The State of California, acting by and through the Department of Trans pbitalic) ri, hereinafter calle d
"STATE," proposes to realign Highway 227 (South Street) between Beebee and South Higuera Streets i n
front of the Village Mobile Home Park in the City of San Luis Obispo . This project will provide left turn
channelization ; a two-way left turn lane, and a bus stop turnout, as well as a soundwall/retaining wall to b e
constructed along South Street to mitigate the noise level for the residents of the mobilehome park . An
additional driveway into the mobilehome park will be constructed at the back of the parcel onto Bridg e
Street . The City of San Luis Obispo hereinafter called "OWNER,"owns and maintains three water servic e
pipelines and meters providing water service to the Village Mobile Home property, within the limits o f
STATE'S project which require relocation in order to accommodate STATE'S project .
It is hereby mutually agreed that :
I.
WORK TO BE DONE
In accordance with Notice to Owner No . 998 .693 dated 1/4/2005, STATE shall relocate OWNER's
three water pipelines as shown on STATE's contract plans for the improvement of State Route 227 ,
EA 494104 which by this reference are made a part hereof OWNER hereby acknowledges revie w
of STATE's plans for work and agrees to the construction in the manner proposed . Deviations fro m
the plan described above initiated by either the STATE or the OWNER,shall be agreed upon by bot h
parties hereto under a Revised Notice to Owner. Such Revised Notices to Owner, approved by th e
STATE and acknowledged by the OWNER,will constitute an approved revision of the plan
described above and are hereby made a part hereof No work under said deviation shall commence
prior to receipt by the OWNER of the Revised Notice to Owner .Changes in the scope of the wor k
will require an amendment to this Agreement in addition to the revised Notice to Owner . OWNER
shall have the right to inspect the work during construction . Upon completion of the work b y
STATE, OWNER agrees to accept ownership and maintenance of the constructed facilities an d
relinquishes to STATE ownership of the replaced facilities .

Existing facilities are located in their present position pursuant to rights superior to those of th e
STATE and will be relocated at STATE expense .
OWNER shall have access to all phases of the relocation work to be performed by STATE for th e
purpose of inspection to ensure that the work is in accordance with the specifications contained i n
the Highway Contract ; however,all questions regarding the work being performed will be directed to
STATE's Resident Engineer for evaluation and final disposition .
PAYMENT FOR WORK :
The STATE shall perform the work under Section I above at no expense to OWNER.
V . GENERAL CONDITIONS :
Upon completion of the work to be done by STATE in accordance with the above-mentioned plans
and specifications, the new facilities shall become the property of OWNER,and OWNER shall hav e
the same rights in the new location that it had in the old location .
It is understood that said highway is a Federal aid highway and accordingly, 23 CFR 645 is hereby
incorporated into this Agreement .

Originally we had discussed a schedule for this project which anticipated that the project woul d
begin construction during June of 2005 . Since our last discussion, the schedule has been revise d
and presently we anticipate that construction will start in mid-September .
