That in accordance with Article XIII of the San Luis Obispo City Charter, Ordinance Number 244 (1962 Series) of the City of San Luis Obispo, and application received pursuant to Ordinance N=ber.244 (1962 Series), the Council of the City of San Luis Obispo hereby declares its intention to grant- a non - exclusive franchise to constructo operate and maintain a community antenna television system in the City of San Lewis Obispo to Central California Communications Corporation. 2. The franchise payment shall be 4% of the monthly total gross receipts and the time and amount of mini payments shall be as set forth in Section 5 of Ordinance Number 244 (1962 Series). 3. The rate permitted to be charged to each subscriber thereto shall be as follows: 1. CHARGES: (2) House wiring not required - material plus labor @ $5,00 per hour; $2.50 minimum. Material plus labor @ $5.00 per hour - $2.50 minim. Remote, relatively inaccessible subscribers within the City shall be defined as those potential subscribers five hundred; (500) or more feet from existing plant facilities. (f) Other Charges: All deposits and monthly service charges are payable in advance. Service charges, relocation and additional charges become delinquent 20 days after billing date. Service may be disconnected at any time thereafter by the i► Company for noud payment. NOTE: Charge for reconnecting non -pay disconnect is $5.00. Before service is reconnected for a subscriber who has been disconnected for non - payment, all past due accounts mast be paid in full (equipment deposits cannot be used to pay any part or all of delinquent account), plus one mouth's service charge mast be paid in advance in addition to the $5.00 reconnect charge. 4. The terms and conditions of the franchise shall be in accordance with Ordinance Number 244 (1962 Series) and the application of the proposed Grantee, copies of which are on file in the Office of the City Clerk, City Hall, 990 Palm Street, San Luis Obispo, California. 5. Christensen, Dolwig, Donnelly, Geddes, Gibson, Holmdahl, McAteer, McCarthy, Schrade, Short, Sturgeon. Those whose names are underlined are co- authors of the bill with Senator Collier. This hearing is the first step in the long legislative process necessary to secure favorable enactment of S.B. 344 at this session of the Legislature. Every improved city street provides additional safety and cuts vehicle operating costs which far outweigh the cost.of S.B. 344. These facts can best be brought to the attention of the people of your community and to your Legislators by local officials responsible for providing an adequate traffic system. Gentlemen: July 30, 1962 Enclosed-is a map which I drew up at an enlarged scale from a copy of the city assessor's map which I acquired when I bought my property from Mr. Howard Ridley in June of 1961. In reference to the northeasterly side of that portion of Sierra Way (formerly Essex Street) which lies northwesterly of Ella Street, I find that said northeasterly side is at right angles to Ella Street and also Parallel to Johnson Avenue. Also Mr. Ridley built the brick incinerator and planted the fruit trees on the northeasterly property line of my prop- erty which is a portion of Lots 9z & 10 as shown on said map. From these facts I would like to exchange a portion (as shown in re) of said Lot 10 for a portion of Sierra Way (as shown in g1jka) so that Sierra Way could become 50 feet wide and parallel to Johnson Ave. if the City should ever acquire a 56 ft. wide portion of Lot � (shown on said map) and its northwesterly extension across thelands of Bovee. As to the 50 foot width, I had a talk with our City Engineer, Mr Romero, I believe, about this exchange and he had his surveying engineers check the iron pipe at the most easterly corner of said Lot 10 and they set a nail in the ground to show me the intersection of the northwesterly line of Ella St. with the southeasterly prolongation of the southwesterly line of Lot 2 as shown on said map. From this I made a horizontal measurement with a surveyor's chain and hand level of the distance along said northwesterly line of Ella Street between said nail and the nail they set near said iron pipe and found it to be 45.45 feet. Thus I would like to add the remainder 4.55 feet to make Sierra Way 50 feet wide. I then had another talk with our City Engineer and he said he would agree with this exchange if I drew up a map and wrote a letter to you to get your confirmation on it. As to that portion of said Lot 9 (shown in yellow) which lies south- westerly of the purposed southwesterly line of Sierra Way, I will make the arrangements with the owner so that I could acquire it, if you should go along with this exchange and save my fruit trees and incinerator. Shipsey ROOM WZ'j e, 4 WITJM: JS: amf ' n'6 -62 80 RESOLUTION NO. 1002,_ A RESOLUTION DETERMINING UNPAID ASSESSMENTS AND PROVIDING FOR ISSUANCE OF.BONDS YOAKUM TRACT, ET AL PROJECT NO. 11 -62 RESOLVED, by the-City Council of the City of San Luis Obispo, California, that WHEREAS, said Council'did on June 4, 1962 pass and adopt its Resolution No. 947 of Preliminary Determination and of Intention relating to.the construction of public improvements in said City under and pursuant to the provisions of the Municipal Improvement Act of 1913, and amendments thereto, and did therein provide that serial bonds would be issued thereunder pursuant to the provisions of the Improvement Bond Act of 1915, reference to said Resolution of Preliminary Determination and of Intention hereby being express- ly made for further particulars; WHEREAS, notice of the recordation of the assessment and of the time within which assessments may be paid in cash, has been duly published and mailed in the manner provided by law, and,the time so provided for receiving ;the payment of assessments in cash has expired, and on August 27; 1962, the Superintendent of Streets has filed with the City Treasurer a list of all assessments which now remain unpaid; and - WHEREAS.;,the Council has duly- ,.considered.s'aid. list and has determined that -the same is an accurate statement thereof; NOW, THEREFORE, IT IS HEREBY ORDERED, as follows: 1. That the assessments in *said unpaid list which now remain unpaid, and the aggregate thereof, are as shown on Exhibit "A" hereto attached and by reference made apart hereof. 2. That for a particular description of the lots bearing the respective assessment numbers set forth in said unpaid list and.upon which assessments remain unpaid, severally and respective- ly, reference is hereby made to the assessment.and to the diagram recorded „in the office of the Superintendent of Streets of said City after confirmation by said_Council; the several lots repre- sented by said assessment numbers being so numbered and designated upon said diagram and assessment as so confirmed and.recorded, severally and respectively. 3. The unpaid iist is in the amount of $80,067.30 and bonds shall be issued upon the security of said unpaid assessments in the amount of $80,067.30 in accordance with the provisions of the Improvement Bond Act of 1915 (Division 10 of the Streets and High- ways Code) and under and pursuant to the provisions of said Resolution of Preliminary Determination and of Intention and the proceedings thereunder duly had and taken; that said bonds shall be ninety (90).in number; shall be dated October 16, 1962, and bear interest from their date at the rate of not to exceed six per cent (6 %) per annum, and the denomination of said bonds with their 'respective numbers and dates of maturity are as shown on Exhibit "B” hereto attached and made a part hereof by reference. 4. Said bonds shall.be issued in series, and the unpaid assessments as .shown on said list.filed with the City Treasurer of said City and determined by said Council, together with the interest thereon, shall remain and constitute a trust fund for the redemption and payment of said bonds and of the interest which may be.due thereon,_which unpaid assessments shall be taxable in annual series corresponding in number to the number of series of bonds issued, and an even annual proportion of-each assessment shall be payable in each year preceding the date of the maturity 2 for each of the several bonds issued, and such proportion of each assessment coming due in any year, together with the annual inter- est thereon, shall in turn be payable in installments as the general taxes of said City on real property are payable, and shall become delinquent at the same time and in.the same proportionate amounts and bear the same proportionate.penalties for delinquency. 5• Said bonds shall be signed by the Clerk and Treasurer of the City or bear the Treasurer's engraved, printed or litho - graphed.signature,• and the official seal of said City shall be affixed thereto. The interest coupons affixed thereto shall be signed by said Treasurer or bear his engraved, printed or litho- graphed signature; and such signing and sealing of said bonds by said.officers and signing of said coupons by said Treasurer shall constitute and be a sufficient and binding execution of each and every one of said bonds and all of the coupons thereof respective- ly. Said bonds shall be substantially in the form set forth in the Improvement Bond Act of 1915. Said Treasurer and Clerk of said City are hereby authorized and directed to sign said bonds. 6. Upon order of abandon, dent, the City Clerk shall record a certified copy of this resolution with the County Recorder.
