Adopt Resolution adjusting the annual salary of the City Administrative Officer. 2. Adopt Resolution adjusting the annual salary of the City Attorney. 3. Adopt Resolution electing to pay and report Employer Paid Member Contributions for appointed officials. DISCUSSION In accordance with the Management Compensation Plan and Pay for Performance System for Appointed Officials, Department Heads and Other Management Personnel, Resolution 9528 (2004 Series), the City Council is authorized to approve annual salary adjustments for Appointed Officials. The performance evaluations for the City Administrative Officer and the City Attorney were conducted on March 8, 2004, in closed session. Based upon their performance during the preceding year, determined through the Appointed Officials' Evaluation process, the Council preliminarily approved a 3% increase for the City Administrative Officer and City Attorney. Increases would be effective April 8, 2004 (the first full pay period in April 2004), resulting in new monthly salaries as follows: A. The City Administrative Officer's salary shall be $11,514 per month. B. The City Attorney's salary shall be $10,080 per month. The Council approved a change in the way that the employee's contribution to the retirement system is handled for appointed officials on March 1, 2004, as part of the Management Compensation resolution. The 8% mandatory employee contribution to the retirement system was removed from the salary ranges for the appointed officials (City Administrative Officer and City Attorney) and the City began making the 8% contribution directly, consistent with the way this benefit is reported for department heads and managers. The California Public Employees' Retirement System (PERS) has requested that the Council adopt a separate resolution to aid PERS in carrying out the City's request for this change in reporting of the Employer Paid Member Contributions (EPMC). It has the same effect as Resolution No. 9528 (2004 Series), adopted on March 1, 2004. C�-I Council Agenda Report— Approval of Appointed Officials' Compensation Adjustments Page 2 FISCAL IMPACT The impact on salaries of these adjustments is $1,887 for the remainder of 2003-04 fiscal year and $7,548 annually. Funding is available within existing resources in the 2003-04 budget as well as the 2004-05 budget. Since the salary ranges for the appointed officials were adjusted to reflect the change in reporting of EPMC, there is no fiscal impact in making that change. It should also be noted that the modification to the CAD's salary is the first in two years, since he voluntarily waived a 4.5% increase last year. ATTACHMENTS 1. (2004 SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO ADJUSTING COMPENSATION FOR THE CITY ADMINISTRATIVE OFFICER WHEREAS, by Resolution No. 9037 (2000 Series), the City Council appointed Ken Hampian as City Administrative Officer; and WHEREAS, by Resolution No. 9440 (2003 Series), the City Council established compensation for City Administrative Officer, Ken Hampian; and WHEREAS, the City Council conducted a performance evaluation on March 8, 2004, in accordance with the Appointed Officials' Performance Process as modified in August of 2002; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. Effective April 8, 2004, the City Administrative Officer's salary shall be $11,514 per month. This reflects a 3% pay for performance increase and the change in reporting of the employee's retirement contribution per resolution 9528. SECTION 2. All other compensation and benefits afforded the City Administrative Officer under Resolution No. 9528 (2004 Series) and the City Administrative Officer Employment Agreement (Resolution No. 9037, 2000 Series), not superseded by the above, shall remain in full force and effect. SECTION 3. The City Council shall evaluate the performance of the City Administrative Officer annually. Effective April 8, 2004, the City Attorney's salary shall be $10,080 per month. (2004 Series) A RESOLUTION OF THE CITY COUNCIL OF SAN LUIS OBISPO ELECTING TO PAY AND REPORT THE VALUE OF EMPLOYER PAID MEMBER CONTRIBUTIONS FOR APPOINTED OFFICIALS WHEREAS, the City Council of the City of San Luis Obispo has the authority to implement Government Code Section 20636(c) (4)pursuant to Section 20691; and WHEREAS, the City Council of the City of San Luis Obispo has a written labor policy or agreement which specifically provides for the normal member contributions to be paid by the employer, and reported as additional compensation; and WHEREAS, one of the steps in the procedures to implement Section 20691 is the adoption by the City Council of the City of San Luis Obispo of a Resolution to commence paying and reporting the value of said Employer Paid Member Contributions (EPMC); and WHEREAS, the City Council of the City of San Luis Obispo has identified the following conditions for the purpose of its election to pay EPMC: • This benefit shall apply to all appointed officials. • This benefits shall consist of paying 8% of the normal contributions as EPMC, and reporting the same percent(value) of compensation earnable {excluding Government Code Section 20636 (c) (4)) as additional compensation. • The effective date of this resolution shall be March 11, 2004. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Luis Obispo elects to pay and report the value of EPMC as set forth above and in Resolution No. 9528 (2004 Series). Since I will not be able to attend in person, I thought I might take this opportunity to express the position on the job performance of both Ken and Jonathan-at the request and on behalf of the San Luis Obispo Firefighters Association Local 3523. Although Jonathan has only been here a short time, we have had the pleasure of working with him in both a labor negotiations setting, and on various other projects-including the current ballot measure that vire are all working on. We have found Jonathan not only to be extremely knowledgeable and experienced in matters relating to public safety labor issues, but also a very approachable and helpful member of the City's management team. Our members think he was an excellent choice for the position, and we look forward to working with him in the future. Nobody knows more than you the difficult times we have had to endure as a City this last year. We all get the reports of Local Governments enduring tremendous hardships and cutting essential services throughout the State. It is our opinion that with your direction, Ken's performance has been excellent in keeping this City afloat and functioning at the level of service we have all worked so hard to achieve. I have had regular contact with Ken on numerous subjects relating to the Fire Department and City Finance as a whole, and I can say his dedication to this City and its Citizens is unquestionable (as demonstrated by the correspondence I have received from him after Midnight on several occasions). Ken.has been pivotal in building the trust and respect between Labor and Management in both the Fire Department and Police Department, and is his policies are a clear example of, "Good Government." As the Cities of California continue to implode around us, there is no one we trust more at the helm than Ken Hampian.
