SUBJECT: 1123 MILL STREET (FORMER BOY SCOUT OFFICE) BUILDING
MATERIAL REMOVAL, SPECIFICATION NO. 90313
CAO RECOMMENDATION
1. Find the bid submitted for the 1123 Mill Street building material removal project non-
responsive.
2. Adopt a resolution dispensing with the competitive bidding process as authorized under the
Public Contract Code Section 20166.
3. Authorize staff to solicit written quotes for completing the building material removal.
4. Authorize an additional appropriation from the CIP Reserve Account up to $5,000 to allow
the CAO to award the contract if the cost is in excess of the Engineer's Estimate.
DISCUSSION
On April 16`h the City Council authorized additional funding for, and the advertising of, bids to
remove hazardous building materials from the former Boy Scout building. This work is an
offshoot of the creation of the Ludwig Community Center at the existing Recreation Center on
the corner of Santa Rosa and Mill streets.
On May 28`}' bids were opened for the removal work. Only one proposal was received. The
bidder was Diversified Technicians with a proposal of$13,158. The proposal was not submitted
as required in the bid documents. The proposal was not on the required form. It was not
accompanied by the proper paperwork or bid bond and the proposal was not signed. This in
itself is reason enough to reject the bid and staff is recommending the bid be rejected as non-
responsive. Research of the companies contract license indicates the contractor may not be
properly licensed and certified to complete this work.
The Public Contract Code allows cities to proceed with projects without complying with the
Public Contract Code requiring public bidding, when no bids are received. Because the one bid
received was non-responsive in accordance with the requirements of the bidding documents, the
City has received no acceptable bids. The City may now proceed with the project without public
bidding.
Staff would like to proceed with actively soliciting licensed and certified contractors to prepare
estimates for the work. This will hopefully accelerate the process to insure the building material
removal is complete prior to the start of the remodeling project by a contractor with the proper
certifications.

FISCAL IMPACT:
The current funding available for the abatement contract is $13,000 including contingencies.
Staff feels an additional $5,000 from the CIP Reserve (balance of over $260,000) will be
necessary in order to negotiate a successful contract. This will bring the funding available to
$18,000. In addition, the project will require the services of a project hygienist. Funding for this
service is available and is estimated at$10,000.
Abatement Contract: $ 13,000 Hygienist Contract: $ 7,000
Abatement Contingencies: $ 5,000 Hygienist Contingencies: $ 3,000
Total: $ 189000 $109000
ALTERNATIVES:
The alternative to obtaining informal proposals from contractors is to readvertise the project for
public bidding. This may or may not result in a lower bid price than informal proposals.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
DISPENSING WITH THE COMPETITIVE BIDDING PROCESS
FOR THE REMOVAL OF HAZARDOUS BUILDING MATERIALS AT
1123 MILL STREET(FORMER BOY SCOUT BUILDING)
WHEREAS, the Public Works Department publicly bid the project to remove hazardous
materials from 1123 Mill Street; and
WHEREAS, the only bid received was determined to be non-responsive; and
WHEREAS, it is important for this project to proceed in a timely manner to be completed in
advance of the remodeling of the existing Recreation Center.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo
that the competitive bidding process is to be dispensed with for the project to remove hazardous
building materials from the former Boy Scout Building at 1123 Mill Street, and staff is authorized to
solicit written quotes for completing the building material removal.
