THIS AGREEMENT is made on this I Oday of August, 2004, by and between the CITY OF SAN LUI S
OBISPO, a municipal corporation and charter city, San Luis Obispo County, California (hereinafter called the City); and
CJP Productions, Inc ., (hereinafter called the Contractor).
WITNESSETH :
WHEREAS, the City wants to perform landscape architectural services related to User Site Design an d
Construction, Specification No . 99124 .90555 ; and
WHEREAS, Contractor is qualified to perform this type of service and has submitted a proposal to do s o
that has been accepted by City .
NOW THEREFORE, in consideration of their mutual promises, obligations and covenants hereinafter
contained, the parties hereto agree as follows :
1.TERM . The term of this Agreement shall be from the date this Agreement is made and entered, a s
first written above, until acceptance or completion of said services .
2.CITY'S OBLIGATIONS .For providing services as specified in this Agreement, City will pa y
and Contractor shall receive therefor compensation in a total sum not to exceed $9,990 .
3.CONTRACTOR'S OBLIGATIONS .For and in consideration of the payments and agreement s
hereinbefore mentioned to be made and performed by City, Contractor agrees with City to provide services as se t
forth in its proposal dated July 8, 2004 (Exhibit A) attached hereto and incorporated into this Agreement . Contractor
further agrees to the contract performance terms as set forth in Exhibit B attached hereto and incorporated into thi s
Agreement .
4.AMENDMENTS . Any amendment, modification or variation from the terms of this Agreemen t
shall be in writing and shall be effective only upon approval by the City Administrative Officer of the City .
5.COMPLETE AGREEMENT .This written Agreement, including all writings specifically
incorporated herein by reference, shall constitute the complete agreement between the parties hereto . No oral
agreement, understanding, or representation not reduced to writing and specifically incorporated herein shall be o f
any force or effect, nor shall any such oral agreement, understanding, or representation be binding upon the partie s
hereto .

PROPOSAL FOR LANDSCAPE ARCHITECTURAL SERVICE S
PROJECT:RECYCLED WATER RE-USE IRRIGATIO NSYSTEM IMPROVEMENT PROJEC TSan Luis Obispo, Ca .
I am pleased at the opportunity to submit this proposal for landscape architectural services on the Recycled Wate r
Re-use Irrigation Improvement Project, San Luis Obispo, California. CJP Productions Inc . has provided an "Ite m
Check List" (attached) to help define the project scope of work. The work described within is for the followin g
project sites : Islay Park, French Park, Laguna Hills Park, Laguna Lake Park, and Laguna Middle School . Th e
scope of services is based on meetings with you and City staff members last month . Based on this, following is th e
required services needed to complete the project :
DATE & SITE INFO. PHASE
This phase will entail the preparation of base maps for the water re-use irrigation improvement plans . This wil l
entail site visits & measurement, meetings with city staff and maintenance personal, data mining of drawin g
archives, vectoring scanned drawings and drafting of the base maps . This work is detailed in the "Item Check List "
under Basemap Preparation .
SITE ANALYSIS PHAS E
Using the City of San Luis Obispo's Utility Department required scope of work, California Code of Regulations Titl e
22, and Gates & Associates' water re-use study, four park sites and one school site will be analyzed for irrigatio n
system modification and improvement . This work is detailed in the "Identify Areas of Re-design/Adjustment".
LANDSCAPE DOCUMENT PHAS E
This phase will include the following :
Preliminary Design Drawing s
CJP Productions Inc . will prepare irrigation modification plans for the four parks and one school sites . These will
be used for review by City staff showing the work that is required to re-use the recycled water for irrigatio n
purposes . Item that will be addressed are detailed in the "Item Check List" under Preliminary Design Drawings .
Bid Documents
The final work will be the preparation of Bid Documents for the Recycled Water Re-use Irrigation Improvemen t
Project . This work is shown in the "Item Check List" under Produce Bid Documents .
•Irrigation Plan s
These plans will show the design, layout, modification and improvement of the existing irrigation system fo r
the four parks area and one school site . The plans will show the point of connection to the existing irrigatio n
system mainline, the types of pipes (sizes & locations), valves (types, sizes & locations), irrigation head s
(types & locations), and connection to irrigation controllers (type & location). Also included are genera l
installation notes and details .

General and project specific irrigation specifications (using City's Specs) will be included .

PAYMEN T
An initial payment of $2,000 .00 as a retainer, will be billed upon acceptance of this proposal . The remainder will b e
made monthly on the above tasks as they are completed and billed directly to the City of San Luis Obispo .
HOURLY FEES "
If revisions are required beyond the above stated services and after submittal of completed landscape document s
due to client design changes, these revisions will be billed at a rate of $40 .00 per hour for drafting & clerical an d$95 .00 per hour for the landscape architect's time . See Rate Schedule .
This fee structure is good for only 30 days from the date of this proposal .
ACCEPTANCE OF PROPOSAL :The above prices, specifications and conditions are satisfactory and are hereb y
accepted . You are authorized to do the work as specified . Payment will be made as outlined above . Upo n

If authorized by client, an overtime premium multiplier of 1 .5 will be applied to the billing rate o f
hourly personnel who work overtime in order to meet a deadline which cannot be met durin g
normal working hours . Applicable sales tax will be added to these rates .
INSURANCE REQUIREMENT S
CJP Productions Incorporated carries complete insurance coverage typically required by publi c
agencies, schools and institutions and discerning clients for the protection of our firm and client s
to be named as additional insured . This includes General Liability and Automobile coverage ,
Professional Liability Insurance (E&O) and Workman's Compensation and Employer's Liabilit y
Insurance .
The current coverage limits are as follows :
