CAO RECOMMENDATION Give final passage to Ordinance No. 1419, as introduced June 18, 2002, approving a negative declaration and prezoning most of the Damon-Garcia site to Public Facility, while leaving the creek corridors zoned Conservation/Open Space. DISCUSSION Data Summary Property Owners: City of San Luis Obispo General Plan Land Use Map: Open Space Zoning: Conservation/Open Space Surrounding Uses: Land to the north, west, and south is grass-covered flatland and hills; to the east is a service neighborhood on nearly level land. Environmental Status: Negative declaration to be approved by ordinance. Action deadline: Not subject to State-mandated action deadlines. Background The active-use portions of all existing City parks are zoned Public Facility (PF), in conformance with the consistency matrix of the resolution that adopted the Land Use Element. When the site intended for sports-fields development was annexed, it was zoned Conservation/Open Space (C/OS), as required for the Margarita Area prior to the specific plan being adopted. The Zoning Regulations allow parks in the C/OS zone with use-permit approval. However, the limit on paved area within a site zoned C/OS is problematic for the proposed sports fields when all parking and paths are considered and the area that may be occupied by the potential Prado Road extension is excluded. The General Plan says creek corridors should be zoned as open space. Creek corridors contain the channels themselves, plus space for creekside vegetation. The recommended action would keep the creek corridors in the C/OS zone. A note on the zoning map exhibit would allow the Community Development Director to adjust the location of the Orcutt Creek corridor (the smaller creek in the southeastern part of the site), if it is relocated as anticipated. Attachment Attachment #1: Ordinance No. 1419, including exhibit map gm/44-02final.doc C9-1 ATTACHMENT 1 ORDINANCE NO. 1419 (2002 Series) AN ORDINANCE OF THE SAN LUIS OBISPO CITY COUNCIL REZONING PROPERTY LOCATED AT 3615 BROAD STREET (R 44-02) WHEREAS, the City Council conducted a public hearing on June 18, 2002, and has considered testimony of interested parties, the records of the Planning Commission hearing and action, and the evaluation and recommendation of staff; and WHEREAS, the City Council has considered the draft Negative Declaration of environmental impact as prepared by staff and recommended by the Planning Commission; BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Environmental Review. The City Council finds and determines that the project's Negative Declaration adequately addresses the potential environmental impacts of the proposed zoning, and reflects the independent judgment of the City Council. The Council determines that the zoning will have no significant effects on the environment. The Council hereby adopts said Negative Declaration. SECTION 2. Findings. That this Council, after consideration of the proposed zoning, and the Planning Commission's recommendations, staff recommendations, public testimony, and reports thereon makes the following findings: A. The proposed PF and C/OS zones are consistent with the General Plan. B. The proposed PF and C/OS zones are consistent with the intended uses and locations of the zone as described in the Zoning Regulations. C. The proposed PF and C/OS zones are consistent with the uses and the types of improvements proposed for the project site. SECTION 2. Adoption of Zone. The territory to be annexed shall be zoned as shown on the attached Exhibit A. SECTION 3. Publication. A summary of this ordinance, together with the names of Council members voting for and against, shall be published at least five (5) days prior to its final passage, in the Tribune, a newspaper published and circulated in this City. This ordinance shall go into effect at the expiration of thirty (30) days after its final passage. This exhibit shall be modified to show the new Orcutt Creek alignment, after the project is completed. RED-FILE MEETING AGENDA July 2, 2002 DATE I'Z'0ZITEM #— — Mayor Settle City Council Members 990 Palm St, SLO, Cal. 93401 Dear Mayor Settle, and City Council Members, I have spoken many times regarding Prado Rd northern alignment and it's future effect on the Damon-Garcia Sports Fields. My goal has been to have the northern alignment segment of Prado Rd (the one you changed in February, 2000)returned to its original place ending at Industrial Way, or realigned to end further south at Tank Farm Rd or Buckley Rd. It should be removed as it separates our childrens sports fields and the open space and any future development for more sports fields. In summary, I have tried to express the following: 1. Prado Rd, northern alignment, will destroy 15 to 45% of Archaeological site SLO-CA-1427. This site is significant and the city should take measures to preserve it not destroy it, 2. The road is not safe for our children. A 100 foot tunnel isnot safe, regardless of mitigation measures. 3. The inadequate parking and the proposed parking off-site are both unsafe for our children. The city is creating a safety impact for our children, families, and visitors. 4. There are many environmental impacts to consider including, mountain scarring, noise impacts, visuals impacts, air quality impacts, plus, due to road alignment, some mountain blasting, and berms being built 18-20 ft above grade of ball fields. 5. Environmentally, all this can happen and still be ok, according to the Negative Declaration? These are significant impacts(#4). A Negative Declaration:seem inadequate. There is no certified EIR on the entire Margarita area specific plan as yet. How can you pull out a parcel from the specific plan and address it's environmental impacts with only a negative declaration, especially when the parcel has a proposed highway 227 road alignment included in it's future development? I have ask many times and never received an answer to that question. 6. CalTrans just published a notice that they are proposing to improve Highway 227 (South St/lower ffiiguera)with sound walls. Isn't Prado Rd suppose to become Highway 227? There is no discussion on this recent issue. 7. Paul LeSage said that the 7 acres, taken up by Prado Rd, could be used for recreational purposes, why didn't anyone say OK, and move the highway off the sports fields 23 acres? I am 100%in favor of the sports field complex. I am a coach and a Dad. Prado Road did not have to be attached to the kids sports field project. What a shame.
