SUBJECT: AWARD OF CONTRACT FOR COON CREEK FISH PASSAGE
RESTORATION AND BRIDGE PROJECT, SPECIFICATION NO.90467
CAO RECOMMENDATION:
1) Award the contract for the Coon Creek Fish Passage Restoration and Bridge Project to R.
Burke Corporation in the amount of$891,370.00; and
2) Authorize the use of up to $89,100 for construction contingencies; and
3) Authorize the use of up to $100,000 for construction related services (construction
management,biological monitoring, soils testing, communications); and
4) Authorize the Mayor to execute the agreement..
DISCUSSION:
On February 3, 2004, Council approved the bid package for the construction of the Coon Creek
Fish Passage Restoration and Bridge Project, Specification No. 90467. On April 15, 2004, City
staff conducted a mandatory pre-bid site visit, which was attended by nine potential bidders. Six
bids were received for the project, ranging from $796,455 and $1;573,948. The Engineer's
estimate for this work was $760,367.00.
The low bid was received from Alex Madonna Construction. However, since the death of Mr.
Alex Madonna, that bid is no longer valid as the contractor's license was in his name only.
Therefore, the City approved the withdrawal of Madonna's bid. The next lowest bid was from
MGE Underground, Inc. in the amount of$864,453.00. MGE Underground failed to submit any
successful representative projects (e.g., bridge and/or stream restoration) as reference in the bid
package. Therefore, MGE Underground's bid was rejected as unresponsive. R. Burke
Corporation was the third lowest bid in the amount of $891,370.00. Burke has completed
numerous successful representative projects with the City in the past. Therefore, we recommend
award for this project to Burke.
The Coon Creek project is located on PG&E property, near the border with Montana de Oro
State Park. This project is part of the mitigation measures as specified in the Water Reuse
Project's Final Environmental Impact Report dated March 1997 and the National Marine
Fisheries Service's Biological Opinion. This project will allow resumption of historic steelhead
passage to a very high quality stream in a relatively protected location that has been shown
through study to be equivalent in quality to the entire portion of the San Luis Obispo Creek being
potentially affected by the Water Reuse Project. Stream restoration and creation of the proper
rock weir pools (i.e., fish passage) will be critical to the success of the project, therefore prior
representative construction experience is important. Completion of the Coon Creek Project is a
requirement of the Water Reuse Project. q

The scope of work for the Coon Creek project includes: (1) construction of a 75-foot long cast-
in-place pre-stressed box girder bridge; (2) removal of existing culverts and earth/debris fill at
the existing Pecho Valley Road crossing over Coon Creek; (3) re-grading of approximately 600
feet of creek channel; (4) construction of rip-rap erosion protection along portions of the
regarded channel bank; (5) construction of rock weir gradient control; (6) installation of soil and
willow cuttings in the rip-rap erosion protection; (7) installation of erosion control seeding on the
newly graded channel bottom; and (8) stabilization of other disturbed surfaces created by access,
staging and other work, by installation of erosion control blankets and seeding. All access to the
work site must be coordinated through the PG&E Diablo Canyon Power Plant.
FISCAL IMPACT:
The total estimated cost for this project is $1,080,470 as summarized below, along with the sources
of recommended funding:

Funding was identified and approved for this project in the environmental phase of the Water Reuse
project. The additional $108,670 is recommended to be transferred from the Salinas Reservoir
Expansion Project budget, a project with more than$900,000 to be returned to Water Fund working
capital as it will not be going forward due to Council's direction to move forward on the alternative
supply from the Nacimiento Pipeline Project.
ALTERNATIVES:
Defer or delay the project. This alternative is not recommended, since its completion is a
requirement of the Water Reuse Project.

AGREEMENT
THIS AGREEMENT is made on this day of May, 2004, by and between the CITY OF SAN
LUIS OBISPO, a municipal corporation and charter city, San Luis Obispo County, California (hereinafter
called the City); and R. Burke Corporation., (hereinafter called the Contractor).
WITNESSETH:
WHEREAS, on March 22, 2004, City requested proposals for the performance of construction
services per Specification No. 90467;and
WHEREAS,pursuant to said request, Contractor submitted a proposal which was accepted by City
for said services.
NOW THEREFORE, in consideration of their mutual promises, obligations, and covenants
hereinafter contained,the parties hereto agree as follows:
1. TERM. The term of this Agreement shall be from the date this Agreement is made and
entered, as first written above, until acceptance or completion of said services. This Agreement may be
terminated by either party by providing to the other party, in writing, thirty (30) days advance notice of said
intent. Contractor shall be paid, in accordance with Paragraph 4 herein, only for work completed by the
Contractor prior to the effective date of said termination. In this event, all information, documents, maps,
and materials shall be given to the City.
2. INCORPORATION BY REFERENCE. City Specification No. 90467, Addendum 1
dated April 16, 2004, and Contractors proposal dated April 21„2004 are hereby incorporated in and made a
part of this Agreement.
3. CITY'S OBLIGATIONS. For providing the services as specified in this Agreement,City
will pay and Contractor shall receive,therefore,compensation in a total sum not to exceed$891,370.00.
4. CONTRACTOR'S OBLIGATIONS. For and in consideration of the payments and
agreements hereinbefore mentioned to be made and performed by City, Contractor agrees with City to do
everything required by this Agreement and the said specifications.
5. AMENDMENTS. Any amendment, modification, or variation from the terms of this
Agreement shall be in writing and shall be effective only upon approval by the Council of the City.
6. COMPLETE AGREEMENT. This written Agreement, including all writings
specifically incorporated herein by reference, shall constitute the complete agreement between the parties
hereto. No oral agreement, understanding, or representation not reduced to writing and specifically
incorporated herein shall be of any force or effect, nor shall any such oral agreement, understanding, or
representation be binding upon the parties hereto.
7. NOTICE. All written notices to the parties hereto shall be sent by United States mail,
postage prepaid by registered or certified mail addressed as follows:

NOTICE TO ALL CONTRACTORS SUBMITTING BIDS AND TO ALL PLANHOLDERS:
You are hereby notified of the following changes, clarifications or modifications to the contract
documents. This addendum shall supersede the original contract .documents and
subsequent addenda. Wherein this addendum contradicts the original contract documents
and previous addenda, this addendum shall take precedence. All other conditions shall
remain unchanged. The change specified below shall become a legal part of the original
contract documents.
A. CHANGES AND/OR CLARIFICATIONS TO THE PLANS/SPECIFICATIONS:
1. County Construction Permit. A County of San Luis Obispo Construction Permit
obtained from the Department of Planning and Building has been issued for this
project. All work shall be subject to and in accordance with the requirements and
conditions of the construction. A copy of the permit is attached. All plan check
comments from the County are available for review at the Public Works Office, 955
Morro Street, San Luis Obispo.
2. Telephone Conduit. On the plans, sheet 3 of 10, note #1 shows an existing utility
box. This box has been 'identified as a SBC telephone utility box. The phone line that
runs to and from this box is buried parallel to the existing road. This service line shall
be maintained at all times during construction except for a scheduled tie over after a
replacement conduit is in place. The contractor shall be responsible to coordinate the
tie over with the utility company. Any cost associated with installing new telephone
cable and making termination connections will be paid to SBC by the City of San Luis
Obispo. The contractor shall be responsible for exposing the existing phone line at
Sta. 2+43.43 and at the utility box, providing and installing a new 4" conduit between
these new points of connection. Penetrations in the bridge shall be in accordance with
State Standard Plan B7-10. Conduit shall be installed through the box girder.
3. Dewatering/Diversion Plan. The contractor shall submit a channel bypass and site
dewatering plan to the City for review and compliance with project and permit
requirements. If the contractor plans on returning de-silted water back to the live
stream, the contractor shall notify the City a minimum of 2 weeks in advance so that
the City may obtain a General NPDES Permit For Discharge Of Low Threat To Water
Quality Order # 01-119.

4. Staging Area. The contractor's staging area shall be in the location south of the
project site and as described and viewed at the pre-bid walk. The area allowed for the
contractors use shall not exceed 2 acres.
5. PGE requirements.
a. All excess debris, soil, pavement and construction material must be removed from
the project site.
b. All employees on site must keep a legal photo I.D. on them at all times.
c. No one will be allowed to smoke on site(PG&E) property.
d. The access gate to the site must remain closed and locked at all times. The gate
can be opened for temporary passage but must be closed and locked after a
vehicle or equipment passes through.
e. The contractor must submit the name and social security number of each
employee or person entering the site 2 working days in advance of performing work
on or delivering materials to the site (PG&E) property. An active list of persons on
site shall be updated every 30 days.
f.. The existing road shall not be blocked and shall be open to traffic at all times
without any delays to passage.
6. Payment. Payment for all additional requirements in this addendum shall be
considered as included in all items of work and no additional compensation will be
allowed.
Contractors are required to base their bid on the plans, specifications and any issued
addenda. To do otherwise shall be at the Contractor's own risk.
Contractors shall note the acknowledgment of this addendum in the appropriate space_
provided on sheet "g" of the Contract Proposal/Proposal Form Signature Sheet.

IMPORTANT DISGLOSURE NOTICE OF TERRORISM INSURANCE
GOVERAGE
On November- 26, 2002, President Bush signed into law the
Terrorism Risk Insurance Ad of 2002 (the "Act`'). The Act
establishes a short-term program under which the Federal
Government will share in the payment of covered lasses caused by
certain acts of international terrorism. We are providing you with
this notice to inform you of the key features of the Act, and to let
you know what effect, if any, the Act will have on your premium_
Under the Ad, insurers are required to provide coverage for certain
losses caused by international ads of terrorism as defined in the
Ac L The Act further provides that the Federal Government will pay
a share of such losses. Specifically, the Federal Government will
pay 90% of the amount of covered losses caused by certain ads of
terrorism which is in excess of Travelers' statutorily established
deductible for that year. The Act also caps the amount of terrorism-
related losses for which the Federal Government or an insurer can
be responsible at $100,000,000,000.00, provided that the insurer
has met its deductible:
Please note that passage of the Act does not result In any change
in coverage under the attached policy or bond (or the policy.or bond
being quoted. Please also note that no separate additional
premium charge has been made for the terrorism coverage
required by the Act The premium charge that is allocable to such
overage is inseparable from and imbedded in your overall
premium, and Is no more than one percent of your premium.
