In cases where it is difficult to secure o_ualified personnel., or if a parson of unusual qualifications is hired, the City Council may authorise the Administrative Officer to hire at the second or third stop, If a person is hired at the second or third step9 he shall receive the neat step when he has fijlr*d the time requirement for such advanced stop as outlined below and is so approved by the Council for advancement. 2. The second step._is an incentive adjustment to encourage an employee to improve his work° Employrees may be advanced to the second stop following the campletion'of.six months satisfactory service, upon ivcommerbdation by their %WpArtmeyit head and the Administrative Officer and approval by the City'Councllo.: 3a The third step represents the middle value.of the salary range and is the rate at uhi.ch a dilly qualified, experienced and ordinarily conscientiow. employee may expect to be paid after a reasonable period of satisfactory service. The fourth step is to be awarded only in case of work which is well above average for this class. PROJECT -UNIT II RESOLVED, by the City Council of the City of San Luis Obispo, California, that WHEREAS, the said Council did, on the 5th day of May, 1958, adopt its Resolution No. 361 -19.58 Series of Preliminary Deter- mination and of Intention to order the construction of sanitary sewer mains, sanitary sewerage lift station, water mains and appurtenances in said City, all as more particularly described and set forth as Project Unit II in said Resolution of Prelim- inary Determination and of Intention. S -58 =1 RESOLVED, by the City Council of the City of San Luis Obispo California that' WHEREAS, on the 5th day'of May, 1958, said Council adopted its Resolution No. 361 - 1958 Series of Preliminary Deter- urination and of Intention that the public interest, convenience and necessity required and that it intended to order certain improvements therein particularly described, and referred the proposed improvements to the City Engineer of said City, he being. the officer having charge and control of the construction of public improvements in and for said City of the kind described in said Resolution, and being a competent person employed by said City for that purpose; WHEREAS,-said Council thereby directed said City Enginee to make and file with the Clerk of said City a report in writing, in accordance with and pursuant to the Municipal Improvement Act of 1913; WHEREAS, said report was duly made and filed with the Clerk, whereupon -the Clerk presented it to said Council for con- sideration; WHEREAS, said Council thereupon duly considered'said report and each and every part thereof, and found that it contain all the matters and things called for by the provisions of said Act, including (1) Maps.and descriptions of lands and easements to be acquired, (2) Plans and specifications of the proposed improvements, (3) Estimate of costs, (4) diagram of district, and -(5) An assessment according to benefits, all of which was done in the form and manner required by said Act; -T,q i WHEREAS, said Council found that said report and each and every part thereof was sufficient in every particular and determined that it should stand as the report for all subsequent proceedings under said Act and Resolution of Preliminary Deter- mination and of Intention, whereupon said Council, pursuant to the requirements of said Act, appointed Monday the 9th day of June, 1958, at the hour of 7:30 o'clock P.M. of said day in the Council Chambers, City Hall, San Luis Obispo, California, as the time and place for hearing protests in relation to said proposed acqui- sitions and improvements, and directed the Clerk of said City to give notice of said hearing as-required by said Act; WHEREAS, it appears that notices of said hearing were duly and regularly posted and published in the time, form and manner required by said Act, as. evidenced by the affidavits on file with said Clerk, whereupon said hearing was duly and regular- ly held at the time and place advertised in said notices; WHEREAS, thirteen persons interested, objecting to said acquisitions and improvements, or to the extent of the assess- ment district, or to the proposed assessment or diagram, or to the maps and descriptions or to the grades'at which said work will be done, or the Engineer's estimate of the costs and expenses thereof filed written, protests with the Clerk of said City at or before the time set for said hearing, and all persons interested desiring to be heard were given an opportunity to be heard, and all matters and things pertaining to said acquisitions and improvements were fully heard and considered by said Council; NOW, THEREFORE, said Council does hereby FIND, DETERMINE AND ORDER, as follows: 1. That the owners of one -half of the area of the pro- perty to be assessed for the cost of said project did not at or prior to the time fixed for said hearing, file written protests against the said acquisitions and improvements, or as to the Engineer's estimate of costs and expenses of said project or -2- c � against the maps and descriptions, or against the grades at which said work is provided to be done, or against the diagram and assessment to pay for the costs and expenses thereof. 2. That any and all protests made either to the ques of the public interest, convenience and necessity of making said acquisitions and improvements under said Resolution of Preliminary Determination and of Intention, or to*said proposed acquisitions and improvements, or the grades to which said work is proposed to be done, or the extent of the assessment district, or the maps and descriptions, or the amounts of the several assessments, and all persons desiring to be heard in relation to,any of said matters, whether as protestants or otherwise, have been fully heard and considered, and are hereby overruled. 3. That the public interest, convenience and necessity require the acquisitions and improvements in the manner proposed, and Division 4 of the Streets and Highways Code shall not apply. 4. That the district benefited by said acquisitions and improvements and to be assessed to pay the costs and expenses thereof, and the exterior boundaries thereof, is the district described in said Resolution of Preliminary Determination and of Intention. 5. That the Engineer's estimate of the itemized and total costs and expenses of said acquisitions and improvements, and of the incidental expenses in connection therewith, contained in said report, be, and it is hereby, finally adopted and approved as the Engineer's total and detailed estimate of the costs and expenses of said acquisitions and improvements. 6. That the plans and specifications for the proposed improvements, contained in said report,b=_, and they are hereby, .finally adopted and approved as the plans and specifications to', which said work shall be done as called for in said Resolution of Preliminary Determination and of Intention. 7. That the diagram showing the assessment district referred to and described in said Resolution of:Preliminary Deter- mination and of Intention, and also the boundaries and dimensions of the respective subdivisions of land within said district as the same existed at the time of the passage of said Resolution, each of which subdivisions having been given a separate number upon said diagram, as contained in said report, be, and it is hereby, finally approved and confirmed as the diagram of the pro- perties to be assessed to pay the costs and expense's of said acquisitions and improvements. 10. That the assessment of the total amount of the costs and expenses of the proposed acquisitions and improvements upon the several subdivisions of land in said district in proportion to the estimated benefits to be received by said subdivisions, res pectively, from said acquisitions and improvements, and of the expenses incidental thereto, as contained in said report, be, and the same is hereby, finally,approved and confirmed as the assess- ment to pay the costs and expenses of'said acquisitions and im- provements. 11. That the Clerk of said City shall forthwith deliver to the Superintendent of Streets of said City the said assessment, together with said diagram thereto attached and made a part there- -of, as confirmed by this Council, with his certificate of such -4- confirmation thereto attached and of the date thereof; and that said Superintendent of Streets shall forthwith record said diagram and-assessment in his office in a suitable book to be kept for that purpose, and append thereto his certificate of the date of such recording, and such recordation shall be and constitute the assess - merit roll herein. 12. That said Superintendent of Streets, upon the re- cording of said diagram and assessment, shall mail to each owner of real property within the assessment district at his last known address as same appears on the tax rolls Iof the City or on file - in the office of the Clerk of said City, or to both addresses, if said address is not the same, or to the -general delivery when no address so appears, a statement containing a designation by street number or'other description -:.of the property assessed suf- ficient to enable the- owner to identify the same, the amount of t. assessment, the date of the recordation of said assessment, the time and place of payment thereof, the effect of - failure to pay within such time, and a statement.of the fact that bonds will be issued.on unpaid assessments pursuant to the Improvement Bond Act of 1915, the last installment of such bonds shall mature.fourteen (14) years from the second day of July next succeeding ten months from their date. 13. RESOLVED, by the City Council of the City of San Luis Obispo, California, that it does hereby preliminarily determine that the public interest, convenience and necessity require, and that it intends to order the following work to be done, acquisi= tions and improvements to be made, as follows: 1. (a) The acquisition of easements necessary to achieve a uniform width.of 54 feet for Laurel Lane from Johnson Street northeasterly 390 feet, more or less; for Flora Street from the northeasterly terminus of Laurel Lane northwesterly 340 feet, more or less; for Alrita Street from a point in Flora Street 240 feet, more or less,, northwesterly of Laurel Lane.northeasterly 625 feet, more or less, thence easterly 330 feet, more or less, to the City limits line; and the improvement of same by grading, paving and the construction and installation of Portland cement concrete curbs, gutters, sidewalks, cast iron water lines, to- gether with valves, hydrants and appurtenances, street lighting facilities and surface and subsurface drainage facilities. (c) The construction and installation of a water pump- ing plant at the intersection of Laurel Lane and Flora Street. (d) The acquisition of all lands and easements and the performing of all work auxiliary to any of the above necessary to complete same. 2. All of the blocks, streets and alleys herein mentioned are shown on maps of record in the office of the County Recorder of San Luis Obispo County, State of California, and shall be shown upon the plans herein referred to and to be filed with the Clerk of said City. 3. Whenever any public way is herein.referred to as running between two public ways,.or from or to any public way, the inter- sections of the public ways referred to are included to the extent that work shall be shown on the plans to be done thereon. _ A 4. All of said work and improvements are to be constructed at the places and in the .particular locations, of the forms, sizes, dimensions and materials, and at the lines, grades and elevations, as shown and delineated upon the plans, profiles and specifications to be made therefor, as hereinafter provided. 5. There is to be excepted from the work above described any of such work already done to line and grade and marked except- ed or shown not to be done on said plans, profiles and specifica- tions. 6.. Said Council does hereby adopt and establish as the official grades for said work the grades and elevations to be shown upon said plans, profiles and specifications. All such grades and elevations.are to be in feet and decimals thereof with reference to the datum plane of -the City of San.Luis Obispo. 7. Notice is hereby given of the fact-that in many cases said work and improvement will,bring the .finished work to a grade 4 different from that formerly existing, and that to said extent sa grades are hereby changed and that said work will be done to said changed grades. 8. Said contemplated acquisitions and improvements,;in the opinion of the City Council of said City, are of more than local or ordinary public benefit, and said Council does hereby make the costs and expenses thereof chargeable upon an assessment district, which district said Council declares to be the district benefited by said acquisitions and improvements and to be assessed to pay the costs and expenses thereof., the exterior boundaries of'which district are the coterminous exterior boundaries of the consoli- dated and composite area described on the map thereof on file in the office of the City Clerk to which reference is hereby made for further particulars. -2- t� t 9. Notice is hereby given that serial bonds to represent unpaid assessments, and bear interest at the rate of not to exceed six per cent (6 %) per annum, will be issued hereunder in the manner provided in the Improvement Bond Act of 1915 (Division 10 of the Streets and Highways Code), the last installment of which bonds shall mature fourteen (14) years from the second day of July next succeeding ten months from their date. 11. That the estimated amount of bonds proposed to be issued to pay the costs of said acquisitions and improvements is the sum of $420,000; that the maximum number of years said bonds are to run is thirty -five (35) years from the date thereof and the maximum rate of interest to be payable thereon shall not exceed six per cent (6 %), payable semi - annually except the first interest coupon may be for a different period. Section 8. That the limit as to time within which ad valorem assessments may be levied upon taxable real property in the parking district hereinabove described shall be thirty -six (36) years from the date of the bonds to be issued for said acquisitions and improvements; and the limit as to rate upon ad valorem assessments upon said taxable real property shall be seventy -five cents ($.75) on each one hundred dollars ($100.00) of assessed valuation. Section 9. A general statement of the public ways within the proposed district on which it is proposed that the City maintain or continue to maintain parking meters, the net revenues from which will be allocated and pledged to the payment of the principal of and interest on any bonds issued to finance the acquisitions and improvements herein described and to payment of operation and maintenance costs of said parking places and to the establishment and maintenance 6. 0 of any reserve funds, sinking funds or other funds designed for securing or paying said bonds and the interest thereon, is as follows: Both sides of Monterey between Osos and Chorro Streets; South side of Monterey between Chorro and Broad Streets; Both sides of Higuera between Santa Rose and Nipomo Streets; Both sides of Marsh Street between Osos and Broad Streets; Both sides of Osos between Monterey and Marsh Streets; Both sides of Morro between Palm and Marsh Streets; East side of Morro between Marsh and Pacific Streets; East side of Chorro between Palm and Higuere Streets; Both sides of Chorro between Higuera and Pacific Streets; Both sides of Garden between Higuera and Marsh Streets; Both sides of Broad between Higuera and Marsh Streets; East side of Court between Monterey and Higuera Streets; West side of Osos between Palm and Monterey Streets; South side of Monterey between Santa Rosa and Osos Streets; provided, that, in the proceedings relating to the formation of the proposed district and to the issuance of said bonds, the City shall provide that if, under the circumstances permitted by the Law, the City shall cease to maintain parking meters on some or all of the above mentioned streets or portions thereof, the City shall install and maintain on other streets in the proposed district, on which meters are not now installed, parking meters which will produce net revenues in an amount equal to the net revenues of the parking meters no longer maintained; and provided, further, that to permit the inclusion in the proceedings for the issuance of said bonds of a covenant against the operation by the City or the proposed district of other facilities for the public parking of motor vehicles which would compete with said proposed parking places, the City shall provide, in the proceedings relating to the forma- tion of the proposed district and to the issuance of said bonds, that if and when and so long as parking meters are installed and maintained on any of the streets within the proposed district on which such meters are not now installed, all of the net revenues from said meters shall be allocated and pledged in the same manner and for the same purposes as 7. the net revenues from the parking meters on the streets and portions thereof hereinabove specifically described. The period of time, measured from the date of said bonds, for which it is proposed that the City agree to maintain parking meters as aforesaid is thirty -six (36) years from the date of said bonds or such portion of said thirty -six (36) years as is necessary to produce from said parking meters net revenues which, together with other revenues and money available for the purpose, will be sufficient to pay the principal of and interest on said bonds as the same fall due. (f) GENERAL, The acquisition of all lands and ease- ments and the.per_orming of all work auxiliary to any of the above which may be necessary to complete the same. 2.
