HomeMy WebLinkAbout03/01/2004, C4 - LIBRARY REQUEST FOR DEDICATED COMMERCIAL LOADING ZONE Council Agenda Report- Municipal Code Amendment Section 10.40.030 Page 2 However, staff realizes that the 919 Palm Street construction project is creating parking problems for the library vans, and is therefore recommending that the Municipal code be amended to allow Council discretion to extend time limits in commercial loading zones as it sees fit for certain reasons. Even with extended time limits, the commercial loading zone would be open to any vehicle with commercial license plates engaged in unloading and loading.activities, as well as Library vehicles. Staff proposes to add the following wording to section 10.44.030 (c) of the Municipal Code. A legislative draft of the proposed change is included as Attachment 2. The Council may, by resolution, temporarily extend the time for unloading and loading of materials at select locations when it is deemed in the best interest of the public due to temporary conditions such as construction, street or public parking lot closures. Additionally, staff recommends that based on this ordinance change, Council approve a resolution extending the time limit for loading and unloading in the commercial zone in front of the Library to 60 minutes for the duration of construction on the Copeland project. CONCURRENCES Although Library staff recognizes the City's concerns about agreeing to all the conditions requested, their preference would be for the City to provide them with dedicated parking spaces. FISCAL IMPACT The cost for the signs, posts, and painted stall markings is approximately $300.00. The fines imposed for a violation of this section would remain consistent with our present fine schedule. ALTERNATIVES This issue is under the sole discretion of the Council although potential alternatives are limited by existing California Vehicle Code and City Municipal code provisions. 1. Do nothing. This option is available;however, it does not satisfy the Library's request for assistance during the Copeland construction period. 2. Create specialty street parking space locations specific for the Library use only. Staff does not recommend this alternative due to the difficulty in enforcement, potential conflicts with Vehicle Code provisions and the potential for precedence setting for other entities. Resolution CADocuments and Serdngs\sIouser\Desktop\CR_Ub Smlls.doc c�� a Attachment 1 ORDINANCE NO. —(2004 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING SECTION 10.44.030 OF MUNICIPAL CODE CHAPTER 10.40, STOPPING FOR LOADING OR UNLOADING ONLY AS ADOPTED BY THE CITY OF SAN LUIS OBISPO WHEREAS, the City Council conducted a public hearing on February 17, 2004, and has recommended approval of amendments to the commercial loading zone times; and WHEREAS, the City Council has considered testimony of interested parties; and the evaluation and recommendation of staff; and WHEREAS, the City Council finds that the proposed amendment is consistent with the City's goal for development of downtown and other areas. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Subsection C of Section 10.44.030 of Chapter 10.44 of the San Luis Obispo Municipal Code is hereby amended to read as follows: 10.44.030 Yellow loading zone—Time restrictions for loading and unloading. C. Permission herein granted to stop or stand a vehicle for the purpose of loading or unloading materials shall not extend beyond the time necessary therefor, and in no event for more than thirty minutes. Evidence that there was no activity involving the loading or unloading of materials into or from a vehicle during any continuous period of time of eight minutes or longer shall constitute prima facie evidence that the vehicle was parked longer than the time necessary for loading or unloading. The Council may, by resolution, temporarily extend the time for unloading and loading of materials at select locations when it is deemed in the best interest of the public due to temporary conditions such as construction, street or public parking lot closures. SECTION 2. If any provision of this Ordinance is for any reason held to be invalid by a court of competent jurisdiction, the City of San Luis Obispo hereby declares that it would have passed each and every remaining provision irrespective of such holding in order to accomplish the intent of this ordinance. SECTION 3. A summary of this ordinance, together with the names of Council members voting for and against, shall be published at least five (5) days prior to its final passage in the Tribune, a newspaper published and circulated in this City. This Ordinance shall go into effect at the expiration of thirty(30) days after its final passage. A..No person shall stop,stand or parka vehicle in any yellow loading zone for any purpose other than loading or unloading material for such time as is permitted in this section. B. The loading or unloading ofmaterials shall be allowed only for those deliveries made by commercially registered and licensed vehicles or professionally signed passenger vehicles displaying an authorized commercial loading zone permit that is used for commercial business deliveries; also, the delivery or pickup of express and parcel post packages and United States mail. All other passenger vehicles not meeting the sign and permit requirements may not use a loading zone for any.purpose except when the zone is not effective. C. (2004 SERIES) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO APPROVING SIXTY (60) MINUTE MAXIMUM USAGE TIME FOR THE COMMERCIAL LOADING ZONE LOCATED ON PALM STREET IN FRONT OF THE COUNTY LIBRABRY DURING CONSTRUCTION OF THE COPELAND PROJECT WHEREAS, the City Council has determined that construction of the Copeland Project has temporarily removed the ability for the County Library to unload and load Library vehicles off- street,.and WHEREAS, Section 10.44.030 of the City of San Luis Obispo Municipal Code allows that Council may, by resolution, temporarily extend the time for unloading and loading of materials at select locations when it i's deemed in the best interest of the public due to temporary conditions such as construction, street or public parking lot closures. NOW THEREFORE BE IT RESOLVED that the Council approves: 1. That the temporary commercial loading zone located on the south side of Palm Street adjacent to the County Library, may have unloading .and loading activities extended from thirty(30)minutes to sixty(60)minutes in duration as per ordinance. 2. This time extension for commercial loading purposes shall remain in effect until such time as the Copeland Project is completed and off-street Library vehicle loading spaces are re-established. 3. This resolution shall become effective immediately after Ordinance No. is effective.
