Appoint Jose Lemus to an unexpired term as the Member at Large on the MTC to begin July 13, 2004 and end on March 31, 2007. 2. Appoint Dustin Dravland Robinson to an unexpired term as the Student Representative on the MTC to begin July 13, 2004 and end on March 31, 2005. DISCUSSION There are two vacancies on the Mass Transportation Committee. One vacancy exists for a Student Representative due to the resignation of Andrew Rubin. The second vacancy, due to the resignation of Jim Weir, is for a Member at Large. After advertising, the Council Subcommittee interviewed six applicants and is pleased to recommend the appointment of Jose Lemus as the Member at Large and Dustin Dravland Robinson as the Student Representative. Consulting Engineer RECEIVED JUL 0 6 2004 July 6, 2004 SLO CITY CLERK Honorable Mayor and City Council 990 Palm Street San Luis Obispo, Ca 93401 RE_ Additional Comments on Drainage Section of"Final EIR"for Dalidio Property Honorable Mayor and City Council; Jan Manx has asked to me expand on my recent comments about the drainage issues in the referenced EIR; specifically, the severity of DW-1 and the proposed mitigation. The"Final EIR" now says that DW-1 is a Class 11 (significant but mitigable) impact as opposed to the original designation as a Class I (significant and unavoidable) impact. The proposed mitigation is to"use pervious paving material to facilitate rainwater percolation." This proposed mitigation directly contradicts the words of the revising letter itself. Page 3 of the March 17 letter, when discussing the impact of the development on the 100-year peak flow rate says "...and secondarily, because the soils in the watershed are clayey...They have high runoff rates when fully saturated.... " The author is saying in this paragraph that the soil has such a high runoff value (i.e. doesn't allow water to infiltrate)that adding pavement doesn't matter. Yet, he suggests that using pervious pavement that allows the water to pass through the pavement to the soil (that.won't accept any water for infiltration) is an acceptable mitigation and makes the impact "insignificant" The author wants it both ways! On one hand the soil doesn't increase flood levels because it won't accept water for infiltration, on the other hand he proposes a mitigation measure that relies on the soil to infiltrate water. The revision to the EIR and the "supporting" document do not support reducing the impact of DW-1 to a Class Il impact. Now,when we go there for our Target shopping,we spend considerable other money in other businesses,which we could have spent in SLO. We are also very hopeful of having a Whole Foods store come to the Marketplace. For us,the Marketplace would NOT conflict with downtown. We go downtown for the ambiance,the art,the boutiques,the Farmers Market and the great selection of restaurants. However,in addition to these attractions downtown,having modern large stores in easy driving distance would certainly enhance SLO living not just for us but for everyone.
