SUBJECT: MITCHELL PARK BANDSTAND DONATION
CAO RECOMMENDATION
As recommended by the Parks and Recreation Commission accept the Rotary Club of San Luis
Obispo's offer to construct and donate a bandstand in Mitchell Park and authorize the Mayor to
enter into, on behalf of the City, a donor agreement with the Rotary Club.
DISCUSSION
The Rotary Club of San Luis Obispo has offered to construct and donate a bandstand in Mitchell
Park as part of Rotary's Centennial Celebration (Attachment 1). As can be seen in Attachment 2,
the bandstand will be located in a slightly different location than what was approved in the
Master Plan and will be placed more in the center of the park. The relocation makes sense
because, with the donation, the Plan now will be completed in phases rather than all at once.
This first phase of the project becomes the construction of the bandstand, which requires the
removal of the flagpole from the center of the park, as well as the landscaping that surrounds it.
To avoid the added cost of reinstalling irrigation and landscaping where the flagpole once stood,
the bandstand will simply be located over the spot where the flagpole originally existed. The
donor will relocate a new flagpole in the northwest corner of the park, consistent with the Master
Plan. City donation policy requires that donors complete the development review process and
obtain a building permit.
The Rotary Club would like to recognize individual donors who give financially to the project by
placing tiles in the walkway. The tiles are similar to those that have been placed in the park in
the memorial comer. The Club will manage the donations and parks maintenance staff will
coordinate tile placement.
The design of the bandstand is keeping with the theme of the park and consistent with the Master
Plan (Attachment 3). A representative of the Rotary Club will attend the Council meeting to
answer any questions about the project.
This facility is likely to be heavily used, as there are a number of community events that occur in
the park. A quieter, less amplified version of Concerts in the Plaza is a possibility.
CONCURRENCE
This item was reviewed and unanimously approved by the Parks and Recreation Commission at
the May 5, 2004 meeting. A copy of the draft minutes is included as Attachment 5.

FISCAL IMPACT
All development review fees are waived for donation projects. Once completed, the City will
maintain and schedule the bandstand for events. The work required by Parks Maintenance staff
in support of this project is minimal. All that is necessary is to cap off the irrigation system in
the center flag pole area where the bandstand is being located.

The San Luis Obispo Monday Rotary Club has a rich history of building projects to benefit the
citizens and City of San Luis Obispo. Within the past seven years the Rotary Club has built the
Pavilion,in Laguna Lake Paris,subsequently the BB0/picnic area near the Pavilion,the bridge.at
Cuesta Park and Eto Park
Now, in partnership with the DayBreak(Tuesday) Rotary Club,we are offering to build a
bandstand at Mitchell Park We believe this would provide community benefit and be an exciting
and attractive addition to the park-

arkThe two Rotary Clubs have established a Taskforce whose members are(DayBreak)Tom
Tolledge, Doug Shaw,.and Bill Almas and (SLO)Bob Wacker,Jim Hoffman and Jim Brabeck.
The project is currently being designed by Tom Brokavich AIA(Tuesday Club). We expect to
start construction in late summer 2004 and complete in Summer 2005. We will need to move and
replace the flagpole as part of the project.
In.this project we request the following help from the City:
• The cooperation of the Parks and Recreation Director and the Comission to help us
expeditiously commence the process and'take it through the City's review process
.• Since this is a gift to the Community, it would be appreciated if all permit fees could be
waived.
Reconfigure the existing landscaping and irrigation systems
• Allow access to and use of electricity and water necessary forthe construction activity.
We are proud of Rotary's past contributions to the City of San Luis Obispo and trust that the offer
is seen in the same spirit ofvolunteer efforts for community.improvement.

DONOR AGREEMENT

THIS AGREEMENT is made and entered into in the City of San Luis Obispo on this 151 day of June,2004,
by and between the CITY OF SAN LUIS OBISPO, a municipal corporation, hereinafter referred to as "City", and
THE SAN LUIS OBISPO ROTARY CLUB,hereinafter referred to as"Donor".
WITNESSETH:
WHEREAS,The Donor desires to donate a bandstand for Mitchell Park;and
WHEREAS, acceptance of the donation is consistent with City Policy as set forth in Resolution No. 8965
(1999 Series).
NOW THEREFORE, in consideration of their mutual promises, obligations and covenants hereinafter
contained,the parties hereto agree as follows:
L TERM. The term of this Agreement.shall be from the date this Agreement is made and entered,as
first written above,until acceptance or completion of the Donation.
2. DONOR'S OBLIGATIONS: Donor shall perform as follows:
• Design the facility improvements.
• Successfully complete the City's development review process, including review by
appropriate advisory bodies.
• Construct the bandstand and relocate the flagpole to the north-west comer of the park.
3. CITY OBLIGATIONS: City shall perform as follows:
• Assist Donor with the review process.
• Waive all permit fees.
• Adjust park irrigation systems as needed.
• Maintain and schedule the bandstand once the Donation is accepted.
4. RECOGNITION: The Donor shall be recognized in the following manner:
a. The bandstand shall be named the "Rotary Bandstand" An approved sign designating this
name may be placed on the bandstand, by the Donor: A bronze.plaque, not to exceed 18"
square commemorating the Donation may also be placed on the bandstand by the Donor.
b. When the renovation is completed, City shall hold a grand opening at which Donor shall
receive appropriate recognition.

5. COMPLETE AGREEMENT. This written Agreement, including all writings specifically
incorporated herein by reference, shall constitute the complete agreement between the parties hereto. No oral
agreement, understanding, or representation not reduced to writing and specifically incorporated herein shall be of
any force or effect, nor shall any such oral agreement, understanding, or representation be binding upon the parties
hereto.
6. AMENDMENTS. Any amendment, modification, or variation from the terms of this Agreement
shall be in writing and shall be effective only upon approval by the City Administrative Officer of the City.
7. NOTICE. All written notices to,the parties hereto shall be sent by United States mail, postage
prepaid by registered or certified mail addressed as follows:

9. AUTHORITY TO EXECUTE AGREEMENT. Both City and Donor do covenant that each

LeSage presented the staff report regarding the Rotary Club's offer to construct and donate a
bandstand in Mitchell Park. LeSage introduced Jim and Gail Hoffman, donor's of the bandstand who
described the bandstand construction.
Commission discussed the item.
Recommendation:
Recommend that the City Council accept the Rotary Club of San Luis Obispo's offer to construct and
donate a bandstand in Mitchell Park.

LeSage presented the staff report for the change in fees for the 2004/2005 fiscal year.
Commission discussed the item.
Recommended Action:
Endorse the change in fees for Laguna Lake Golf Course effective July 1, 2004,increasing all rates by
25 cents per round and$1.00 a round for Twilight Rates.
(KnighYLemieux, unanimous).
4. Laguna Lake Golf Course MOU for a Telecommunications Lease
LeSage introduced Cindy McDonald, who presented the staff report regarding a telecommunications
facility to be located in Laguna Lake Golf Course.
