IRREVOCABLE AND PERPETUAL OFFER TO DEDICATE
(Victoria Avenue and Alphonso Street)
THIS IRREVOCABLE AND PERPETUAL OFFER TO DEDICATE is made this
day of b 0 ( em 6J , 2014, by San Luis Garbage Company, a California corporation,
hereinafter termed Offeror.
FOR GOOD AND VALUABLE CONSIDERATION, Offeror covenants and promises as
follows:
1. That said Offeror is the sole owner of the real property commonly referred to as 783
Alphonso Street and 780 Woodbridge Street, San Luis Obispo, California and as more
particularly described in Exhibit A attached hereto and incorporated herein by this
reference:
2. That said Offeror does hereby irrevocably and in perpetuity offer to the City of San Luis
Obispo ( "City") an easement for public street right of way purposes, in, over, upon,
across and under that portion of certain real property located in the City of San Luis
Obispo, County of San Luis Obispo, as more particularly described in Exhibit `13-1" and
depicted in Exhibit `13-2" both of which are attached hereto and incorporated herein by
this reference, together with the right to install, maintain, repair and replace any and all
public right of way improvements City deems necessary, in its sole and absolute
discretion.
3. Said easement offered herein shall be non - exclusive and in gross. Provided, however, the
easement rights offered to the City shall be paramount and superior to the rights of
Offeror and all other persons and entities.

4. That said Offeror agrees that said offer of dedication set forth herein shall be irrevocable
and that City, or any other such governmental entity, may, at any time in the future,
accept said offer of dedication.
5. That until such time as the above offer of dedication is accepted by such a government
entity, all owners of property contiguous to the above described road parcel shall have the
right to use of said road parcel as a private road.
6. That said Offeror agrees that this irrevocable and perpetual offer to dedicate is and shall
be binding on their heirs, legatees successors and assigns.
IN WITNESS WHEREOF, Offeror has executed this offer of dedication as of the first date set
forth above.
