SUBJECT: DRIVEWAY ACCESS EASEMENT FOR RARIG DEVELOPMENT
THROUGH THE REGIONAL TRANSPORTATION CENTER SITE.

CAO RECOMMENDATION
Adopt a resolution approving a vehicular access easement within the RTC site.
DISCUSSION
Background
The Railroad Transportation Center (RTC) project incorporates an additional seven (7) feet of
right of way along its Santa Barbara Avenue frontage to accommodate sufficient street widening
to provide for left-tum vehicle movements at its main entrance opposite Upham Street. The
project traffic study also identified the need to widen the street all the way to Broad Street to
accommodate left turn lanes at High Street and the entrance to the Pacific Home Do-it Center
(PHDIC), which was established by the City Council.
When the RTC project was nearing the final design stage, a "preliminary" redevelopment project
for the Rarig property at the northeast corner of High Street and Santa Barbara Avenue was
reviewed by staff. Due to site development constraints on the RTC and Rarig properties, (grade
differences between the RTC site and Rarig property, shape of parcel, existing trees, proposed
street widening, onsite circulation, etc.) negotiations commenced between staff and Steve Rarig
to provide for more logical and compatible development of both sites.
As a result of those negotiations, the approved RTC and Rarig projects incorporate mutually
beneficial features as follows:
CITY BENEFITS:
1) Grading of a slope onto a portion of the Rarig property, effectively reducing the length of
retaining wall needed to contain the RTC driveway near the High Street entrance.
2) Offer of dedication of necessary right of way and improvements by Rarig, to complement
the RTC widening of Santa Barbara Avenue..
3) Offer of dedication to accommodate the RTC driveway onto High Street.

RARIG BENEFIT:
Vehicular access to a small parking lot adjacent to the RTC parking lot and driveway from
Santa Barbara Avenue and from High Street, which allows for more efficient onsite parking
lot areas,and driveway aisles. High Street access is permanent access; Santa Barbara Avenue
access is"permissive", in case the use and/or design is ever modified to preclude same.
Redevelopment of the PHDIC property is proposed to be constructed in the near future and
additional widening will be done that will further improve this Santa Barbara Avenue corridor to
provide for more efficient and safer traffic maneuvers, as stated in the referenced traffic report.
The offer of dedication to the City from Rarig will be recorded simultaneously with the access
easement to Rarig. (See Exhibit A of Attachment 1).
CONCURRENCES
The Community Development Director and City Attorney concur with the recommended action.
FISCAL IMPACT
None.
ALTERNATIVES
Option 1: Deny approval of an access easement, as proposed. However, this would be contrary
to negotiations with between staff and Rarig and City Architectural Review Commission
approvals

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
APPROVING AN ACCESS EASEMENT FOR RARIG DEVELOPMENT AT
1998 SANTA BARBARA AVENUE
WHEREAS, "Rang Development, a Partnership" (hereinafter"Rarig"), has offered to grant
necessary rights of way to accommodate 1) the proposed widening of Santa Barbara Avenue
(adjacent to 1998 Santa Barbara Avenue), in accordance with the current City Council adopted
street widening line established with the Railroad Transportation Center(RTC)project,and 2) to
accommodate the RTC driveway access on High Street, and
WHEREAS, "Rang"has requested an easement for vehicular ingress and egress via
driveways being constructed for the RTC project to accommodate access to a proposed private
parking lot on Rarig property in exchange for the above dedication of rights of way, as described
and depicted in the attached"Exhibit A".
NOW THEREFORE BE IT RESOLVED that a vehicular access easement for ingress and
egress is hereby granted to Rarig.
The Mayor is hereby authorized to execute the easement deed to Rarig upon submittal of the offer
of dedication for the above-referenced street rights of way.

FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged, the City of
San Luis Obispo; a Municipal Corporation of the State of California, hereby GRANTS to Rarig
Development,.a partnership, as GRANTEE, an easement.for vehicular ingress and egress purposes
over portions of those parcels of land described as follows: 1) Parcel B, as described in Documont
No. 075219, filed for record on. December 30, 1985, and 2) Exhibit "A-1", as described in
Document No. 1999-071016, filed for record on October 6, 1999, in Official Records in the office
of the San Luis Obispo County Recorder, State of California,more particularly described as follows
and shown on the attached"Exhibit I":
1. Permanent ingress and egress via the City Railroad Transit Center (RTC) driveway(s) on
High Street.
2. Permissive ingress and egress via the RTC access driveway on Santa Barbara Avenue at
Upham Street.
