CULVERT EXTENSION UNDER AN EXISTING STREET WIDENING AGREEMENT (PM SLO 99-214) CAO RECOMMENDATIONS 1) Authorize $137,620.53 payment to Source Commercial Group (Dan Lemburg, et al) for work performed under the provisions of an agreement between the City and Marilyn Stickler, et al. 2) Approve a budget amendment to transfer $40,000, budgeted for a nearby culvert extension under "Street Widening — Orcutt Road (Duncan-Bullock), and $23,000 CIP Reserve Fund into the subject project account. DISCUSSION Background The City Council approved an agreement with Marilyn Stickler, et al, on October 22, 1996 (Attachment 1) regarding the purchase of an additional nine (9)ft. of right of way for Orcutt Road,to accommodate a Council (previously) adopted revised Orcutt Rd. setback line. The Grantor(owner)had already dedicated 22 ft. of right of way to accommodate the previously adopted setback line. The additional 9 ft. was added specifically to allow a wider landscaped median and slightly wider parkway. The agreement provides for reimbursement to the property owner for design and construction costs associated with installation of the box culvert, but not the otherwise typical frontage improvements,base material, street paving, etc. The agreement also provides for reimbursement to the City by the owner, if the street widening had been built under a City contract,because of"traffic demands" and prior to development of the owner's property. In such case,the reimbursable costs would be for any additional costs beyond the basic culvert construction that was done, including but not limited to: standard curb, gutter and sidewalk, base and paving, utilities relocations, etc. The current owner (Source Commercial Group) is subject to the terms and conditions of the agreement and has subdivided the property into 4 parcels. The street widening (including the box culvert) is one of the conditions of that subdivision. Building permits on the parcels are currently being processed for the development. -7-/ COUNCIL AGENDA REPORT—Reimbursement for Orcutt Road Culvert Page 2 Reimbursement Request and Evaluation The estimated total cost in 1996 was $75,000, which was budgeted under CIP 53919747-90553. However, the lowest bid for the basic box culvert only, received by the owner, including approved additive items, excluding initial backfill, environmental monitoring and mitigation planting of the disturbed riparian corridor, was $86,100. The actual project costs, including these items; totaled $163,706.64. These costs were higher than the budgeted amount due in part to considerable added costs beyond the basic culvert construction costs that were associated with obtaining the necessary permits, environmental monitoring and replacement of riparian vegetation. Other Contributing factors included increases in construction costs between the date of the agreement and the date of construction and the time of year that construction occurred. The owner submitted a request for the entire $163,706.64 for reimbursement by the City(Attachment 3). Staff evaluated the items submitted for reimbursement and determined that not all costs are eligible for reimbursement by the City. Staff believes that the method of bidding the work by the owner (i.e., segregating the culvert from the remainder of the street work) led to possible higher costs. The owner chose to pursue the culvert contract ahead of the complete.street project to accommodate the imminent winter rainy season. The plan was to complete the remaining work during the Fall and Winter - outside of the creek and the Corps of Engineers and Dept. of Fish& Game jurisdictions. Environmental monitoring, prior to and during construction, was a requirement of the Army Corps of Engineers (ACOE)permit. Although the ACOE permit incorporated language for"full- time" monitoring during construction, City staff (including Natural Resource Manager, Neil Havlik) concluded that limited monitoring, once the creek habitat was disturbed and once the work had progressed outside the "waters of the United States" would be sufficient to meet State and Federal requirements. However, the owner chose to follow the permit "requirement" verbatim, which resulted in a cost of$20,315. Staff has evaluated the owners request (Attachment 2) and has approved the following reim- bursement schedule based on the attached agreement: 1) One hundred percent of the costs associated with the original construction contract, less those costs required by the "conditions of approval" for the subdivision, i.e. utility relocations, curb gutter sidewalk, railings, street drainage, paveout, etc. 2) One hundred percent of the costs for preparation of the environmental plan, replanting and mitigation. 3) Fifty percent of: a) the costs for the work by the applicant's engineer, in acquiring the environmental per- mits b) the costs associated with construction after expiration of the first Army Corp of Engi- neers permit c) the costs associated with the Environmental Consultant, Morro Group, after expira- tion of the first Army Corp of Engineers permit Based on the above analysis and the agreement, staff believes that a fair and equitable distribution of costs allocates $137,620.53 as the City's share and$26,086.11 as the property owners share. C/7—2- COUNCIL AGENDA REPORT—Reimbursement for Orcutt Road Culvert Page 3 Budget Amendment In order for the City to reimburse the owner, Staff is requesting a budget amendment to the approved CIP for the subject culvert extension. The source of the funds is the CIP Reserve fund ($23,000) and the Orcutt/Duncan to Bullock Widening. The Orcutt/Duncan to Bullock project proposed to widen the South side of Orcutt Road for bike lane. However, this project is already "bonded for' and will be constructed with the approved Tract 2134 and therefore City funds are no longer needed. CONCURRENCES The Finance Director and City Attorney concur with the recommended action. FISCAL IMPACT Approval of the reimbursement requires a budget amendment to the subject CIP in order to supplement the already budgeted $75,000. The source of the funds is the CIP reserve fund for $23,000 and $40,00 from the CIP for improvement of Orcutt Road. Under the recommended funding revisions, the CIP reserve will be reduced by $23,000. The current balance in this account is $106_,500, leaving $83,500 to address other CIP contingencies for the balance of the fiscal year. ALTERNATIVES 1) Deny the request for reimbursement for the Orcutt Road Culvert Extension. 2) Deny the request for reimbursement for the Orcutt Road Culvert Extension and direct staff to renegotiate the amount. 3) Authorize a reimbursement of the originally budgeted amount of$75,000. CITY agrees to: a. Pay the sum of sixty-one thousand five hundred dollars ($ 61, 500.00) for purchase of the above-referenced property (fee title) . The funds shall be paid upon receipt of a deed conveying clear title to the subject property. b. Budget for and reimburse GRANTORS for the pro-rata design ' and construction costs to extend the existing drainage structure under Orcutt Rd. (approximately 700 ft. east of Broad St. ) to the future back of sidewalk, during the next City budget period. If CITY paves out any portion of Orcutt Road, adjacent to GRANTOR(S) I property, CITY shall calculate the equitable (market) value of .City-installed facilities which are the responsibility of the Developer, pursuant to this agreement. Due to these, I have given you the benefit of half the construction related costs after expiration of the Corps permit. Certainly the project could have been better managed but,at this point,arguing over those merits would not accomplish much. I consider this matter closed and have directed my staff to process a.reimbursement in the amount of$137,620.53.
