That the abandonment proceedings shall be pursuant to Division 9, Part 3, Chapter 2 of the Streets and Highways Code. 2. That upon a finding, at the hereinafter stated public hearing, that said street is not necessary for present or prospective public street purposes, that portion of Venable Street lying between Chorro Street and westerly to the Creek, shall be abandoned, subject to an easement reserved to the City for ingress and egress and for drainage and public utility purposes. 3. That a map is on file in the office of the City Clerk for particulars as to the proposed abandonment and the location of the easement reserved. 4. That July 6, 1964, at 8:30 P.i•n. in the Council Chambers of the City Hall is the time and place set for public hearing on said abandonment, which is not less than fifteen *(IS) days from the passage of this resolution. 5. That the City Engineer shall post notices on said streets in accordance with Section 8322 of the Streets and Highways Code and shall cause this resolution to be published once, at least ten days prior to said hearing in the Telegram- Tribune, a newspaper published and circulated in said City. 6. Whelchel NOES: None ABSENT: None ATT EST: 40r*% CIT Y""CLL IF- t{ /7 90 RESOLUTION NO.; 1289 (1964 Series) A RESOLUTION OF THr CITY COUNCIL OF THE CITY OF SAN LUIS OBLSPO, STATE OF CALI- FORNIA, RELATIVE TO URBAN PLANNING ASSISTANCE W H E R E A S , the City of San Luis Obispo desires to continue planning studies contributing to an over -all program for future community development, the preservation of community values, the prevention of conditions tending to cause urban blight, and the pro- motion of the general health, safety, and welfare of its citizens; and W HE R E AS the State Department. of Finance, under authority of Chapter 1641, Statutes of 1959, may provide planning assistance for such a program and receive financial assistance from the Urban Renewal Administration, as authorized by Section 701 of the Housing Act of 1954, as amended (Public Laws, 83rd Congress); NOW, THEREFORE, B E IT RESOLVED that the City Council of the City of San. Luis Obispo hereby requests the State Department of Finance to provide planning assistance under authority of Chapter 1641, Statutes of 1959, with such financial assistance as may be provided by the Urban Renewal Administration, under authority of Section 701 of the Housing Act of 1954, as amended (Public Laws 860, 83rd Congress). That such planning assistance is more particularly described in a project description that is attached hereto and made a part of this resolution as if fully set forth herein. BE IT FURTHER RESOLVED that the City Council of the City of San Luis Obispo, subject to approval of such planning assistance by the State and Federal authorities, hereby authorizes: (a) Payment to the State Department of Finance of a sum not to exceed Seven Thousand Four Hundred Sixty -One Dollars ($7,461.00). (b) No use of personnel of the City of San Luis Obispo for technical assist- ance is contemplated in this project. T HAT , the total estimated cost of the City of San Luis Obispo's project as planned: is Twenty -two Thousand Three Hundred Eighty -two Dollars ($22,382.00) . That the Council hereby determines that the policy for the use and plans for development of the City owned property adjoining Laguna. Lake and fronting on Madonna Road shall be as follows: A. None of the property should be sold and all of the property should eventually be used for recreational purposes. B. Consideration will be given to interim leasing of the property adjacent to Madonna Inn for income purposes to aid in the recreational development. C. The City should attempt to re- acquire the 23 acres presently owned by the School District by outright purchase if the financing can be arranged, or the City will consider trading an acceptable site for the school property. D. That the Hector Plan for the development of the Laguna Lake property has been adopted as a general guide and may be modified by acceptable precise develop- ment plans. E. That a balanced recreational use should be made of the property, including but not limited to golfing, water sports and picniclIting. F . The roads developed on the property should be designed to service the recreational facilities and not to service the adjoining areas as "through public streets. " The main thoroughfare through this area may ultimately be located from the extension of Marsh Street overpass through the saddle of the mountains behind the Madonna property, and extending to Foothill Boulevard west of the present City limits. G. WP, f ATTEST: RESO'nJTION NO. 1287 (1964 Series) A RESOLUTION AMENDING RESOLUTION NO. 1135 (1963 Series) REGARDING POLICIES TO IMPLEMENT THE SETBACK ORDINANCE BE I T R E S 0 L V E D by the Council of the City of San. Luis Obispo as follows: 1. That Resolution No. 1135 (1963 Series), entitled "A RESOLUTION REPEALING RESOLUTIONS 868 (1961 Series) AND 872 (1961 Series), AND PROVIDING NEW POLICIES TO IMPLEMENT THE SETBACK ORDINANCE, if shall be and is hereby amended to read as follows: I. That Resolution No. 868 (1961 Series) and Resolution No. 872 (1961 Series) are hereby repealed and the following shall constitute the new policies of the City in regard to streets on which setback ordinances have been or will be set. A. NORMAL RESIDENTIAL LOTS (1) On eingle normal sized residential lots, if the owner will dedicate the necessary right -of -way for the street widening, the City will give the owner credit for the value of the property dedicated, to be applied toward the cost of installing the curb, gutter, sidewalk and normal grading that might be involved at the previous curb line on a standard installation. If the cost of these improvements exceed the land value, then the property owner will pay the City the amount of such excess cost at the time of executing the agree- ment. If the land value exceeds the cost of these improvements, then the City will pay the owner such excess amount at the time of executing the agreement. (2) The City will provide all necessary engineering and preparation of documents and will pay for the cost of relocation of utilities, replacement of landscaping, replacement of driveways, and grading in excess of the amount that would have occurred at the old curb line. City will base and pave the street out to the new gutter. The City will install a retaining wall whenever a 2 :1 slope in a cut or fill would create a front yard sub- - startially less than.the required setback. The City will pay the owner for 15 -gallon size trees and 5 -gallon size shrubs when it is not practical to replace them. (3) The time when improvements would be installed by the City would depend upon the funds budgeted for this purpose, and the written agreement between the City and the property owner would provide that the dedication of the right -of -way would be subject to the condition that the City would install the necessary improvements when the monies were available. (4) The issuance of building permits and connection of utilities shall not be conditioned on the dedication of land for street widening purposes. If the property owner does not wish to construct curb, gutter and sidewalk at the new setback line, then the per- mits should be issued and a cash deposit be made with the City to guarantee placement of improvements after negotiation with the City Council. B. RESIDENTIAL LAND THAT CAN BE SUBDIVIDED INTO FOUR PARCELS OR L . (1) On residential parcels that are large enough-to, be subdivided, if the property owner will dedicate the necessary right -of -way for the street widening, the City will give the owner credit for the value of the property dedicated, to be applied toward the cost of installing the curb, gutter, sidewalk and grading. If the cost of these improvements exceed the land value, then the property owner will pay the City the amount of such excess cost at the time of executing the agreement. If the land value exceeds the cost of these im- provements, then the City will pay the owner such excess amount at the time of executing the agreement. (2) In either event, the property owner will covenant with the City that, upon any subsequent subdivision, or subdivisions, the owner would reimburse the City for all land acquisition cost except an amount equal to the cost of land acquisition of one normal residential frontage or that parcel retained by the subdivider. If the owner retains a parcel large enough to be subsequently subdivided, then the covenant will continue on such parcel retained, and the owner will pay the cost of land acquisition upon each subsequent sub- division of said parcel. (3) The City will provide all necessary engineering and preparation of docu- ments and will pay for the cost of relocation of utilities, replacement of landscaping and replacement of driveways. The City will base and pave the street out to the new gutter. The City will install a retaining wall whenever a 2 :1 slope in a cut or fill would create a front yard substantially less than the required setback. The City will pay the owner for 15 -gallon size trees and 5- gallon size shrubs when it is not practical to replace them. The owner will not be required to reimburse the City for these improvements upon subse- quent subdivision. (4) The time when improvements would be installed by the City would depend upon the funds budgeted for this purpose, and the written agreement between the City and the property owner would provide that the dedication of the right -of -way would be subject to tLe condition that the City would install the necessary improvements when the monies were available. (5) In the event the property is subsequently subdivided into five (5) or more lots within any two (2) year period, the subdivider would be required to reimburse the City for the cost of all the land acquired by the City. MAJ OR SUBDIVISIONS (1) Major subdivisions of five (5) lots or more shall be required to dedicate the land required for street widening, install curb, gutter and sidewalk, and earthwork to bring the street to sub - grade. The City will base and pave out the street to meet the new curb line. D. USE PERMITS AND VARIANCES (1) Dedication of rights -of -way for street widening purposes may be required as a condition of a use permit or variance where the land density will exceed 6000 square feet per family unit, or where, in the opinion of the Planning Commission, the traffic needs would be increased as a result of the improvement. E. PROPERTY ZONED OTHER THAN RESIDENTIAL (1) Any property zoned or used other than for residential, or containing more than four (4) dwelling units, would have to dedicate the right -of -way and install the curb, gutter and sidewalk. We hereby request that our property described as Lot 12, Block C. of Park View Homes No. 1, address 107 Ramona Drive be excluded from said inprovements for the following reasons: 1. Excessive cost because of the abnormal corner lot that has 140 foot exposure on Del Sur Way and 140 foot frontage on Ramona Drive. In order for us to benefit from sidewalks it would be desirable to have them in front of our home rather than in the back as proposed in this resolution. This would mean 280 feet of sidewalk that we would have to be re- sponsible for as compared to a mere 60 foot frontage that represents seven out of eight of the signers of the petition. 2. It is not necessarily in the interest of the public. Many of the property owners in the tract are not infavor of sidewalks although they are not directly involved in this particular resolution. They are, however, indirectly intere- sted as it effects the entire area. 3. Sidewalks in this area are not necessary for public safety. The street in question is not a main street, a tKoroughfare, a collector street, or even a through street. It is a residential street adjacent to the city limits and there is a minimum of both foot and vehicular traffic. 4. The last 320 feet in front of lots 13 and 14 and in back of lot 12 is quite steep. We feel that the installation of sidewalks on this portion'of the block would be .creating a hazard to the safety and welfare of small children on,,the small wheel play vehicles. For the above reasons we therefore request that the rity Council of the City of :San Luis Obispo grant an exception as set forth in paragraph 3 of the resolution and exclude our property. Therefore, the City can and does, through the office of the City Engineer, require a permit for any construction or excavations taking place in the streets. This permit, among other things, requires that the work he done by a licensed cdn- tmcxor, requires the pesmattee to assume full responsibility for safeguarding the Public use of the street during cons=c Lion, and requires the contractor to recompact and resurface the street, or pay the City to resurface the .street. Because repairs to street excavations take place at scattered Intervals, and because the nearest hot miX Plana is located in Santa Maria, the City has repaved excavations with cold mix, which does not provide as permanent a surface as the original street. A second problem occurs in instances where the contractor repaves his own excavations. In these cases, the contractor often neglects to pave the 'treacle unztil, completion of the entire pro,Pect when it is convenient for. him to hire a paving contractor to do the work at one time. Since our present requirements do not call for temporary repaving, the trench remains unsurfaced For an extended period of time, thereby creating an inconveaieace for the traveling public. To eliminate both problems, it is suggested that the Council adopt a policy which would call for the permutes to install temporary paving on all trenches within 48 hours after hackfilling and to repave the Bch with hot mix within thirty (30) days after backialling, or deposit sufficient monies with the City to reimburse the City for its cost in repaving the trenches. Adoption of these standards will assure that streets will have the same cross sections whether in the County or the City, will assure uniformity in construction standards and practices for curb and gutter, sidewalk, driveway ramps, street base and paving, cross gutters, catch basins, storm drains, sewer and water, and all other construction features which will be accepted for maintenance by the City or County. We believe adoption of these standards will lessen costs for the contractor since he will be dealing with only one set of standards throughout the County. The County and various cities will also benefit by an improved quality of work made possible by standardization as well as probable lesser costs. One -and one half years ago, the group submitted a partial report of standards agreed upon at that time. Since then, the group has continued to meet and after much discussion has generally agreed that the enclosed standard details most closely represent a desirable standard for adoption by the County and each city. DRAINAGE Cross Gutters: Cross gutters will not be permitted across major or secondary streets even at intersections where a.stop sign will be placed. In no case will a cross gutter.be permitted in mid block. Cross gutters will be allowed across the thru - travel lanes of a local street at a T intersection, and across the thru - travel lanes of a cross intersection of two local streets. Hydraulic Calculations: Hydraulic ca cu a ions shall be made by use of the rational formula, utilizing the Division of Highways design approach, providing capacity in new designs for ultimate designs upstream, using a 0.7 runoff factor, a 10 year storm design criteria for local streets and minor drainage, a 25 year design criteria for intermittent drainage, and a 50 year design criteria for major drainage. Minor drainage is defined as that amount of water which can be carried within a 42 inch concrete pipe; intermediate drainage is defined as being the amount of water carried by a structure larger than a 42 inch pipe but smaller than an 8 ft. by 8 ft. concrete box culvert; major drainage is defined as that amount of water which will require drainage capacity greater than an 8 ft. by 8 ft. box culvert. Each jurisdiction will use its own rainfall intensity curve when they are avail- able, but if no curves are available, Division of Highways charts will be used. Friction factors shall be as recommended in Table 7 -20 of the fourth edition of Ring's Handbook. Maximum permissive velocity in open.channels will be as designated in Table 7 -33 of Ring's Handbook. Drainage Channels: Plant mix will not be allowed for lining of any permanent channel. All open drainage channels smaller than 64 square feet in area must be lined with &unite or concrete unless an exception is granted by the City -G ,L,— All channels greater than 64 square feet in area will have a concrete or gunite channel bottom with slopes planted to a low growing ground cover to provide permanent stabilization. 1 - All channels will have a minimum of one foot freeboard. The minimum bottom width of lined channels will be 6 feet and the minimum bottom width of unlined channels will be 8 feet. All open channels will be protected by a chain link fence at least 5 feet high with access points for maintenance no further apart than 1,200 feet. The developer will be requested to improve an all weather access and maintenance road at least 12 feet wide located on the channel side of the chain link fence. SEWER Sewer Pipe• Bituminous fiber pipe will not be permitted within the mains or laterals. Concrete pipe will be permitted only for sizes of 18 inches or larger and then subject to the approval of the City Engineer. Cement asbestos pipe may be used for sewers providing the grade is no flatter than 17. and subject to the discretion of the City Engineer in each community. For grades flatter than 1 7., an epoxy lining will be required if cement asbestos pipe is permitted by the City Engineer. Cement joints, hot pour joints, and rubber ring joints will not be permitted. Absolute minimum sewer main size will be 6 inches. An 8 inch main will be required unless engineering calculations show that present and future development potential would warrant a lesser size. Sewer laterals shall be a minimum of 4 inches in diameter and of the same material and quality of joint as the sewer main. Sewer wyes attached after construction of the main line shall have a positive means of preventing the wyes from extending into the main line. Sewer Design: —sewer mains shall be designed flowing full, considering ultimate development upstream and infiltration for the area in question. A peak rate of flow to be used for single family residential areas will be 300 gcd, which considers infiltration. Sewer mains will be designed for a 2 feet per second velocity flowing full. Manholes: TMoles will be spaced no further apart than 400 feet. Cleanouts at the end of a line may be spaced as far as 400 feet from the nearest manhole. Steps will not be permitted in manholes. 2 - Sewer grades will be designed from center of manhole to center of manhole. Minimum manhole width shall be 48 inches and the minimum opening, 24 inches. Brick or block manholes will not be allowed except under special circumstances where it is not feasible to construct pre -cast manholes. Eccentric cones will be permitted. WATER Water Mains: Minimum clearance between water mains and the street surface shall be 36 inches. Minimum water main size shall be 8 inches unless engineering calculations show that present and future development potential will warrant a lesser size. Steel water mains will not be permitted. Both cement asbestos and cast iron water mains will be acceptable although local conditions might dictate the use of one material rather than the other. All water main pipe shall meet AWWA standards for Class 150. Either tapped couplings or saddles will be acceptable in connecting house services to the main, although local conditions might dictate the use of one type or the other. SURVEY Street Monuments:. Street monuments shall be set to reference street center lines at inter- sections, curves, and along the tract boundary as required by the engineer of the local public agency. Monuments shall be set no further apart than 500 feet along center lines and shall be shown on the final subdivision map. Boundary Monuments: Boundary monuments shall be set at all angle points marking the extremities of the subdivision and shall be set no further apart than 500 feet along boundary lines. Boundary monuments shall be of iron pipe, no smaller than 12 inches in diameter, no shorter than 30 inches in length, capped and stamped with the land surveyor's or registered engineer's number, set 6 inches below the ground surface, and indicated by a marker stake extending above the ground surface. - 3 - f Lot Stakes: Lot stakes shall be constructed of 2 inch iron pipe at least 18 inches in length or a 2 x 2 wooden hub at least 12 inches in length painted white and tagged. All lot stakes shall be set at ground surface. If a lot corner falls on concrete or rock, the corner shall be set by means of a lead plug and tagged. MISCELLANEOUS All concrete sidewalks shall be a full 4 inch thickness. The minimum sidewalk width shall be 4 feet clear exclusive of the curb top. Minimum driveway thickness shall be 6 inches. All streets shall intersect at right angles and shall have at least 50 feet of center line tangent adjacent to the intersection and measured from the pro- longation of the cross street property line. After some discussion the Board requested. the Administration to again notify the City Council regarding.its established policy for improve- ments such as sidewalks, curbs and gutters. The Board accepts the will of the majority of the property owners in the area, indicated by signatures of over fifty percent of the owners of property excluding district -owned property. The Board does not feel that it should support such improvements unless.the majority of the property owners are in favor of such improvements. We understand that Resolution No. 1236 was adopted under the present ordinance and that the property owners were not consulted. In any future projects concerning such improvements the Board of Education would like to be informed whether or not a position has been taken by the property owners in the particular area by means of a petition. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, a petition signed by all of the owners of the land in the hereinafter described territory was filed with the Council of the City of Wean Luis Obispo on November 4, 1963, requesting annexation of the hereinafter described territory to said City. 2. That the territory which the petitioners request he annexed to the City of San Luis Obispo and which said City and its Council propose to annex, is situate in the County of San Luis Obispo, State of California, hereby designated "Peterson Property, " and des- cribed as follows: Lot 59 of the Ranchos Canada de Los Osos and La Laguna, in the County of San Luis Obispo, State of California, according to James T. Stratton's survey and map of the subdivision of said ranchos recorded October 8, 1869 in book A pages 83 and 84 of Maps, in the office of the county recorder of said county and also including that portion of County Road No. 29 (Los Osos Road) lying between said Lot 59 and the present City boundary line and further in- cluding that portion of County Road No. 29 (Los Osos :toad) lying southerly of said Lot 59 extending to the southerly line of the intersection of Madonna Road (also known as County Road No. 29) and Los Osos Road. 3. That the County Boundary Commission of San Luis Obispo County, California, did in session duly assembled on August 22, 1963, consider the proposed annexation boundaries of said "Peterson. Property, " as above described, and said Boundary Commission recommended that the City include an adjoining street area, in which recommendation the City Planning Commission and City Council hereby concur and which street area is in- cluded in said petition. 4. That Monday, December 2, 1963 at the hour of 8 :30 P.M. in the Council Chambers of the City Hall in the City of San Luis Obispo, County of San Luis Obispo, State of California, is hereby fixed as the time and place when and where any owner of property within the City of San Luis Obispo who does not also own property in the territory to be annexed, and having any objections to the proposed annexation, may appear before the Council of said City and show cause why such uninhabited territory should not be so annexed to the City of San Luis Obispo.
