECESSITY OF PUBLIC SEWERAGE
THEREIN.
WHEREAS, under and pursuant to the provisions of Section
2$08, Part I Division 4 of the Streets and Highways Code of the
State of California and as.amended by Statutes :1945, Chapter 271.;
the City Council of the City of San Luis Obispo is authorized to
declare the necessity for the construction of sanitary sewers
within any portion of the City of San Luis Obispo in the interest
of the public health; and
WHEREAS, the County Health Officer, of the County of San
Luis Obispo, California has recommended in a written statement to
the City Council of the City of San Luis Obispo that the .construc-
tion and installation of public sewerage is necessary in the
interest of public health and safety in certain portions of the
Phillips Addition, Taylor Tract, and the Slack Tract located in
the City of San Luis Obispo; and
WHEREAS, the City Council of the City of San Luis Obispo
is desirous of declaring that.the necessity for public sewerage
exists in said certain portions of.the Phillips Addition., Taylor
Tract and the Slack Tract in the City of San.Luis Obispo where
public sewerage does not exist;
NOW THEREFORE, BE IT RESOLVED by the Council . of the City
of San Luis Obispo that public sewerage is hereby declared to be
necessary as a health measure in the following portions of said
Addition and said Tracts;
All of Blocks 2627 29 30,32,33,,41 42, and 43; the
easterly one -hall of Blocks 18 to H, inclusive; the
easterly one -half of Block 34; the westerly one -half
of Block 25; the westerly one -half of Lots 10 and 11
in Block 25; the northerly 190.47 feet of the westerly
one -half of Block 24; the north one -half of Masterly
one -half of Block 40; the westerly one -half of Block 40;
the westerly one -half of Block 39; all of of 8 and 9
in Block 38; all of Lot 10 and portions of Lots 11 and 12
in Block 35; and the easterly 100 feet of Lots 14 to 18
inclusive, in Block 31; all part of the Phillips Addition
as shown oh map filed and recorded August 27, 1902 in
Volume A page 162 of Maps, San Luis Obispo County Records.
All of Lots 1, 2 and 10 in Block 140 of the Slack Tract
as shown on map filed and recorded in the year 1874 in
Volume B page 90 of Maps, San Luis Obispo County Records,
except that southerly ten feet of said Lots 1 and 2
deeded to the County of San Luis Obispo for roadway.

A RESOLUTION DECLARING CERTAIN PORTIONS OF CHORRO STREET,
NORTH BROAD STREET. AND FOOTHILL BOULEVARD TO BE AND CON-
STITUTE BOULEVARDS.
1-THEREAS, under and pursuant to the provisions of Section 24
of Ordinance No. 122 (New Series) of the City of San Luis Obispo,
entitled "An Ordinance Regulating Traffic Upon and the Parking of
Vehicles on the Public Streets of the City of San Luis Obispo,"
as amended by Ordinance No. 124 (New Series) entitled "An Ordinance
Amending Section 24 of Ordinance No.,122 (New Series)," the City.
Council of the City.of San Luis Obispo is authorized to declare any
street or portion of any street within the City of San Luis Obispo
to be and constitute a boulevard; and

WHEREAS, said City Council is desirous of declaring portions
of Chorro Street, North Broad Street, and. Foothill Boulevard to be
and constitute a boulevard;
N014 THEREFORE, BE.IT RESOLVED by the Council of the City of
`San Luis Obispo that the following portions of said streets be and
the same are hereby declared. to be boulevards for the purpose men -.
tioned in Section 24 of said Ordinance No. 122 (New Series):
Chorro.Street from the southerly line of Walnut Street
to the southerly line of Lincoln Avenue. North Broad
Street from the southerly line of Lincoln Avenue to the
southerly line of Mountain View Street. Foothill Boule-

Luis Obispo, be, and he is hereby directed to furnish the Council

gether with a careful estimate of the costs and expenses of such
work, for the construction of a public sanitary sewer system, in-
cluding the installation of sanitary sewer pipes, together with
the necessary outlets, manholes, flush tanks, connecting sewers and
other appurtenances, within that certain district, located in the
City of San Luis Obispo, County of San Luis Obispo, State of Calif-

A RESOLUTION PROVIDING FOR THE EXECUTION BY THE
CITY OF SAN LUIS OBISPO OF A LEASE AGREEMENT
RENTING SPACE IN THE CITY RECREATION TO
THE BUREAU OF INTERNAL REVENUE.
BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
That the City of San Luis Obispo execute that certain
document dntitled " Lease between City of San Luis Obispo, a
Municipal Corporation, and the Bureau of Internal Revenue,
dated June.14th, 1949, whereby said City agrees to rent space
in the City Recreation Building to the Bureau of Internal
Revenue at an annual rental of $1800.00 per year, payable in
monthly installments; and
BE IT FURTHER RESOLVED that the Mayor of the City of
San Luis Obispo, be, and he is hereby authorized to execute
said Agreement for and on behalf of said City, which execution
shall be attested bythe City Clerk.

Lester the sum of $487.02 for the installation by said parties of

MEMORANDUM OF AGREEMENT FOR EXPENDITURE OF
GAS TAX ALLOCATION "FOR MAJOR CITY STREETS.
WHEREAS, a memorandum of agreement has been presented
to be entered into with the State of Cali�ornia in accord-
ance with a project statement submitted by the City of
onn tots M %ig p for expenditure of the gas tax al -:
location to cities for the fiscal year 1950, and
WHEREAS, the city council has heard read said agree-
ment in full and is familiar with the contents thereof;
THEREFORE, be it resolved by the city council of the
City of San Luis Oblape that said project statement
be and it is hereby adopted as the budget of proposed ex-
penditures of the gas tax allocation to cities, and said
agreement be and the same is hereby approved and the mayor
and the city clerk are directed to sign the same on behalf
of said City, said agreement to be binding upon the City
upon its execution by the authorized officials of the State.

RESOLVED, by the City Council of the City of San Luis Obispo,
California, that
WHEREAS, the Health Officer of said City has recommended
to this Council as necessary as a health measure the construc-
tion of vitrified clay pipe sanitary sewer mains, wye branches,
lampholes and standard manholes with cast iron manhole and lamp -
hole frames and covers, together with house laterals opposite al
improved parcels of property and others where requested in
Henderson Avenue from Slack Street to 60 feet south of Abbott
Street, Graves Avenue from Slack Street to Hays Street and from
McCollum Street to Loomis Street, Grand Avenue from Slack Street
to about 75 feet north of Murray Street, Hays Street, McCollum
Street and Hope Street from Grand Avenue to Dana Avenue, and
Loomis Street from Grand Avenue to about 150 feet east of Graves
Avenue, which recommendation was given in writing and has been
spread upon the minutes of this Council;
WHEREAS, this Council intends to undertake proceedings
pursuant to the Municipal Improvement Act of 1913 and the Refund
ing Assessment Bond Act of 1935, as modified by the Municipal
Improvement Act of 1913 for the construction and financing of
said sewers and appurtenances in said streets.,-and to assess
the cost thereof upon the - district benefited; the boundaries
of which district are the coterminous exterior boundaries of
the composite and consolidated area consisting of the following
real property situated in said City;
All of Blocks.26, 27, 29, 30, 32, 33, 41, 42 and 43; the
easterly one -half of Blocks 18 to 22, inclusive; the easterly

OF INTENTION TO CONSTRUCT SANITARY SEWERAGE SYSTEM
PHILLIPS ADDITION
SANITARY IMPROVEMENT DISTRICT NO. 1
RESOLVED, by the City Council of.the City of San Luis
Obispo, California, that in its opinion the public interest and
convenience require, and that it is the intention of said Council
to order the following improvements to be made in said City,
to -wit:
1.. The construction of vitrified clay pipe sanitary sewer

elevations, as shown and delineated upon the plans, profiles
and specifications to be made therefor, as hereinafter provided.
5. There is to be excepted from the work above described
any of such work already,done to.line and grade and marked
excepted or shown not to be done on said plans, profiles and
specifications.
6. Said Council does hereby.adopt and establish as the
official grades for said work the grades . and elevations to be
shown upon said plans, profiles and specifications. All such
grades and elevations are to be in feet and decimals thereof
with reference to the datum plane of the City of San Luis Obispo,
7. Said contemplated improvements, in the opinion of the
City Council of said City, are of more than local or ordinary
public benefit,, and saidCouncil does hereby make the costs and
expenses thereof chargeable upon an assessment district, which
District said Council declares to be the district benefited by
said improvements and to be pay the costs and expenses thereof,
the exterior boundaries of which are the coterminous exterior
boundaries of the composite and consolidated area consisting of
the following real.property situated in said City:

said property having been acquired in the use of a public funct-
ion. The easterly one -half of Blocks 18 and 19, Phillips Tract
and the.closed portion of Wall Street opposite same shall be
assessed.and paid by the San Luis Obispo School District. Said
Council further declares that all public streets, highways,
lanes, courts, alleys and public places within said assessment
district in use in the performance of a public function as such,
shall be omitted from the assessment hereafter to be made to cov
the costs and expenses of said improvements.
9. Notice is hereby.given that serial bonds to represent
unpaid assessments and bear interest at the rate of not to
exceed five per cent per annum, 'will be issued hereunder in
the manner provided in the Refunding Assessment Bond Act of 1935:
.as modified by the Municipal Improvement_'Act of 1913, the last
installment of such bonds shall mature fourteen (14) years from
the second day of July next succeeding ten months from their
date.
10. Except as herein otherwise provided for the issuance
of bonds, all the above work shall be done pursuant to the pro-
visions of the Municipal Improvement Act of 1913, as amended.
11. Reference is hereby made to the proceedings of this
Council, the City Health Officer of the City of San Luis
Obispo, under Section 2808 of the Streets and Highways Code and
Section lb of the Municipal Improvement Act of 1913, as amended.

12. Said proposed.improvements are hereby referred to
the City Engineer of said City, and the officer having charge
and control of the construction of public improvements in and
for said City of the kind described herein, being a competent
Person employed by said City for that purpose; and said City
Engineer is hereby directed to make and file with the City Clerk
of said City a report,in.writing,:presenting the following:
(a) Plans and specifications of the proposed improvements
to be made pursuant to this Resolution of Intention;
(b) Engineer's statement of the itemized and total esti-
mated costs and expenses of said improvements and of the inci-
dental expenses in connection therewith;
(c) Diagram showing the assessment district above re-
ferred to, and also the boundaries and dimensions of the respect
ive subdivisions of land within said district as the same exist-
ed ab the time.of the passage of this Resolution of Intention,
each of which subdivisions shall be given,a separate number upon
said diagram;
(d) A proposed assessment of the total amount`of the cost
and expenses of the proposed improvements upon the several sub-
divisions of land in said district in proportion to the estimate,
benefits to be received by such subdivisions, respectively, from
said improvements, and of-the expenses incidental thereto.
13. If any excess shall be realized from the assessment
it shall be spent for the maintenance of said improvement, unless
the Council shall hereafter determine that said amount or any
part thereof shall be applied as a credit to each assessment
herein.

RESOLVED, by the City Council of the.City of-San Luis Obispo
California; that
WHEREAS, on- the L7th day of 'October, 1949, said
Council adopted its Resolution of Intention No. to con-
struct vitrified clay pipe sewer mains and appurtenances in and
for said City, and did refer the proposed improvements to the
City Engineer of said City, he being the officer having charge
and control of the construction of public improvements in and
for said City of the kind described therein, and being a com-
petent person employed by said City for that purpose, and did
therein direct said City Engineer to make and file with the City
Clerk a report in writing, all as therein more particularly de-
scribed, under and pursuant to'the Municipal Improvement Act of
1913, as amended;
WHEREAS, said City Engineer has made and filed with the City
Clerk a report in writing as called for. in said Resolution of
Intention, and under and pursuant to said Act, which report has
been presented to this Council for consideration.; and
WHEREAS, this Council has duly considered said report and
each and every part thereof, and finds that the same and each and
every part thereof is and are sufficient and that neither said
report nor any .part thereof requires modification in any respect;
NOW, THEREFORE, IT IS ORDERED, as follows:
1. That the plans and specifications for the proposed im-
provement to be made, contained in said report, be, and they are
hereby, preliminarily approved and confirmed;
2. That the Engineer's estimate of the itemized and total
estimated costs and expenses of said improvements and of the

RESOLVED, by the City Council of the City of San Luis Obisp
California, that
WHEREAS, the City Engineer of said City has ascertained the
general prevailing rate of .per.diem wages in the locality in
which said public work.is proposed to be performed for work of a
similar character to that described in Resolution of Intention
No. 1$ N S adopted October 17th, 19+9;
WHEREAS, said rate of'per diem wages is set forth and con-
tained in the specifications for said project, copies of which
are on file in the office of the City Engineer, and also in the
office of the City Clerk of said City;. and
WHEREAS;- this- Council_.has: duly considered said scale and
find the same,to be correct in all particulars;
:NOW, THEREFORE. ,IT IS HEREBY FOUND, DETERMINED AND ORDERED,

is hereby adopted as the prevailing rate of per diem wages for
work of a similar character to that above described in the local-
ity in which such public work is proposed to be performed.

WHEREAS, pursuant to Resolution of Intention No. 918 (New
of this Council, adopted pursuant to the Municipal Improvement
Act of 1913, as amended, the City Engineer of said City has fil
with the City Clerk the written report called for under Section
of said Act, and by said Resolution of Intention, which report
has been presented by said City Clerk to'this Council for con-
sideration, and this Council has considered and preliminarily
approved and confirmed said report and ordered that the same
stand as the report for the purposes of all subsequent proceed-
ings had pursuant to said Resolution of Intention;
NOW, THEREFORE, IT IS ORDERED,. as follows:

at the hour of 8:00 o'clock P. M. in the regular meeting place of
said Council in the Council Chambers, Recreation Building at the
intersection of Santa Rosa and. Mill. Street , San Luis
Obispo, California, be, and the same are hereby, appointed and
fixed as the time and place for hearing protests in relation to
the proposed improvements called for under said Resolution of
Intention and more particularly provided for in said report.
2. That the City Clerk be, and he..is.hereby, directed to
give notice of said hearing by two successive insertions in the

lated in said City, and by'conspicuously posting same along all
the open streets within the assessment district, at not more than

3. That said notices to be posted shall be headed "Notice
of Improvement ", in letters of not less than one inch in height,
and shall, in legible characters, state the fact and date of
the passage of the Resolution of Intention and of the filing of
said report and of the date, hour and place set for the hearing
of said protests, and briefly describe the improvements proposed
to be made, and refer to said Resolution of Intention and Report
for furthur particulars'.
4. That the City Clerk of said City shall mail or cause to
be mailed notices of the adoption of said'Resolution of Intenti
and the filing of said reports postage prepaid, at least twenty'
days before the date set for hearing of said protests, to all
persons owning real property proposed to be assessed, whose name
and addresses appear on _the_ last equalized _assessment- rol -1 for
City taxes prior thereto or as known to the City "Clerk, which
notice shall contain a statement of the time, place and purpose
of the.hearing on said Resolution -of Intention and report and a

SANITARY IMPROVEMENT DISTRICT NO. 1
RESOLVED, by the City Council of the City of San Luis Obispo,
California, that
WHEREAS, the City Council of said City did, on the 17th .
day of 'Uctober, ,. 1949, adopt its resolution of prelim-
inary approval of the City Engineer's report, wherein it did
preliminarily approve the plans and specifications for the con-
struction of vitrified clay pipe sewer mains and appurtenances
in and for said City, and an assessment and diagram to be con-
firmed in accordance with a total and itemized estimate of the
costs and expenses thereof, all as more particularly described
and set forth in Resolution of Intention No .918 NS adopted by
said Council on October I7th , 1949;
NOW, THEREFORE, IT IS ORDERED that the City Clerk of said
City is hereby directed to publish twice in the
Telegram- Tribune a newspaper of general circula-
tion published and printed in said City, a notice inviting sealed
proposals or bids for the construction of said improvements, and'
referring to the plans and specifications on file in the office
of the City Clerk, the,first publication of which shall be at
least ten days prior to the date of opening bids
All proposals or bids shall be accompanied by a certified
check payable to the order of the City, amounting to ten per
cent of the bid, or by a bond in said amount and payable to said
City, signed by the bidder and two sureties who shall justify
before any officer competent to administer an oath, in double
said amount, and over and above all statutory exemptions, or by
a corporate surety. Said check shall be forfeited or said bond
shall become payable to said City in case the bidder depositing

the same does not, within fifteen days after written notice that
the contract has been awarded to him, enter into a contract with
the City, the faithful performance of which shall,be secured by
an undertaking in the amount of 50% of the amount so bid, with

Enclosed is Resolution Requesting payment by School.Board. This
is done under Sec. 18004 of the Educations Code.
You will note therein that we have provided that they will be
assessed prorata.. You or the engineer should take the matter up.with
the Sch®1 Board, stating they are paying on the Game basis as anybody
else and that we are hopeful of receiving bids below the estimate.
However, if we do not they should still pay on the same basis as
anybody else if the project proceeds. The project will be on competitive
bids and for cash which should be most favorable to them.

'WHEREAS, this Council has undertaken proceedings pursuant
to the Municipal Improvement Act of 1913.,for the construction of
vitrified clay pipe sanitary sewer mains, wye branches, lamp -
holes and standard manholes with cas't.iron manhole and'lamphole
frames and covers, together with house laterals opposite all im-
proved parcels of property and,others.where requested in Hender-
son Avenue from Slack Street to 60 feet south of Abbott Street,
Graves Avenue from Slack Street to Hays Street and from McCollum
Street to Loomis Street, Grand Avenue from Slack Street to about

WHEREAS, The City of San Luis Obispo entered into an
Agreement with the California Physicians' Service ( The Blue
Cross Plan) and agrees to make authorized dues deductions for
eligible persons on the payroll who subscribe to the service
and to subsequently forward the -total amount to the Hospital—
Service _ , together with the reports
necessary to maintain accurate and complete membership files.
NOW THEREFORE, BE IT RESOLVED by the City Council

SANITARY IMPROVEMENT DISTRICT NO. 1
RESOLVED, by the City Council of the City of San Luis
Obispo, California, that
WHEREAS, on the 17th'day of October, 1949, said City Counc
adopted its Resolution of Intention No. 918 N. S. to construct
and install sanitary sewer mains and appurtenances in said City,
and referred the proposed improvements to the City Engineer of
said City, he being the officer having charge and control of the
construction of street improvements in and for said City of the
kind described in said Resolution, and being a competent person
appointed by said City Council for that purpose;
WHEREAS, said City Council thereby directed said .City
Engineer to make and file with the City Clerk of said City a
report in writing, in accordance with and pursuant to the Munici-
pal Improvement Act of 1913, as amended;
WHEREAS, said report was duly made and filed with the City
Clerk of said City, whereupon said City Clerk presented it to
the City Council for consideration;
WHEREAS, said City Council thereupon duly considered said
report and each and every part thereof; and found that it contain
ed all the matters and things called for by the provisions of
Section 2 of said Act, including (1) plans and specifications of
the proposed improvement, (2) estimate of costs, (3) diagram
of district, and (4.) an assessment according to benefits, all of
which was done in.the form and manner required by said Act;
WHEREAS, said City Council found that said report and each
and every part thereof was sufficient in every particular and

determined that it should stand as the-report for all subsequent
proceedings under said Act, whereupon said City Council, pursuan
to the requirements of said Act,.appointed Monday, the 21st day
of November, 1949, at the hour of eight o'clock P. M. of said d
in the Council Chambers in the Recreation Building at the inter -
section of Santa Rosa and Mill Streets in said City, as the
time and place for hearing protests in relation to said proposed
improvements, and directing the City Clerk of said City to give
notice of said hearing as required by•said Act;
WHEREAS, it appears that notices of said hearing were duly
and regularly posted, mailed and published in the time, form and
manner required by said Act, as evidenced by the affidavits on
file with said City Clerk, whereupon said hearing was duly and
regularly held at the time and place stated in said notices; and
WHEREAS, persons interested, objecting to said
improvements, or to the extent of the assessment district, or to
the proposed diagram or assessment or to the grades at which sai
work will be done, or to the'City Engineer's•estima:te of the
costs and expenses thereof, filed written protests with the City
Clerk of said City at or before the time set for hearing, and
all persons interested desiring to be heard were given an oppor-
tunity to be heard, and all matters and things pertaining to
said improvements were fully heard and considered by said Counc
and said
City Council has acquired jurisdiction to order said improve-
ments and the confirmation of said diagram and assessment to pay
the costs and expenses thereof;
NOW, THEREFORE,'said City Council does hereby FIND.. DE-
TERMINE and ORDER, as follows:
1. That the owners of one -half of the area to be assessed
for the cost of the project did not, at or prior to the time

fixed for said hearing, file written protests against the said
proposed improvements as a whole, or against the district or the
extent thereof to be assessed for the costs and expenses of said
improvements as a whole, or as to the City Engineer's estimate o
said costs and expenses, or against,the grades at which said wor
is provided to be done, or against the diagram or assessment to
pay for the costs,and,expenses thereof.
2. That the district benefited by said improvements and 1
be assessed to pay the costs and expenses thereof, and the exter
for boundaries thereof are more particularly described in Resol
tion of Intention No. 918 N. S. and made a part hereof by ref-
erence thereto. There is excepted from the assessment Lots 6
and Tin Block 25 and,any other Tots which may be acquired by
the Highway Division of the Board of Public Works of the State
of California prior'to the confirmation of the assessment herein,
said property.having been acquired in the use of a public func-
tion. The easterly one -half of Blocks 18 and 19, Phillips Tract
and the closed portion of Wall Street opposite same shall be
assessed and paid by the San Luis Obispo School District. Said
Council declares that all public streets, highways, lanes,
courts, alleys and public places within said assessment district
in use in the performance of a public function as such, shall be
omitted from the assessment hereafter to be made to cover the
costs and.expenses of said,improvements.
3. That the plans and specifications for the proposed im-
provements, contained in said .report, be, and they are hereby,
finally adopted and approved as the plans and specifications to
which said work shall be done as called for in said Resolution
of Intention.
4. That the City Engineer's estimate.of the itemized and
total estimated costs and expenses of said improvements, and of
the incidental expenses in connection therewith, contained in

as the Engineer's total and detailed estimate of the costs and
expenses of said improvements.
5 That the public interest and convenience require, and
said City Council does hereby.order the improvements to be made
as described in, and in accordance with, said Resolution of
Intention on file in the office of the City Clerk of said City,
reference to which is hereby made for a more particular descrip-
tion of said improvements, and also for further particulars pur-
suant to the provisions of said Municipal Improvement Act of
1913s as amended.
6. That the diagram.showing the assessment district re-
ferred to and described in said Resolution of Intention, and also
the boundaries and dimensions of the respective subdivisions of
land within said district -as the same existed at the time of the
passage of said Resolution of Intention, each of which subdivi-
sions having been given a separate number upon said diagram, as
contained in said report, be and it is hereby, finally approved

7, That the assessment of the total amount of the costs
expenses of the proposed improvements upon the several subdivi-
sions of land in said district in proportion to the estimated
benefits to be received by said subdivisions, respectively, from
said improvements to be done-, and of the expenses incidental

thereto, contained in said report, be, and`the same is hereby,
finally approved and confirmed as the assessment to pay the cost
and expenses of said improvements.
8. That said City Engineer's report be, and the same is
hereby, finally adopted and approved as a whole.
9; That the City Clerk shall forthwith deliver to the
Superintendent of Streets the said assessment .14 together with

diagram thereto attached and made a part thereof, as confirmed by
this City Council, with his certificate of such confirmation
thereto attached and of the date thereof; and that said Superin-
tendent of Streets shall forthwith record said diagram and assess
went in his office in a suitable book to be kept for that pur-
pose, and append thereto.his certificate of the date of such
recording, and such recordation shall be and constitute the
assessment roll herein.
10. That said Superintendent of Streets, upon the record-
ing of said diagram and assessment, shall mail to each owner of
real property within the assessment district at his last known
address as the same appears on the tax rolls of the City, or on
file in the office of the City Clerk of said City, or to both
addresses, if said address is not the same, or to the general de-
livery when,no address so appears, a statement containing a
designation by street number or other description of the property
assessed sufficient to enable the owner to identify the same,
the amount of the assessment, the date of the recordation of
said assessment, the time and place of payment thereof, the ef-
fect of failure to pay within such time, and a statement of the
fact that bonds will be issued on unpaid assessments pursuant to
the Refunding Assessment Bond Act of 1935, as modified by the
Municipal Improvement Act of 1913, the last installment of such
bonds shall mature fourteen (14) years from the second day of
July next succeeding ten months from their date.
11. That said Superintendent of Streets shall also give II
notice by publishing a copy of a Notice to Pay Assessments by
three successive insertions in the
Telegram - Tribune , a newspaper published in said
City, that said assessment.has been recorded in his office, and
that all sums assessed thereon are due and payable immediately,

sixty (60) days after the date of recording said assessment,
which date shall -be stated'in said notice, and of the fact that

That the City Council of the City of San Luis Obispo
does herewith approve.the application of the Housing. Authority of
the County of San Luis Obispo to the Public Housing Administration
for a preliminary loan solely for the purpose of covering the cost
of conducting a survey, said survey to be for the purpose of deter-
mining whether or not there now exists in the City of San Luis Obispo
a need for low rent public housing units at rentals within the means
of low income families,
BE IT FURTHER RESOLVED that the application of the afore-
said Housing. Authority of the County of San Luis Obispo shall not in

LUIS OBISPO AND WILLIAM DECKER HOLDREDGE, AR-
CHITECT.
BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
That the City of San Luis Obispo enter into that cer-
tain agreement entitled "ARCHITECT'S AGREEMENT" dated the L
day of �� , 1950, whereby WILLIAM DECKER HOLDREDGE agrees
to draw plans for, and render complete architectural services in
connection with, the proposed City Hall to be erected at the north-
west corner of Palm and Osos streets; and the City agrees to pay
for said services under the terms and conditions set forth in said
agreement; and
BE IT FURTHER RESOLVED that the Mayor of the City of
San Luis Obispo be, and he is hereby authorized to execute said
agreement for and on behalf of said City, which execution shall

A P.ESOLUTION AWARDING CONTRACT FOR TORO
STREET WATER LINE I- APROVEMENT.
WHEREAS, the City Council of the City of San Luis Obispo
did heretofore advertise for bids for the Toro Street water line
improvement from Palm to Walnut streets in said City in accordance
with plans entitled, "Plans and Profile Toro Street Water Line
Improvement "', and contract documents and specifications entitled,
"Proposals Requirements for San Luis Obispo, California, for Toro
Street Water Line Improvement from Palm Street to Walnut Street ",
said plans, contract documents and specifications being on file
in the office of the City Clerk of the City of San Luis Obispo.
AND WHEREAS, said City Council fixed Monday, the 6th
day of February, 1950, at the hour of 7:30 o'clock P.11. as the
time when bids would be received; opened and read.
AND W?-TEREAS, several bids were received by said City
Council and, at the time fixed, were publicly opened, and read.
AND WHEREAS all bids received were carefully examined
and considered. by said City Council, and it appearing to said
City Council that the bid of Allan Richard Ochs was the lowest
and. best bid received and the bid most advantageous to the City
of San Luis Obispo; and it also appearing that said Allan Richard
Ochs was the lowest, regular, responsible bidder to file a bid.
NOT THEREFORE, BE IT RESOLVED by the City Council of
the City of San Luis Obispo that it award, afld it does hereby
award the contract for the Toro Street Water Line Improvement
from Palm to Walnut Street in said City to Allan Richard Ochs
at the base amount named in its bid, received as aforesaid and
now on file, to wit: The sum of $2695.00.

interest coupons affixed thereto shall .be signed by said City
Treasurer or bear his engraved, printed or lithographed signature;
and such signing and sealing of said bonds by said officers and
signing of said coupons by.said City Treasurer shall constitute and
be a sufficient and binding execution of each and every one of
said bonds and all of the coupons thereof.respectively. Said bonds'
shall be substantially in the form'set forth in the Refunding
Assessment Bond Act of 1935, said officers of said City are hereby
authorized and directed so to sign respectively.
The interest coupons attached to each of said bonds and
evidencing the interest to accrue thereon shall be numbered consec-

RESOLVED, by•the.City Council of the City of San Luis
Obispo, California, that.
1. The City Clerk of said City be, and he is hereby,
directed to call for bids for the sale of improvement bonds to be
issued pursuant to Resolution of Intention No. 918 N.S. adopted
by the said Council on October 17,'1949, said bids to be received
by said City Clerk at or before the hour of eight o'clock P.M.

BE IT RESOLVED by the Council of the City of San Luis Obispo

That that certain grant:. deed executed February 24, 1950, by
Edwin A. Brown and Vernice M. Brown and conveying to the City of
San Luis Obispo a portion of the NE quarter of the NE quarter of
Section 27, Township 30 South, Range 12 East M. D. M. be and the
same is hereby, accepted by said City; the consideration therefore
being that the City will at its own expense, cause said portion
of land to become a part of Foothill Boulevard, and improved in

WHEREAS the Council of the City of San Luis Obispo has
called a Special Municipal Election to be held on June 69 1950,
at which Election a proposed Initiative Ordinance is to be
voted upon by the people of the City of San Luis Obispo; and
WHEREAS the Direct Primary Election is to be held on
the same date; and
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of San -Luis Obispo as follows:
That, pursuant to Section 10050 of the Elections Code
of the State of California, the Board of Supervisors of the

A RESOLUTION REGARDING SIDNEY STREET SEWER
LINE E %TENSION **
WHEREAS certain owners of property on Sidney Street in
the City of San Luis Obispo, have agreed to advance the money
necessary to install a main sewer line, together with 14 con-
necting laterals on said Sidney Street from Augusta Street to
point 200 east of Johnson Avenue; said sewer line and laterals
to be Constructed in conformity with plans and specifications
prepared by the City Engineer, and under the Supervision of
said City Engineer.
NOW,THEREFORE, BE IT RESOLVED-by the Council of the City
of San Luis Obispo as follows:
That the Building Department of the City of San Luis Obispo
be instructed not to issue any permits to any private individual,
owning proper�r fronting on said Sidney Street main sewer line,
to connect with said line until said private individual has first
furnished a statement in writing signed by George L. Andre, City
Attorney, declaring that said individual has paid, or reimbursed,,
to the contributing property owners, his property's proportionate
share of the installation of said sewer line and laterals.

WHEREAS, under and pursuant to the provisions of Section
24 of Ordinance No. 122 (New Series) of the City of San Luis
Obispo, entitled "An Ordinance Regulating Traffic Upon and the
Parking of Vehicles on the Public Streets of the City of San
Luis Obispo," as amend.ed, the City Council of the City of San
Luis Obispo is authorized to declare any street or portion of
any street within the City of San Luis Obispo to be and con-
stitute a boulevard; and
WHEREAS, said City Council is desirous of declaring a
portion of Foothill Boulevard to be and constitute a boulevard;
NOW THEREFORE, BE IT RESOLVED by the Council of the City
of San Luis Obispo that Foothill Boulevard from the westerly
line of Ferini Road to the Westerly line of Broad Street, be and
the same is hereby declared to be a boulevard for the purpose

BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
That the City Council of the City of San Luis Obispo,
County of San Luis Obispo, State of California has found and
determined and does hereby find and determine, that the public
interest end necessity require the acquisition, construction,
completion and maintenance by the said City of San Luis Obispo
of a public improvement, to wit: A sewer line from Reba Street
to South Street and that the property hereinafter described is
necessary therefor1
BE IT FURTHER RESOLVED that the City Attorney for said
City of San Luis Obispo be, and he is hereby authorized and
directed to file such condemnations suit or suits as may be
necessary to acquire the necessary sewer right of way for said
sewer line, and to prosecute the same in any and all proper
Courts in the name of the City of San Luis Obispo as plaintiff,
against any and all proper persons as defendants necessary to
acquire said sewer right of way.
BE IT FURTHER RESOLVED, that the said City Attorney be,
and he is hereby further authorized and directed to seek the
immediate possession of said sewer right of way and that the

sum as may be directed by the Judge of the Superior Court to be
reasonably adequate to secure the owner or owners of the right of

A RESOLUTION APPOINTING THE MAYOR OF THE CITY OF
SAN LUIS OBISPO AS AUTHORIZED AGENT FOR THE CITY
OF SAN LUIS OBISPO IN THE APPLICATION FOR PURCHASE
OF SALINAS RIVER DAM SITE AND FACILITIES.
WHEREAS, it appears necessary and desireable that
the City of San.Luis Obispo make its application to the Pub-
lie Health Service, Federal Security Agency, for the purchase
of the Salinas River Dam Site and facilities; and
WHEREAS, it is necessary to designate some officer
of the City of San Luis Obispo to sign all necessary papers
and conduct any and all negotiations,
NOW, THEREFORE; BE IT RESOLVED by the Council of
the City of San Luis Obispo that Timothy I, O'Reilly, Mayor
of the City of San Luis Obispo, be, and he is hereby appoint-
ed such agent for the City of San Luis Obispo to sign all ,

WHEREAS, the City Council of the City of -San Luis Obispo
did heretofore advertise for bids for the resurfacing of Chorro
Street and Hathway Avenue in said City in accordance with plans
entitled, "City-of San Luis Obispo Plans of Chorro Street and
Hathway'Avenue;.and contract documents and specifications en -,
titled., "City of'San Luis Obispo, California,'Proposal Require-
ments for Chorro Street from Stenner Creek-Bridge to Murray Ave.

plans, contract documents'and specifications being on file in the
office of the City Clerk of the City of San Luis Obispo.
AND WHEREAS,. said.City Council fixed Saturday, the 24th day
of June, 1950, at the hour of 12:'00 o'clock Noon as the time when
bids would be received, opened and read.
AND WHEREAS, several bids were received by said'City Council
and, at the time fixed, were publicly opened, and read.
AND WHEREAS,, all bids received were carefully examined and

Council that-the bid of Madonna Construction Co. in the_ amount
` of 86497.00 was the lowest and best bid received

agreement entitled, "Amendment to Lease of War Public Works"
between the United States of America and the City of San Luis
Obispo, relating to the lease, with option to purchase, of the
City Recreation Building and site; the purpose of said amendment

32 instead of a portion only as provided originally in said
lease- option agreement.

WHEREAS, under and pursuant to the provisions of Section 24
of Ordinance No. 122 (New Series) of the City of San Luis Obispo,
entitled "An Ordinance Regulating Traffic-Upon and the Parking of
Vehicles on the Public Streets of the City of San Luis Obispo," as
amended, the City Council of the City of San Luis Obispo is author-
ized to declare any street .ortportion of any street within the City
of San Luis Obispo to be and constitute a boulevard; and
WHEREAS, said City Council is desirous of declaring portions
of Hathaway Avenue, Johnson Avenue, Broad Street, Nipomo and Villa
Streets, and Foothill Boulevard to be and constitute boulevards;

constructing and completing the following municipal improvements
of said City, to wit
The constructing, altering and acquiring facilities for
the improvements of the quality of the municipal
water supply by rapid sand filtration and related
treatment processes, including land, structures,
pipework, labor, equipment and appurtenances therefor,
was submitted to the voters of said City; and the City Council of
said City did meet and canvass the returns of said election on
the 25th day of November, 1949, and thereafter on the 28th day of
November, 1949, did count and canvass all absent voter ballots
cast. at said election; and said City Council did as the result of
said canvass determine and declare, and doiahereby certify., that
said proposition received at said election, the affirmative vote
of more than two- thirds (2/3) of all the voters voting on said
proposition at said election, and was thereby carried and adopted
by said election, and the issuance of said bonds by said City was
duly authorized.
NOW THEREFORE, BE IT RESOLVED by the Council of the

City of San Luis Obispo, State of California, as follows:
Section 1. That all acts, conditions and things required
by law to exist, happen and be performed precedent to and in the
issuance of said bonds have existed, happened and been performed in
due time, form and manner as required by law, and said City of San
Luis.Obispo is now authorized pursuant to each and every require-
ment of law to incur indebtedness in the manner and form as.in this
resolution provided.
Section 2. That the bonds of the City of San Luis Obispo,
in the aggregate principal sum of $300,000.002 to be known as the
"City of San Luis Obispo Filtration Plant Bonds of 1950" shall issue
to pay the cost of the acquisition, construction and completion of
the following municipal improvements of said City, to -wit:

Section 3. That said bonds shall be issued as herein-
after set forth and shall be sold in accordance with law at not
less than their par value and accrued interest. Said bonds shall
be negotiable in form and of the character known as serial, and
shall be 300 in number, numbered consecutively from 1 to 300, both
inclusive, of the denomination of $1,000.00 each. All of said
bonds shall bear interest from their date until paid at the rate
or rates set forth in the proposal of the successful bidder for
said bonds, but not to exceed five per cent (5 %) per annum, pay-
able semi - annually, which interest shall be evidence by coupons
attached to each bond, and each of said coupons shall represent
six (6) month's interest on the bond to which it is attached.

Section 5.. For the purpose of paying the principal and
interest of said bonds, the Council of the City of San Luis Obispo,
shall, at the time of fixing the general tax levy and in the manner
for such general tax levy provided, levy and collect annually each
year, until such bonds are paid or until there shall be a sum in the
treasury of said City set apart for the purpose, to meet all sums
becoming due for principal and interest on said bonds, a tax suf-
ficient to pay the annual interest on said bonds as the same be-
comes due, and also such part of the principal thereof, as shall
become due before the proceeds of a tax levied at the time for
making the next general tax levy can be made available for the
payment of such principal, provided, however, that such tax shall
be levied and collected at the time and in the manner aforesaid,
annually each year sufficient to pay the interest on such in-
debtedness as it falls due and also.to constitute a sinking fund
for payment of the principal thereof on or before maturity.
Said tax shall be in addition to all other taxes levied
for municipal purposes, and shall be collected at the same time and
in the same manner as other municipal taxes are collected, and as
collected shall be forthwith paid into the fund for which the same
was levied and collected. Such fund shall be designated as "Fil-
tration Plant (1950) Bond Interest and Sinking Fund ", and all ` scume ----

to become due for the principal and interest on said bonds shall
be paid from such fund. There shall likewise be deposited in said
fund and moneys received on account of interest accrued on said
bonds from their date to the date of delivery and actual payment of
the purchase price thereof.
Section 6. The Mayor of said City of San Luis Obispo and
the Treasurer of said City are hereby authorized and directed, re-
spectively, as such officers, to sign each of said bonds on behalf
of said City, and the City Clerk is hereby authorized and directed
to countersign each of said bonds and to affix the official seal
of said City thereto; and the said Treasurer is hereby authorized
and directed to sign each of the interest coupons¢ either by his
own hand or by lithographed or engraved factimile signature; and
such signing, countersigning and sealing shall be a sufficient
and binding execution of said bonds and coupons by said City. In
case any of such officers whose signatures or countersignatures
appear on the bonds or coupons shall cease to be such officer be-
fore the delivery of such bonds to the purchaser, such signature
or countersignature shall nevertheless be valid and sufficient for
all purposes the same as though he had remained in office until
the delivery of the bonds.
Section 76 There is hereby created and established a
fund to be known as °Filtration Plant Fund of 195011, which shall
be kept by the Treasurer of said City; and all proceeds of sale
of said bonds (other than accrued interest received on the sale
of said bonds) shall be placed by the Treasurer to the credit of
said fund, and shall be applied exclusively to the acquisition,
construction and completion of the aforesaid municipal improvement.
Section 8. The City Clerk is directed to cause to be
lithographed, printed or engraved a sufficient number of bonds and
coupons of suitable quality, and to cause the blank spaces thereof
to be filled in to comply with the provisions hereof, and to pro-
cure their execution by the proper officers, and to deliver them,
when so executed, to the Treasurer of said City, who shall safely
keep the same until they shall be sold by the Council; whereupon
he shall deliver them to the purchaser or purchasers thereof, on
receipt of the purchase price. Said Mayor, Treasurer and City
Clerk are further authorized and directed to make, execute and
deliver to the purchaser of said bonds a signature and no— litigation
certificate in the form customarily required by purchasers of
municipal bonds generally, certifying to the genuineness and due
execution of said bonds and further certifying to all facts within
their knowledge relative to any litigation which may or might
affect said City, said officers or said bonds, and said Treasurer
is further authorized and directed to make, execute and deliver to
the purchaser of said bonds a Treasurer's receipt-in the form

RESOLUTION NO. 1000 (New Series)
A RESOLUTIONd REGARDING CIVIL DEFENSE AND DISASTER
ORGANIZATION OF THE CITY OF SAN LUIS OBISPO.
WHEREAS, Ordinance No. 342 (New Series) of the City
of San Luis Obispo relating to civil defense and disaster pro-
vides that the civil defense and disaster organization, the
distribution of civil defense powers and duties, the assignment
of functions and services and the recruitment, direction and
training of personnel shall be prescribed by resolution adopted
concurrently with the adoption of said ordinance now, therefore,
BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
Sec. 1. The civil defense and disaster organization of
this city shall be as hereinafter more particularly described
and as shown on the attached chart marked Exhibit A and entitled,
"Suggested Model Local Organization of Civil Defense ". Said
Exhibit A, including all information shown thereon, is as much
a part of this resolution as if the materials and information
- set forth by said exhibit were all fully described herein.
Sec. 2. DIVISION OE OPERATING SERVICES. There is hereby
created a Division. of Operating Services. For the purposes.of
civil defense planning and organization, the chief of each opera
Ling service within this division shall be responsible to the
director through the assistant director.
Within this division, there shall be the following civil
defense and disaster services:
(1) Fire Service;
(2) Law enforcement service, which shall include the
plant protection service;
(3) Engineering service, which shall include utility
service, shelter protection and rescue service;
(4) Health and medical services, which shall include
special weapons defense; and,
(5) Emergency welfare service, which shall include
mass feeding, clothing and shelter.
The director shall appoint a chief of each such service,
except as hereinafter provided. The chief of the fire depart-
ment of the City of San Luis Obispo shall be chief of the fire
service. The chief of police of the City of San Luis Obispo
shall be chief of the law enforcement service. The city engin-
eer or director of public works of the City of San Luis Obispo
shall be chief of the engineering service.
Sec. 3. DIVISION OF SPECIAL SERVICES. There is hereby
created a division of special civil defense and disaster services.
This division shall be under the direction and control of a deputy
director 'of civil defense, who shall be appointed by the director.
For the purpose of civil defense and disaster planning and organi-
zation, the deputy director is responsible to the director through
the assistant director of civil defense and disaster.
Within this division there shall be the following services;

which shall include

recruitment of civilian auxiliaries to mili-
tary activities; and,
General administration service.
The director shall appoint a chief of each such service
who shall be responsible to the deputy director of the Division
of Special Services. The Director may appoint the same person
as chief of two or more services. (As may be justified by
local conditions.)
Sec. 4. LEGAL. The city attorney shall serve as the
legal advisor to the director of civil defense and to the civil
defense organization.
Sec. 5. AIERICAN RED.CROSS. The American Red Cross in
the City of San Luis Obispo will, in natural disaster, furnish
food, clothing, shelter, registration and information service,
supplementary medical service when requested, and rehabilita-
tion to individuals and families affected by the disaster.
In war- caused disaster,. the American Red Cross will fur-
nish only food, clothing and shelter to affected individuals
and families.
The American Red Cross will provide funds with which to
finance all its relief operations during natural disaster. Civil
defense financing will be provided by public or private agencies
other than the Red Cross for Red Cross functions and war- caused
disasters.
The director shall be responsible for arranging, through
the chairman of the local Red Cross chapter, for the parcipi-
tation of the Red Cross in civil defense as part of the mass
care service in case of war- caused disaster, and for the re-
lationship between the Red Cross and the civil defense organi-
zation in case of natural disaster.
Sec. 6. DUTIES. The civil defense and disaster duties
of the deputy director and the chiefs of operating services
and special services shall be as described in "United States
Civil Defense," National Security Resources Board Document 128,
dated September 8, 1950, copies of which shall be filed in the
office of the city clerk for use and examination by the public.
Such duties as described in'United States Civil Defense" may be
changed from time to time by the director by written administra-
tive orders, particularly for the purpose of conforming to re-
commendations of the State Director of Civil Defense or subse-
quent modifications recommended by the Federal Civil Defense
Administrator. Upon recommendation of the civil defense and
disaster council of the City of San Luis Obispo, such duties
shall be changed in accordance with such recommendations.
