CAO RECOMMENDATION Adopt a resolution approving the request for a contribution of$215,000 in Affordable Housing Funds. DISCUSSION Background Judson Terrace Lodge Corporation (JTL), a local non-profit housing provider, plans to build 32 apartments for low-income, frail elderly persons in San Luis Obispo. As described in the attached letter, JTL has secured the necessary planning approvals and gone out to construction bids for this project after securing about $1.4 Million in local support, including funding from both the City and County of San Luis Obispo. Due to several factors, project costs have come in significantly higher than expected, leaving a funding gap of $579,157. To help close the gap, JTL requests a contribution of$215,000 from the City's Affordable Housing Fund. The current cash balance in the Affordable Housing Fund is $395,053. This is the first request for use of the Fund. Evaluation Designed to provide affordable housing for low-income, frail seniors, Judson Terrace Lodge is of particular importance to the community. It would provide affordable housing for a growing segment of the City's population and would meet a special housing need designated in the Housing Element of the General Plan. The City has already taken several actions in support of this project: • Amended the General Plan and rezoned the site from Low-Density Residential (R-1) to High-Density Residential (R-4) (GP/R 106-99); • Granted a negative declaration of environmental impact on the General Plan amendment and rezoning (ER 106-99); • Approved a use permit to allow a residential care facility (A 113-00); • Granted Architectural Review Commission approval of a new 32-unit senior apartment project (ARC 113-00); • Waived approximately $432,000 in City fees to accommodate affordable housing. BUS 6-1 Judson Terrace Lodge—Request For Affordable Housing Funds Page 2 In addition, JTL has requested $108,000 in 2002 City CDBG funds to install handicapped accessible facilities at the new apartments. At its November 14" meeting, the Human Relations Commission endorsed JTL's request for CDBG funding. That recommendation is tentatively scheduled to come before Council in February 2002. The Urban County of San Luis Obispo has already allocated $700,000 in HOME funds, and the federal government (HUD) has approved $2.6 Million in Section 202 funds to provide tenant rent subsidies. When the Affordable Housing Fund was established in 1999, the establishing ordinance described it as a "fund established and administered by the City, containing in-lieu fees and other funds held and used exclusively to increase and improve the supply of affordable housing." The ordinance also said the fund shall be administered by the Finance Director and is allocated "at the discretion of the City Council." The potential uses of the fund and award criteria were not spelled out in the ordinance, however Council has since approved award criteria for the Fund.. Staff's evaluation of JTL's request,based on those criteria, follows: 1. Eligibility. Use of the Affordable Housing Fund will increase or improve affordable housing and promote General Plan policies regarding housing and related community goals. The proposed project meets this criterion. It will provide 32 rent-subsidized apartments, affordable to very-low and low-income frail, elderly persons. It is consistent with Housing Element Program 1.22.11 and Policy 1.28.1: The City will establish a housing trust fund to be used to develop affordable housing units and acquire land for affordable housing projects. To qualify for such public assistance, housing must include guarantees that it will remain affordable as long as legally permissible. Affordable housing in-lieu fees will be placed in this fund. The City will encourage housing that meets the special needs of families with children, single parents, disabled persons, those desiring congregate or co-housing lifestyles, the elderly, students, and the homeless 2. Suitability. The project to be assisted is appropriate for its location, both in terms of land use and design. The project has received all necessary environmental, land use and architectural review approvals. Project site planning and design have been determined to be appropriate to the site and the neighborhood, and no community objections to the project were raised. 3. Urgency. There exists an urgent or overarching need for the type of housing to be assisted. Judson Terrace Lodge clearly meets this criterion. It will be part of a continuum of care and will help fill the gap in housing options for seniors in San Luis Obispo, especially seniors with very low incomes. It will provide low-income seniors with an intermediate level of care between independent living and nursing home care. While this level of care is available for seniors who can afford it, it is out of reach of many low-income seniors without assets. There are not other similar facilities in the City of San Luis Obispo that will accept very-low income seniors who BUS 6-2 Judson Terrace Lodge—Request For Affordable Housing Funds Page 3 need supportive life services, and very few in the County. Because of the commitment of HUD 202 funds, tenants will not have to pay more than 30 percent of their incomes for rent, making this housing affordable even to seniors with the lowest incomes. Judson Terrace Lodge will be located next to Judson Terrace (107 units), which has been providing independent living for low= income seniors for over 25 years. The two facilities will share some resources and coordinate activities as appropriate. 4. Financial Effectiveness. But for the requested assistance, the project would not be economically feasible; or AHF funding "leverages" significant additional funding from other sources. As described in the attached letter, a federal Section 202 grant has been approved in the amount of$2.6 Million. The deadline for JTL to provide a "commitment to proceed" has already been extended once. Without a firm commitment by JTL to proceed, HUD's funding commitment will expire December 17, 2001. A request for an additional time extension has been submitted and has the support of Congresswoman Lois Capps. The additional support requested from the City of San Luis Obispo is critically needed to allow the project to proceed and would, in essence, leverage over $3 Million in federal funds. Project funding is "tight", despite considerable cost cutting in the project's design. If Affordable Housing Funds are not granted, it is unlikely the project can proceed in the foreseeable future. 5. Readiness. The project has all necessary City approvals and is ready to proceed. The project has received all necessary planning approvals, and building plans are in for plan check. Initial plan check comments have been provided and plans returned to the applicant for corrections. Construction permits could reasonably be issued within six to eight weeks, depending upon how quickly the plan corrections are made, with construction to begin shortly thereafter. JTL's funding request appears to meet the recommended criteria. In staff s judgment, the project would provide a significant community housing benefit and by its use and design, requires substantial local and federal support to make it happen. As with most subsidized housing, project construction relies on a combination of funding sources. Once built, the project will receive federal rent subsidies for at least five years, with the possibility of continuing federal or state funding after that. Project funding will also be provided through donations and fund raising by Judson Terrace Lodge Corporation. ATTACHMENTS 1. Draft Council Resolution 2. Affordable Housing Fund Award. The City Council hereby awards $215,000 (Two Hundred and Fifteen Thousand Dollars) in Affordable Housing Funds to Judson Terrace Lodge Corporation for the development of 32 apartments for very-low and low-income frail elderly persons in the City of San Luis Obispo. SECTION 3. Award Payment. The Finance Director shall issue payment of $215,000 from the Affordable Housing Fund to Judson Terrace Lodge Corporation upon issuance of construction permits for a.32-unit senior housing project located at 3000 Augusta Street in the City of San Luis Obispo. It will be located on the landlocked parcel behind Judson Terrace Homes on Augusta Street. Plans are fully developed and in plan check. Construction will begin as soon we are able to close our financing gap and upon the U.S. Department of HUD's approval of our financing package. As you may recall,Judson Terrace Lodge was conceived by the nonprofit Board of Judson Terrace Homes and other senior advocates in San Luis Obispo. This was in response to the well documented desperate need for service-enriched, supportive housing and/or assisted living facilities for very low income seniors in San Luis Obispo and surrounding communities who can no longer manage to live independently. As such, Judson Terrace Lodge is expected to serve many extremely low-income seniors, such as those with incomes below 30% of the area median income. It took twelve years of planning and many setbacks and frustrations before the Judson Terrace Board combined forces with another faith-based nonprofit,American Baptist Homes of the West(ABHOW), to form a new nonprofit,Judson Terrace Lodge. We sought and obtained HUD funding of $2.6 million dollars for the frail elderly project, to be built on land we already owned. 1'he HUD funding, for which there was great competition, is a non-servicing loan— essentially a grant—which brings with it a five-year commitment of a tenant subsidy. This enables residents to pay not more than thirty percent of their incomes for rent. It is an incredibly good deal for very low income seniors—the best program currently available. To be eligible, residents must have incomes at or below fifty percent of the area median income for their household size—in other words, very low income people who, in many cases, will have no income other than Social Security. The HUD funding, however, is not sufficient to pay for the building's construction. We have requested and received very generous support for this project from both the City and the County of San Luis Obispo and other parties, as follows: BUS 6-6 City of San Luis Obispo ATTACHMENT 2 October 24, 2001 Page 2 County HOME funds: $700,000 City CDBG to purchase land: $ 94,000* City waiver of fees: $431,683 School impact fee waiver: $ 43,300 Owner donations and fundraising: $105,208 Owner unpaid advances (forgiven) $ 36,000 We had taken the architect's plans out to bid, and construction costs have come in higher than expected, thereby creating the funding gap. There are a number of reasons for this gap, among them the following: • Lumber costs have increased by $20,000 to $30,000 in the past three years, since our original request to HUD. • HUD requires Davis-Bacon wages for this project, and labor costs have gone up about 12% in the last three years. • There has been some neighborhood opposition to the project, requiring additional negotiations to upgrade the design of the common fencing, resolve placement of fencing on the actual property lines, and the moving or protection of neighbors' structures and planting along the existing fence line. The agreements, legal and consulting work alone, will add an additional$8,000 to $10,000. • The initial City design review indicated that given neighborhood opposition the only project that would be approved for this location would require a one-story profile from the upper property line. This has required an extensive site pad cut, offhaul of excess soil and deep masonry retaining walls. • Accessibility requirements demand that we maintain a flat floor level throughout the project. • The site has existing utility poles serving power to Johnson Street and these have to be relocated and new neighborhood drop lines installed at project expense. • The access driveway through Judson Terrace is requiring an engineered retaining wall. • A handicap access ramp is being required across the Judson Terrace property to the new facility. This requirement will add about$38,000 to the offsite costs. • We have incurred $59,000 in additional design and engineering fees as a result of the above required work. • A policy decision by HUD not to allow a bridge joining the Judson Terrace Homes site to the Judson Terrace Lodge site has required us to design a basement level with a three stop elevator adding about $200,000 to our building costs. *Approximately half of the site is owned by Judson Terrace. In spite of our best efforts,we were unable to persuade HUD to allow Judson Ten-ace to sell this parcel to Judson Terrace Lodge for one dollar. HUD requires that the appraised value be charged,and the payment used to write down the Judson Terrace mortgage. BUS 6-7 ATTACHMENT 2 City of San Luis Obispo October 24, 2001 Page 3 To address the increased costs we have done extensive value engineering, including: • Eliminating 600 square footage in common areas and hallways. • Eliminating the second elevator, which had been included to make the wing of the low-profile building more accessible to frail elderly residents. It was replaced by a one-person lift. Installation of the lift has now also had to be eliminated, although it could be installed at a later date. • Eliminating all the equipment in the common kitchen area, although stub-outs remain for future installations, when funds permit. Meals will instead be transported from the Judson Terrace Homes kitchen. • Simplifying the retaining wall at the rear of the property. • Eliminating a small amount of decorative brick veneer on the front of the building and replacing with scored, brick-colored plaster: • Changing the style of the shower units; only two units will now be fully accessible. • Eliminating laundry equipment, which will now be leased, not owned. • Making minor modifications to the window design. • Modifying the carpet specification to the minimum FHA standard. • Changing commercial quality VCT flooring materials planned in common areas to sheet vinyl. • Changing the paving specifications from concrete to asphalt. • Changing the wireless emergency call system to a site-based/hard wired system. • Specifying pre-finished hardboard instead of stained wood interior doors. No further value engineering is possible. We considered phasing the project, but with one building,this is not feasible. Even with the above changes, we have a funding gap of $579,157 (see attached spreadsheet). We are asking the City to commit $215,000 from its Inclusionary Housing Fund, the County to provide $200,000 in HOME funds, and the nonprofit owners are committing themselves to raising an additional $164,157 through a variety of fundraising efforts, including requests to foundations. The owners (ABHOW and Judson Terrace Lodge) have already received commitments of about$100,000. Additionally, we plan to apply for CDBG funding in 2002 to cover the costs of the handicapped ramp, fully accessible shower stalls, the lift and a more sophisticated emergency call system. These are items that were eliminated as part of the value engineering effort, as noted above. The cost of this building per square foot is $106, which is not unreasonable for current construction costs, the complex design and difficult site conditions. The per unit cost may seem high, but this is a small project that needs to address the common area needs of BUS 6-8 ATTACHMENT 2 City of San Luis Obispo October 24, 2001 Page 4 its frail elderly population. It does not have the economies of scale of a sixty unit building, and it will necessarily incur the unusual costs detailed above. We fervently ask however, that the Council bear in mind the population that will be served, the valuable subsidies that will be provided($517,000 for the first five years, plus expected extensions of the subsidy contract), and the fact that generations of frail, low- income San Luis Obispo seniors will be served by Judson Terrace Lodge. We are under considerable pressure from HUD to submit the application for Firm Commitment on this project. We have already received one six-month extension of time from HUD, which expires December 17, 2001 and we are requesting another six month extension. We have requested support from Representative Lois Capps in overcoming HUD's anticipated refusal of a further extension (attached). We simply cannot over-emphasize the costs involved.in losing this federal funding that not only provides for construction,but also a minimum commitment of five years in rental subsidies for our frail seniors. Together, this represents a sum in excess of three million dollars already earmarked for affordable housing. Consequently, the low-income . elderly residents of the City and County of San Luis Obispo, and their families; have the most to lose. Thus, the timing of the City's contribution, and its support of our request to HUD for an extension, are most critical. In closing, allow me to reiterate that we are committed to this project, to raising the additional necessary funds, and to commencing construction immediately after we get approval from HUD.
