PURSUANT TO CIVIL CODE SECTION 798.75.5
FOR LAGUNA-LAKES MOBILEHOME PARK
The City of San Luis Obispo has adopted a Mobilehome Park Rent Control Ordinance. Any
purchaser of a mobilehome within Laguna Lakes Mobilehome Park must recognize and understand
that such person is purchasing(or has pw*chased)only the mobilehome which occupies a homesite
(space) within the mobilehome park and possibly accessory structures, etc. Ownership of the
homesite/space remains with the owner of the mobilehome park The price,appraisal or stated value
of the mobilehome may not reflect the mobilehome's offsite value but may;rather,reflect its"site"
value.
Thus,the price, appraisal or stated value of the mobilehome or the amount you have agreed
to pay for the mobilehome may reflect more than the intrinsic value of said mobilehome,which is
personal property. Laguna Lakes Mobilehome Park believes the best measurement or indication of
actual offsite or intrinsic value of a mobilehome can be obtained from either NADA or the Kelly
Blue Book valuation guides for mobilehomes. You may wish to request information respecting the
NADA or Kelly Blue Book value of the mobilehome from the Seller or dealer or agent.
Laguna Lakes Mobilehome Park contends that the City of San Luis Obispo Mobilehome Park
Rent Control Ordinance, as applied, is operating to take rights and/or property owned by the
mobilehome park and that the Rent Control Ordinance,as actually applied,is in direct conflict with
the Constitutions of the United States and California. Laguna Lakes Mobilehome Park would refer
the homeowner or prospective homeowner to Richardson v. City and County of Honolulu(9h Cir.
1997) 124 F.3d 1150, cert. denied, 525 U.S. 871, 119 S. Ct. 168 (1998), and Chevron USA v..
Cavetano(Dist HI, 1998) 57 F.Supp.2d 1003. Laguna Lakes Mobilehome Park would also refer the
homeowner or prospective homeowner to that certain news article in the April 26,2000 edition of
the Wall Street Journal concerning rent control in California, a copy of which article is attached
hereto and incorporated herein by reference.
The ultimate resolution of the propriety and/or validity of the City of San Luis Obispo Rent
Control Ordinance,as applied, could dramatically impact or alter the resale value,price,appraisal
or stated value of the mobilehome being purchased(or already purchased). Some rent control studies
have shown that for every$100.00 in below market rents,the mobilehome price could be$10,000
higher. It is the park owner's position that rents in the park are generally far below market as a result
of rent control and,particularly,the limitation on rent increases on resale. If these limitations are
lifted or declared illegal or unenforceable as unconstitutional,you should know that the mobilehome
may be of significantly less value"on site,"and you may be required to pay a significantly higher
rent.
