THIS AGREEMENT is made on this 'g- 'day of July, 2004, by and between the CITY OF SAN LUI S
OBISPO, a municipal corporation and charter city, San Luis Obispo County, California (hereinafter called the City); and
CJP Productions, Inc, (hereinafter called the Contractor).
WITNESSETH :
WHEREAS, the City wants to perform landscape architectural services related to WRF - Open Spac e
Enhancement Project, Specification No . 90509 .90552 ; an d
WHEREAS, Contractor is qualified to perform this type of service and has submitted a proposal to do s o
that has been accepted by City .
NOW THEREFORE, in consideration of their mutual promises, obligations and covenants hereinafte r
contained, the parties hereto agree as follows :
1.TERM . The term of this Agreement shall be from the date this Agreement is made and entered, a s
first written above, until acceptance or completion of said services .
2.CITY'S OBLIGATIONS .For providing services as specified in this Agreement, City will pa y
and Contractor shall receive therefor compensation in a total sum not to exceed $3,595 .
3.CONTRACTOR'S OBLIGATIONS .For and in consideration of the payments and agreement s
hereinbefore mentioned to be made and performed by City, Contractor agrees with City to provide services as se t
forth in its proposal dated September 30, 2004 (Exhibit A) attached hereto and incorporated into this Agreement .
Contractor further agrees to the contract performance terms as set forth in Exhibit B attached hereto and incorporate d
into this Agreement.
4.AMENDMENTS .Any amendment, modification or variation from the terms of this Agreemen t
shall be in writing and shall be effective only upon approval by the City Administrative Officer of the City .
5.COMPLETE AGREEMENT . This written Agreement, including all writings specificall y
incorporated herein by reference, shall constitute the complete agreement between the parties hereto . No oral
agreement, understanding, or representation not reduced to writing and specifically incorporated herein shall be o f
any force or effect, nor shall any such oral agreement, understanding, or representation be binding upon the partie s
hereto .

PROPOSAL FOR LANDSCAPE ARCHITECTURAL SERVICE S
PROJECT:
OPEN SPACE ENHANCEMENT PROJEC TAT SEWER TREATMENT FACILIT YSan Luis Obispo, Ca .
I am pleased at the opportunity to submit this proposal for landscape architectural services on the Open Spac eEnhancement Project for the City of San Luis Obispo, California . The project area is south of the existing sewe rtreatment facility (under construction) on the east side of Hwy . 101 . It extends to Los Osos Valley Road overpas swith the eastern boundary along San Luis Obispo Creek (top of bank). The scope of services is based on meeting swith you and City staff members last month . Based on this, following is the required services needed to complet ethe project:
DATA & SITE INFO. PHASE
This phase will entail the preparation of base maps for the enhancement plans . This work consists of :1.Site visits, measurements & assessment, and photo-documentation .'2.Meetings with City staff on project's scope of work and time frame .3.Data mining of drawing archives and computer drafting of the base map for the enhancement project concep tplan.
PRELIMINARY DESIGN PHASE
CJP Productions Inc . will prepare a Preliminary design plan for the project area and the design will include th efollowing:
1.Preliminary rout of Bob Jones bike path through site . Location rest areas and trail amenities .2.Preliminary design of new soil mounds and modifying existing soil mounds .3.Preliminary re-positioning of existing SLO monument sign .4.Preliminary location of new bridge for bike path on Perfumo Creek at Los Osos Valley Road .5.Preliminary design to modify and enhance existing wetland ponds .6.Preliminary design of wetland expansion feature .
7.Show area to be retained for future sewer treatment expansion .8.Preliminary location of new landscape plantings (trees & large shrubs).
A meeting will be scheduled with City staff for the presentation of the Prelimianry Deisgn Plan .
FEE
The fee for these services will be $3,595 .00 (three thousand five hundred ninety five dollars and .00 cents) an dbreaks down as follows :

PAYMENT
' An initial payment of $1,000 .00 will be paid as a startup fee, will be billed upon acceptance of this proposal . Th eremainder will be made monthly on the above tasks as they are completed and billed directly to the City of San Lui sObispo.
HOURLY FEES
If revisions are required beyond the above stated services and after submittal of completed landscape document sdue to client design changes, these revisions will be billed at a rate of $45 .00 per hour for drafting & clerical an d$95 .00 per hour for the landscape architect's time .
This fee structure is good for only 30 days from the date of this proposal .
ACCEPTANCE OF PROPOSAL :The above prices, specifications and conditions are satisfactory and are hereb yaccepted. You are authorized to do the work as specified . Payment will be made as outlined above . Uponacceptance, please sign and retum one copy to this office .
