DISCUSSION At the June 19, 2001 City Council meeting, the Council adopted a resolution in accordance with Chapter X of the City Charter declaring the City's intent to grant San Luis Garbage Company (SLG) exclusive franchise agreements for green waste and residential curbside recycling collection. The next step in the process is to adopt an ordinance (Attachment 1) granting the franchises to SLG with the terms and conditions provided in the two agreements.. The term of the agreements are to coincide with the term of the refuse collection franchise which is until March 2012. Other key provisions of the agreements are: ■ Type: Exclusive ■ Term: March 2012 ■ Franchise fee: 6% of gross revenue ■ Service Highlights: ■Green waste containers provided to all residential and commercial customers ■Commingled recycling for all customers ■Public education and information component ■Bulky waste collection and recycling ■Addition of other materials as markets develop The execution of these agreements will ensure current and future services remain consistent with today's standards and assist in controlling future rate increases. CONCURRENCES San Luis Garbage Company and the SLO County Integrated Waste Management Authority concur with the recommendation made in this report. 3 - 1 Council Agenda Report—Green Waste&Recycling Franchises Page 2 FISCAL FYIPACT There are no new fiscal impacts associated with the recommended action. On November 9, 2000, the.City Council reviewed a base year solid waste rate application submitted by SLG and approved an integrated solid waste rate effective January 1, 2001 that includes residential curbside recycling and green waste collection services. (2001 Series) AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO GRANTING EXCLUSIVE FRANCHISES TO SAN LUIS GARBAGE COMPANY FOR GREEN WASTE AND RESIDENTIAL RECYCLING COLLECTION SERVICES WHEREAS, the City of San Luis Obispo has adopted a Source Reduction and Recycling Element (SRRE) to meet the state law AB 939 requirements; and WHEREAS, the SRRE states that the City will provide residential curbside recycling and green waste collection services; and WHEREAS, the San Luis Garbage Company has provided recycling services at a reasonable rate since 1977; and WHEREAS, San Luis Garbage Company has agreed to continue the provisions in the franchise agreements. BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Exclusive franchises shall be granted to San Luis Garbage Company for services to collect 1) residential and commercial green waste and 2) residential recyclables subject to the terms and conditions presented in Exhibit 1, Green Waste Services Agreement and Exhibit 2, Residential Recycling Services Agreement. SECTION 2. Ordinance No. 1308 (1996 Series) shall be repealed upon the effective date of this ordinance. SECTION 3. A summary of this ordinance, approved by the City Attorney, together with the names of the Council members voting for and against it, shall be published at least five days prior to its final passage, in the Tribune, a newspaper published and circulated in this City. This ordinance will go into effect at the expiration of thirty(30) days after its final passage.
