DISCUSSION Background Staff has received a petition from residents living in the Verde/Luneta/Tassajara area seeking to establish a residential parking permit district in accordance with the provisions of Municipal Code—Section 10.36.170 (Designation of residential parking permit areas), which requires the support of a majority of residents living in the affected area in order to create the district. The petition is requesting that parking be restricted between the hours of 10pm and 6am, seven days a week. This request is actually an expansion of the current Tassajara parking permit district (Attachment 2). Although a portion of the residents within the proposed expansion area were surveyed when the original Tassajara District was established in 1994, at that time there was no strong support to expand the district beyond what was being proposed. This resulted in establishing the unique one-block Tassajara parking district that exists today.. Resident Support The new petitioners have the support of 68% (31 out of 45) of the residents who feel that things have changed since 1994 that warrant expanding the parking restriction boundaries. According to the petitioners there are a number of concerns that they feel justifies expanding the parking district: insufficient residential parking protection, excessive noise, heavy traffic, and street litter as a result late night parties, and a declining quality of life. Although the petitioners realize that parking restrictions will not solve all of the problems in their neighborhood, they believe the proposed parking measures will have a positive effect on the area. PH4-1 i Council Agenda Report-Residential Parking District Page 2 Staff Survey Results Because there is a potential for the parking problem to spillover into the adjoining neighborhood if the district was expanded, staff independently surveyed nearby blocks to determine if there was interest and support for expanding the district further than what was proposed. A total of 176 surveys were sent to adjoining blocks. The large survey area was driven by the fact that another parking district (Park View) ends several blocks away, which could potentially result in residents being surrounded by controlled parking within a smaller open parking area if they did not become part of the expanded district. The results of the survey were mixed and are shown on Attachment 3. Overall, 102 out of 176 (57%) responded to the survey. Of these results, only 47 residences (46%) supported becoming part of the proposed area, with no clear majority for any single block to join the expanded district. Fifty-five residences (53%) did not support becoming part of the proposed parking district. Given there was no majority interest to join the expansion area from the surveyed streets, staff would recommend that the district be expanded to the boundaries set forth in the petition with two exceptions. Staff is recommending that the boundaries of the proposed expansion area not include two residences on each end of Luneta (333 and 499) because the residents do not wish to be part of the expanded parking district. Furthermore, staff contacted the current residents on 100 South Tassajara who have the 24 hour, seven day a week parking restrictions to determine if they would like to change their block to the proposed hours of 10pm-6am. Only one of the residents desired to make a change at this time. Therefore, staff would recommend maintaining the 24-hour period for the 100 block of Tassajara and the expanded area be established at 10pm-6am. This format of two different time periods within one parking district currently exists in the Alta Vista parking district. Thus, there is precedent for this approach and it represents the will of the affected residents of the proposed expansion area. In addition to the mail surveys, staff also conducted field surveys in early November in an attempt to ascertain the level of the problem. Based on the field observations there was support for the petitioners' concerns regarding impacted parking conditions along the streets within the proposed parking district. Verde and Luneta were heavily impacted, with the remaining 0-99 block of Tassajara experiencing a moderate impact as you moved further into the neighborhood. Criteria For Preferential Parking District The Municipal Code (Section 10.36.170) requires three factors to be found in order to designate an area as a preferential parking district: 1) the area is predominately residential; 2) streets in the area are congested with vehicles parked by persons not residing in the area; 3) limiting parking in the area to bona fide residents is necessary in order to preserve the quality of life of persons residing in the area. PH4-2 .J Council Agenda Report-Residential Parking District Page 3 The first criterion is self-evident. The entire proposed area is residential along with congested parking on the affected streets. However, staff was not able to determine if the impact was from nearby residents of a large apartment complex or true non-residents. Based on discussions with the representative of the expanded area, it is a mixture of both, with heavy days occurring on Thursday-Saturday. Thus, it would appear that the proposed expansion area meets the second criteria at least 3 days a week. As with all parking districts, quality of life issues are highly subjective and staff has no means of saying one way or another if this criterion is met. This determination will have to fall to the Council after taking public testimony to decide whether this requirement can be fulfilled before granting final approval. Enforcement With the expansion of this district the City will have five large districts requiring enforcement at various times and days of the week throughout the City. The proposed hours of 10pm to 6am,daily would mean that the Police Department would assume the enforcement duties. Enforcement of this expanded area can be accomplished by utilizing the augmented Student Neighborhood Assistance Program (SNAP) staff that was approved as part of creating the College Highlands parking district in the spring of this year. SNAP personnel currently patrol the existing Tassajara and nearby Park View District which has restricted parking from 12am-7am daily. These similar hours to the proposed hours of 10pm to 6am daily can be patrolled with reasonable efficiency without a major impact to the current enforcement routine conducted by the additional SNAP personnel. Implementation Assuming passage of this District is approved, additional permits would need to be acquired and signs and poles would have to be ordered and installed. Necessary paperwork for first-time district households would be mailed to residents/owners during early January with enforcement ready to begin sometime in late February 2002. CONCURRENCES The proposed hours of l0pm-6am daily for restricted parking fall within the responsibility of the Police Department, and more specifically the augmented Student Neighborhood Assistance Program (SNAP) personnel that were approved as part of the College Highlands parking district. However, as with other after hours parking enforcement, the Police.Department would only be able to dispatch personnel (Police and/or SNAP) when appropriate staff was available to respond to parking issues as opposed to other higher priority calls. The Police Chief concurs with this assessment of the potential demands for parking enforcement of the expanded district. Staff also presented the proposed parking district to the Student Community Liaison Committee(SCLS) at its meeting of November 15, 2001; however, the committee took no formal position on the proposed expansion. PH4-3 Council Agenda Report-Residential Parking District Page 4 FISCAL IMPACT Creation of the parking permit district would have some direct costs to the City. Sign and pole installation would cost approximately $1,500. Additional permits and materials and processing would cost approximately $500. Since there is no formal budget for creation of this particular parking district, if approved, the monies would have to come from the unappropriated parking fund balance. Conversely, there is a potential for producing parking fine revenues of approximately $3,000-$5,000 annually depending upon the level of enforcement and the number of citations issued. ALTERNATIVES Given the support (68%) and the proximity of the proposed parking district to two existing parking districts, creating a larger residential permit area is the most effective means of meeting the wishes of the majority of residents living in the impacted area. Thus, staff would recommend establishing the residential parking permit district to help improve the quality of life for the neighborhood. Alternatives to the staff recommendation could come in many forms, e.g., no parking district; larger parking district; changes in hours or days of enforcement; etc. Staff feels that none of these alteratives would best meet the wishes of the neighborhood. BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. Pursuant to Section 10.36.170 et seq. of the San Luis Obispo Municipal Code the residential parking permit area is hereby established as shown and listed on Exhibit A. SECTION 2. No vehicle other than vehicles providing services to the area or having a residential parking permit clearly displayed on the dashboard on the driver's side of the vehicle may park on any street within the hashed area of the district boundaries 24 hours a day, seven days a week and all other streets within the district boundaries from l0pm to 6am, seven days a week. SECTION 3. The Public Works Department shall be directed to post the area with signs that clearly indicate these restrictions. SECTION 4. The Parking Division shall issue residential parking permits on demand as permitted in Section 10.36.220 of the Municipal Code. Permits shall be issued for a year effective September 15. In the two years I have lived in this neighborhood, I have seen a few of my neighbors, some of them students, having parties which impact the neighborhood to a greater or lesser extent. In fact, as City Police reports will show, I have been the victim of several cases of vandalism during some of these parties. Had this parking district been in effect when this vandalism occurred, it would have had absolutely no impact whatever, as the vandalism always occurred earlier in the evening than when the parking restrictions would have applied. The problem here was vandalism, not parking. If we, as neighbors, have a problem with parties or noise or vandalism, let's deal with those issues and not try to control them by fixing something that's not broken. Please vote against the Verde-Luneta parking district. This request stems from the concerns of the residents that their block would be impacted if the district were expanded without including their street. Although the staff survey of the adjoining streets initially did not receive a majority support from any block to be included in the expanded district, these residents have reconsidered the matter and now fully support becoming part of the district. All seven residences on the block have signed the petition(attached) to be part of the expanded area. Given this strong support, staff recommends the boundaries of the expanded district be amended to include this block. The revised boundaries are shown on the attached map. They are well within what can be expected when people are living in a neighborhood of single-family residences. As we understand the proposal, there will be unlimited parking on the street for residents and visitors during day and evening hours. And during the late night and early morning hours, each residence would have permits for two parking spots on the street. Our neighborhood is on the fringe of the off-campus housing. It appears that our streets get spill-over parking from those off-campus complexes. This makes it nearly impossible most of the time day or night for residents or their visitors to find a spot on the street. I have a physical disability making walking extremely difficult. We also have visitors from time to time who have mobility problems-especially as we all get older! The availability of parking within a reasonable distance of:our house has become increasingly difficult in the past few years until now the availability is negligible. Also, our neighborhood has homes that are used as rentals for college students. These homes are often the site for parties - usually week-ends but occasionally week-nights also. These parties bring scores if not hundreds of party-goers in cars which line the streets. (Last week-end our driveway was blocked by one of these cars when we got home at 11 PM. We had to call police for assistance.) The parties are often very noisy and there is an aftermath of litter on neighborhood lawns, sidewalks and in the street. Some of the party-goers become not only loud but abusive and vulgar especially as the hours that a party is in progress goes on. We urge establishment of the Permit District. Students at Cal Poly and Cuesta need housing. San Luis Obispo wants to retain its nice neighborhoods. THIS IS A REASONABLE WAY TO PRESERVE THE CHARACTER OF OUR NEIGHBORHOOD FOR LONG-TIME RESIDENTS AS WELL AS THOSE WHO ARE HERE ONLY A SHORT TIME.
