A dependent child is one under the age of 18 and unmarried, or a disabled child of any age who has been continuously disabled since age 18. 2, A uidcw ceases to be eligible for a benefit upon her remarriage, 3. A widower will be eligible for a benefit the same as a widow provided he was dependent upon the deceased member for at least one-half of his support, 4. The basic death benefit currently included in your retirement program pro- vides that should a member die prior to his retirement, his beneficiary would be paid the member's accumulated contributions plus an additional amount equal to one month's salary for each year of service, up to a maximum of six months. The above survivor benefits will be payable in addition to any basic death benefit the survivor may be entitled to receive, 5. If a member is covered under both the SBRS survivor benefit'described above and the survivor benefits as provided in Section 2136505 of the Retirement Law (Section 21337 for safety members), the survivor would receive the greater of the two allwancee, but not both. 6, The special death benefit provided the widow of a safety member whose death is "in line of duty" is a monthly allowance equal to one -half of the member's "final compensation," If the widow is also eligible for a benefit under the survivor program herein described, she will not receive both benefits, rather she '.ill receive the larger of the two.. EFFECTIVE DATE These survivor benefits will become effective an October 1, 1962, All present members of the System will be given the opportunity by written ballot to select this survivor coverage. Persons who choose coverage will remain covered until they termi- nate their employment or retire. The $180 would continue to be paid until the last child passes the age of 18 at which time the payment would cease until the widow reaches the age of 62. She would then receive $90 a mouth for the remainder of her lifetime. A copy of the resolution is attached.for your convenience, . You will note, and probably you are aware already, that the resolu- tion memorializes the President and the Congress of the United States to oppose any amendment of the U. S. Constitution, or any other action by Congress or the executive branch, which might subject the income from' state and local bond's to a federal tax or to cause the tax to. be increased because'of such bond holding s. by -a taxpayer whether or not.the increase is .in fact titled a tax. I believe you will agree, as the head of a local government body, that any federal taxation of the interest on bonds in California would be a serious deterrent to the many bond- financed programs so vital to the continued needs of this State and its communities. As the'legislaturels resolution indicates, federal taxation of such bond interest, as income, would.curtail construction of needed public improvements, such as the building of schoolsy highways, and water and sewer systems and would cause either tax increases by the State-and its political subdivisions or would result in the federal government assum- ing the responsibility of financing such improvements. Certainly a resolution from your council in opposition to a federal tax on these bonds would impress our national leaders and.representatives. in Congress, and would do much to counter any move to impose such a tax. .1 As the state officer charged with the responsibility for the sale of California general obligation.bonds, I earnestly recommend a thorough study of the legislaturel,s resolution by your council, and request•that your collective consideration be given to your'own.adoption of such a resolution to the President and Congress.
