RESOURCES BOARD(CARB)RESOLUTION 00-2
CAO RECOMMENDATION
Adopt resolution approving the SLO-Transit Fleet Action Plan, in accordance with the
requirements of CARB Resolution 00-2.
DISCUSSION
Background
In September 1998 the California Air Resources Board (CARB) adopted Resolution 98-49 urging
transit agencies and school districts to convert their diesel transit fleets to alternative fuel(i.e. CNG)
through standard bus replacements. Transit agencies, metropolitan planning organizations, engine
manufacturers, and the California Transit Association (CTA) worked with CARB to develop an
emission rule that would give transit operators flexibility towards reducing emissions from their
fleets. As a result of these discussions, CARB, in 2000, adopted Resolution 00-2, which further
defined the emission goals that each provider must accomplish and required each agency to adopt
an Action Plan to show intended compliance with CARB regulations. The Status Report for Public
Transit Bus Fleet Rule (March 2002) summarizes the current regulation and has been included in
the Council's reading file as background information for this report.
What is CARB Resolution 00-2?
CARB Resolution 00-2: Public Transit Bus Fleet and Emission Standards for New Urban Buses
was passed in 2000 and will be in effect through 2015 unless changed in the future. Resolution 00-
2:
1. Required transit operators, by January 31, 2001, to choose one of two fuel paths to cleaner
emissions.
2. Set milestones for clean air emissions, and
3. Allowed the choice of two implementation action plans to achieve clean air emissions.
Fuel Path to Cleaner Emissions
Transit operators were required to choose a fuel path to meet the new emission standards in
2001. Regardless of fuel path chosen, all transit engines must comply with the same emission
standards by 2007. The two options presented to transit operators to choose from include:
a) Clean Diesel Fuel Path. Allows transit operators to continue purchasing diesel engines, but
requires operators to adhere to accelerated Fleet Rule and bus purchase requirements. Large
operators (>200 buses)were also required to demonstrate zero emission technology.

b) Alternative Fuel Path. Requires 85%of a transit operator's bus purchases be alternative fuel
through the term of the regulation. Using this path, transit operators adhere to a more
relaxed schedule for complying with the Fleet Rule, and are not required to demonstrate
zero emission technology.
On February 6, 2001, the City Council declared the Clean Diesel Fuel Path by resolution. Clean
diesel is a type of diesel that contains low sulfur that meets emission standards set forth by the
California Air Resources Board. The diesel path provides a fast track for the reduction in
Particulate Matter emissions (PM) and the reduction in nitrogen oxide (NOx) emissions. The
reduction of PM emissions is made possible by the installation of a diesel particulate filter retrofit
for each bus. This device filters particulate materials prior to their release into the environment.
Current Milestones for Clean Air Emissions
The first milestones transit operators had to
meet by an October 1, 2002 deadline were the Table 1
clean air standards set forth in Table 1. The Emission Standards for October 1,2002
City met the standard for NOx, but has not Emission Standard Actual

(PM). The primary reason for non-compliance 4.80 g/bhp 4.30 g/bhp
with the PM standard is due to the City's older
fleet of pre-1991 vehicles, which have higher PM emissions.
Implementation action plans available?

1996-2002 20% 75% loo production year) as mandated by CARB.
Based on this option, the City would need to decommission one pre-1991 vehicle and install PM
retrofit devices in the bus fleet as described in the Summary of Options (Attachment 2). The total
cost after the completion of this option in 2007 is estimated at$98,000. In addition,staffestimates a
need for an additional $135,000 to install devices to meet 2007 standards for NOx even though no
such devices or technology are available at this time that would allow the standard to be met.

The second action plan option available Table 3
to the City is deferred implementation. Option 2:Deferred PM Retrofit Implementation Schedule
This option is available to operators vehicles/Year 2003 2004 2005 2006 2007
with less than twenty vehicles. Because Tier 1 100 I
the City has fourteen (14) vehicles in its Pre-1991
bus fleet, the City is eligible to exercise Tier 2 100
this option. The deferred implementation 1991.-1995
Tier 3 100
action plan allows the City to delay PM 1996-2002
retrofit until 2007. Table 3 summarizes
the deferred PM retrofit implementation schedule for transit operators with less than twenty (20)
vehicles. Based on this option,the City will still need to perform the following:
• Decommission one pre-1991 vehicle. This decommissioned vehicle would be placed in the
inactive fleet and used for parts for other buses.
• Install two PM Retrofit devices in 2003 in order to show progress towards compliance. By
retrofitting two clean diesel vehicles, the City can significantly reduce its overall PM
emissions.
• Install twelve PM Retrofit devices in 2007, representing the balance of the transit coach
fleet. (Note: Trolley vehicles are exempt from the emission requirements because they are
not considered to be heavy-duty transit coaches)
The total cost after the completion of this option in 2007 is estimated at $135,000 but could be
more depending on availability of PM trap devices or the need to replace bus engines.
Recommended action plan option for the City
Staff recommends that the City utilize the Deferred Implementation option as outlined above. In
simple terms, deferred implementation allows the City the greatest flexibility in retrofitting its bus
fleet and establishing cost control.
Currently, there are no combustion engines on the market nor known technology available to meet
the 2007 NOx standards. Thus sometime prior to the 2007 date, either new technology will emerge
or CARB will need to reconsider the rules. The Deferred Implementation action plan option affords
the City the opportunity to wait for engine manufacturers to produce an engine or develop a PM trap
that meets the 2007 NOx standard. Prior to the arrival of 2007, it should be clear whether or not the
engine manufacturers will have a solution to this issue and what course of action is best for the City.
The Deferred Implementation option gives the City the ability to wait for technological
advancements to satisfy both emission standards without first retrofitting to meet the 2002 standard
(which cannot be met for NOx) and then again addressing the 2007 NOx standard by either retrofit
devices or new engines.

FISCAL IMPACTS
The Deferred Implementation Action Plan costs less than the Tiered Implementation action plan(by
$98,000) and gives the City greater flexibility and most likely the best ability to meet clear air goals.
The estimated cost of fitting filters on the two buses to reduce the particulate matter emissions is
$39,000. This amount was allocated in the approved 2002-03 budget (see pages E-14 and E-15 of
the 2001-03 Financial Plan Supplement). Funding needed in 2007 for the remaining buses would
need to be budgeted in the 2005-07 Financial Plan.
CONCURRENCES
The Mass Transportation Committee, at their regular meeting on March 13, 2002, concurred with
the proposed CAO recommendation. Please refer to the minutes in Attachment 3.
ALTERNATIVES
Alternative 1. The Council could defer all retrofits and decommissioning of vehicles until 2007.
The consequence of this action would be that CARB may determine that the City is reluctant to
make reasonable efforts in reducing emissions and withhold future transit funding. In recent
months, CARB has been considering the elimination of the Clean Diesel Fuel Path. By showing
good faith effort to reduce emissions, CARB will be less likely to eliminate this fuel path.
Alternative 2. The Council could select the tiered implementation action plan option. The
consequence to this alternative is that the City may run the risk of spending more of its limited
transit dollars by addressing NOx and PM emissions separately, instead of waiting for the engine
or trap manufacturers to develop the technology to address the emission standards
simultaneously.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
APPROVING THE CITY OF SAN LUIS OBISPO'S 2002 TRANSIT FLEET ACTION PLAN IN
ACCORDANCE TO THE REQUIREMENTS OF THE CALIFORNIA AIR RESOURCES
BOARD(CARB)
WHEREAS, the California Air Resources Board (CARB) is authorized to make
regulatory amendments to reduce emissions from mobile sources; and
WHEREAS, these amendments require the City of San Luis Obispo to meet certain
obligations in the purchase, maintenance and upgrading of public transit buses used in revenue
service; and
WHEREAS, it is required by the California Air Resources Board, in accordance with the
provisions of Title XIII of the California Code of Regulations, Sections 1956.1 — 1956.4 that the
City select a compliance path and notify CARB of its intent to follow that path; and
WHEREAS, the City declared the clean diesel path on February 6, 2001; and
WHEREAS, the tiered implementation and deferred implementation are viable options
for the City to meet the CARB mandates;
WHEREAS, the City has less than twenty heavy duty transit coaches and operates within
a one hour ozone attainment district and is eligible to defer implementation to January 1, 2007;
NOW,THEREFORE, BE IT RESOLVED that the Council of the City of San Luis
Obispo,who operates SLO Transit:

1. Authorizes the City Administrator Officer to exercise the deferred
implementation; and
2. Authorizes the City Administrator Officer to decommission one pre-1991 heavy
duty transit vehicle, placing the decommissioned vehicle into the inactive fleet, and utilize it for
spare parts; and
3. Authorizes the City Administrator Officer to install CARB certified particulate
matter filtering devices in two heavy duty transit vehicles; and
4: Authorizes the City Administrator Officer to comply with the CARB mandates by
either installing the balance of the heavy duty transit vehicle fleet with CARB certified
particulate matter filtering devices and/or other equipment, including complete power modules,
to comply with the CARB emission standards and mandates.

Chairman Paul Dalian called the meeting of the Mass Transportation Committee to order
at 2:34 p.m. on Wednesday, March 13, 2002, in Room B, Parks and Recreation Center,

INFORMATION ITEMS
Il. Status Report on the Restructuring of Advisory Bodies
Peggy Mandeville provided the Committee with an update on the Council's goal
of creating a parking and access advisory body. Staff informed the Committee
that the Council is no longer considering the consolidation of any existing
committees and has scheduled a joint meeting with the Planning Commission to
discuss the possible expansion of their role to more explicitly include parking and
access issues in their discussions and deliberations.
Ms. Mandeville also provided the Committee with an update on the City's
Downtown Transfer Center project. The project, which consists of improvements
to the Osos Street transit block; will begin construction in April. During
construction, City buses will temporarily be relocated to Palm Street (between
Osos and Morro Streets).

I2. MTC Committee Chair Announcement
Chairman Paul Dahan gave a farewell speech. Expressed his appreciation for the
opportunity to work with the Mass Transportation Committee as Chair.
I3. Transit Manager's Report
Mr. O'Dell presented the Transit Manager's report highlighted on the
Reauthorization of Transportation Equity Act for the 2151 century. The proposal
from the Federal Transit Administration was rejected by the American Public
Transportation Association (APTA),which would have decreased the City's
federal apportionment. APTA presented a proposal that would increase the City's
federal apportionment and provide additional operational and capital money. The
APTA Legislative Committee in March 2002 and the APTA Board of Directors
will consider this proposal in Spring 2002. If APTA's proposal is accepted then
this proposal will be used as a lobbying document for the Reauthorization of TEA
21.
14. Members' Information
Committee member information packets were passed out by Austin O'Dell. After
review of these packets,personal information corrections were noted.

Motion made to accept the meeting minutes by Paul Dahan; seconded by Jean

DISCUSSION ITEMS
DI. San Luis Obispo's 2002 Transit Fleet Action Plan in Accordance to the
California Air Resource Board (CARB) Resolution 00-2
Mr. O'Dell gave a PowerPoint presentation of the City's decision to opt for the
clean diesel.path as mandated by the California Air Resource Board (CARB).
Mr. O'Dell presented two options for the City to consider in order to comply with
the CARB mandates. The first option was the tiered implementation and the
second was the deferred implementation. Because the city had less than 20
vehicles Mr. O'Dell recommended the deferred option, in addition to selling one
pre-1991 vehicle and retrofitting two vehicles in 2003.
Motion to accept Staff's recommendation to approve a resolution adopting the
Deferred Implementation in the Transit Fleet Action Plan per CARB Resolution
00-2 made by Jean Knox; seconded by Jennifer Allen-Barker and carried out
unanimously.

D2. Recommended Participation in Zero Fare as Part of Try Transit Month in
September 2002.
Mr. O'Dell informed the Committee of Regional Rideshare's grant from the San
Luis Obispo Air Pollution Control District (APCD) for$50,000 to provide
countywide transit subsidies. Regional Rideshare would like to restructure their
grant to provide free countywide transit for month of September 2002 for Try
Transit Month in association with National Try Transit Week. Mr. O'Dell further
informed the Committee that the estimated fare revenue for September 2002 is
equal$22,500. The estimated reimbursement for participating in Try Transit
Month from Regional Rideshare would be $17;500, Mr. O'Dell provided the
following issues for consideration:
• Estimated fare box ratio for September 2002
• Should the City absorb the loss in fair revenue for one month?
• Will the loss in fare revenue jeopardize the required fair box ratio to
receive STA funds?
• Will first-time riders become loyal riders?
Mr. O'Dell requested the Committee to make a recommendation for City Council
.regarding participation in Try Transit Month.
Motion to participate in Try Transit Month contingent on its being a Countywide
effort and conditional upon receipt of Air Pollution Control District's funds made
by Richard Lee; seconded by Jean Knox and carried out unanimously.
ACTION ITEMS
Al. Assigning Two Committee Members to Serve on the Art on Bus PaneL
Members must be able to meet on March 26, 2002 or March 27,2002. Deby
Anderson and Jean Knox volunteered to serve on the panel. Coordination for
final meeting date and time will be made by the project manager for the Art on
Buses Program.
A2. Ad Hoc Committee Assignments for the SRTP Subcommittee,and the Bus
Stop Committee.
Jennifer Allen-Barker and Deby Anderson will serve on the SUP Subcommittee
and Ann Wager and Jean Knox will serve on the Bus Stop Committee. Staff will
coordinate meeting times.
A3. Election of Chair and Vice Chair of the Mass Transportation Committee.
Chair Paul Dahan's and Vice Chair Jean Knox's terms expire March 31,2002.
Deby Anderson was nominated by Richard Lee and Richard Lee was nominated
by Jennifer Allen-Barker for the position of Chair. Richard Lee was nominated
by Ann Wager and Andrew Rubin was nominated by Paul Dahan for Vice-Chair.
Deby Anderson received five votes thereby giving her the position of Chair.
Richard Lee received five votes thereby giving him the position of Vice-Chair.
