DISCUSSION The current PCC Bylaws, Article 4, Section G, state that a special meeting may be called at any time by the Chairperson or by a majority of the committee members currently serving on the PCC, provided each member is given written notice of the special meeting at least one week prior to the meeting with the time and place of .the special meeting announced (as required by California Law). This section of the PCC Bylaws is presently inconsistent with the Brown Act, (Government Code section 54956), which allows for shorter notice periods for special meetings. Consistency with The Brown Act's noticing requirements was discussed by the Promotional Coordinating Committee at their regular meeting on February 11, 2004. At this meeting (minutes are Attachment 1) members of the PCC proposed the following revisions to their Bylaws so that Article 4, Section G would read; A special meeting may be called at anytime by the Chairperson or a majority of the committee members currently serving on the PCC; provided that each member is given notice of the special meeting at least 24 hours prior to the meeting, and that the time and place of the special meeting is announced as required by California law. FISCAL IMPACT No fiscal impact. ALTERNATIVES If Council is not satisfied with the proposed revision they could direct the PCC to discuss this issue further, or direct the PCC not to change the bylaws. REVIEW OF BYLAWS Shelly Stanwyck, Economic Development Manager, reviewed the Bylaws for the PCC focusing on the noticing requirements for a Special Meeting, which seemed unduly long. After some discussion, the committee moved to revise the Bylaws to allow for a shorter notice period for special meetings. ACTION: Moved by Hunt Roberts/Justice to revise the PCC's Bylaws so that Article 4, Section G would read: A special meeting may be called at anytime by the Chairperson or a majority of the committee members currently serving on the PCC, provided each member is given notice of the special meeting at least 24 hours prior to the meeting, and that the time and place of the special meeting is announced as required by California law, Motion carried 6:0. (2004 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO AMENDING THE PROMOTIONAL COORDINATING COMMITTEE BYLAWS WHEREAS pursuant to the City of San Luis Obispo's Advisory Body Handbook, the Promotional Coordinating Committee reviewed its bylaws and the resolution creating the Committee. WHEREAS the Promotional Coordinating Committee wishes to bring its bylaws into conformance with the Brown Act and has forwarded recommendations to the City Council to revise them. NOW THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo that Article 4, Section G of the Promotional Coordinating Committee Bylaws is hereby amended to read as follows: A special meeting may be called at anytime by the Chairperson or majority of the committee members currently serving on the PCC, provided that each member is given notice of the special meeting, and that the time and place of the special meeting is announced as required by California law. The pertinent language mentioned in the Agenda report, enabling the PCC to provide 24 hours notice of a special meeting, was inadvertently left out of the Resolution.
