HomeMy WebLinkAbout10/15/2002, C9 - MEMORANDUM OF AGREEMENT (MOA) BETWEEN THE CITY AND THE SAN LUIS OBISPO POLICE STAFF OFFICERS' ASSOC council NiftfiqD� /o/a-o AD aacEnba Report cv C I T Y O F SAN LU IS O B I S P O FROM: Ann Slate, Director of Human Resource Prepared by: Karen Jenny, Risk Managery SUBJECT: MEMORANDUM OF AGREEMENT(MOA)BETWEEN THE CITY AND THE SAN LUIS OBISPO POLICE STAFF OFFICERS' ASSOCIATION (SLOPSOA) CAO RECOMMENDATION Adopt a resolution approving the MOA between the City and SLOPSOA for the period of July 1, 2002 through June 30, 2004. SLOPSOA represents the Police Sergeants, Lieutenants and Captains. DISCUSSION In closed session on May 7, 2002, the City Council authorized staff to begin negotiations with SLOPSOA and to develop a successor agreement to replace the current MOA, which expired June 30, 2000. The City's bargaining team of Ann Slate,Karen Jenny and Bill Avery met with the SLOPSOA team on March 22, April 16, June 12, August 16 and August 28. A tentative agreement has been reached,which includes the addition of one new classification and the movement of two management classifications into this bargaining unit. The substantive provisions of the agreement include: Salary Increases: Communications Records Supervisor Sworn Supervisor & Communications Manager Effective 7/02 4% Effective 2/03 3% Effective 7/03 3% 2% Effective 1/04 2% 2% 2% Effective in February 2003,the City's contribution(1%) to deferred compensation will cease for the Records Supervisor and Communications Manager. Retirement: The agreement includes the 2.7% at 55 retirement formula for miscellaneous employees under the similar cost-sharing provisions as other bargaining groups and the 3% at 50 retirement formula for safety employees. Sick leave payouts at retirement: 20% after 20 years of service with City of San Luis Obispo Council Agenda Report—SLOPSOA Memorandum of Agreement Page 2 25% after 25 years of service with City of San Luis Obispo 30% after 30 years of service with City of San Luis Obispo Elimination of the current benefit of 10%payouts after ten years. City Contribution to Cafeteria Plan: Effective November, 2002, the current equal contribution of$400 per month to the City's cafeteria plan for health insurance premiums will change to a graduated system of$290 per month for employee only, $540 per month for employee plus one dependent, and $690 per month for family coverage. This is the same as what the Police Officers' Association is receiving. The agreement includes a re-opener to discuss changes to the City's contribution in July 2003. Uniform Allowance: The uniform allowance for employees required to wear uniforms will be increased from$775 to $850 effective 7/02 and to $900 effective 7/03. Overtime: Language in the MOA will be modified to provide the sergeants who are eligible for overtime the similar overtime provisions that are currently in place for the police officers, including an increase of the maximum number of compensatory hours that an employee can accumulate from 48 to 80. Reopener: Should the City and POA agree to any modifications to the PERS Police Retirement Plan,the City would agree to meet and confer with SLOPSOA (which is actually required by state law). Any enhancements to the retirement plan that SLOPSOA may receive would be cost neutral to the City with the employees bearing any and all costs,including both short-and long-term costs. FISCAL IMPACT Total compensation for SLOPSOA is approximately $1,500,000 per year. The package as described above costs approximately$86,100 in year one and$68,000 in year two. These costs do not include the cost of implementing the 3%at 50 retirement formula for Police safety employees; a cost report has been requested from PERS and is expected toward the end of October. Funding required to support FY 2002- 2003 is available in the existing fund balance. The second year costs will be included in the two-year financial plan for 2003-05. ALTERNATIVES Because the MOA complies with previous Council direction, is similar to contracts recently approved for other units (including SLOPOA), and demonstrates the City's and SLOPSOA's willingness and ability to craft a mutually satisfactory agreement in a timely and collaborative manner, no alternatives are presented for Council consideration. (2002 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO ADOPTING AND RATIFYING THE MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF SAN LUIS OBISPO AND THE SAN LUIS OBISPO POLICE STAFF OFFICERS' ASSOCIATION FOR THE PERIOD OF JULY 11 2002—JUNE 30,2004 BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. The Memorandum of Agreement between the City of San Luis Obispo and the San Luis Obispo Police Staff Officers' Association(SLOPSOA), attached hereto as exhibit "A"and incorporated herein by this reference, is hereby adopted and ratified. SECTION 2. The Finance Director shall adjust the Personnel Services appropriation accounts to reflect the negotiated compensation changes. SECTION 3. The City Clerk shall furnish a copy of this resolution and a copy of the executed Memorandum of Agreement approved by it to: Steve Tolley, SLOPSOA President and Ann Slate, Director of Human Resources.
