HomeMy WebLinkAbout05/04/1993, 4 - FILING OF AN APPLICATION WITH THE DEPARTMENT OF TRANSPORTATION FOR A SECTION 9 GRANT UNDER THE URBA city of san pais oBispo = May 4, 19 3 A �"�M� COUNCIL AGENDA REPORT FROM: Michael McCluskey, Public Works Direct PREPARED BY: Harry Watson, Transit Manager SUBJECT: Filing of an application with the Department of Transportation for a Section 9 grant under the Urban Mass Transportation Act of 1964 CAO RECOAEMENDATION: Adopt a resolution authorizing staff to apply for a Federal Transit Administration (FTA) Section 9 grant in the amount of$1,376,986 towards capital and operating support of SLO Transit. BACKGROUND: The 1990 census classified the City of San Luis Obispo an urbanized area making it eligible for Federal grants for mass transportation systems under Section 9 of the Urban Mass Transportation Act of 1964. The grant application includes funding which was apportioned to San Luis Obispo in FY 1991-1992 and FY 1992-1993 of$502,650 and$430,189 respectively. Funding levels are set by Congress annually, thus the City's apportionment will fluctuate in future years with those funding levels. Future apportionments are announced in the Federal Register. These funds remain available to be obligated for three fiscal years following the fiscal year apportioned. At the end of the three years, any unobligated funds revert to the Federal Transit Administration (FTA) for reapportionment. State Rideshare funds of$468,000 are included in the grant application. Of that amount, $216,000 is slated for Regional Transit with the City acting as applicant. These State funds have been directed to the Federal Transit Administration through the City's Section 9 grant. - This decision was made by the Division of Mass Transportation, Federal Assistance Branch of Caltrans. Concluding the grant. application is $121,039 in economic stimulus funds. Once the funding is received, the City will be able to implement the following transit program enhancements: 1. longer operating hours 2. additional buses for services 3. bus cleaning facilities 4. better accessibility to buses by the disabled The contract for Federal financial assistance does impose certain obligations upon the applicant, including the certification of compliance with numerous Federal programs in such areas as civil rights and minority business. The City must also provide a local share of project costs in the program (50% of funds to ���u�� ��►p �►` � city of san p i s owpo COUNCIL AGENDA REPORT UMTA Page Two cover operating costs and 20% of capital costs). FTA will fund 90% of the cost of capital projects which improve bicycle access to mass transit, meet the requirements of the Clean Air Act, or the Americans with Disabilities Act. The City proposes to use State Transportation Development Act (TDA) funds and fare revenues to cover the local match requirement. Projected TDA and farebox revenues for 1992-1993 are $743,600, which exceed the required local match. Significant reporting requirements, as contained in the Urban Mass Transportation Act, are tied to the Section 9 funds. The weekly; monthly, quarterly, and annual reporting requirements will require significant additional staff time. Failure to adhere to the reporting requirements can result in no further Federal funding at a minimum and the potential demand to return the grant funds at the maximum. The FTA application process requires a resolution of the governing body of the applicant authorizing the Ming of the application. Suggested wording is contained in UMTA Circular 9030.1A, page V-14. The resolution authorizes the City Administrative Officer, or his designee, to act on the City's behalf in matters relating to the FTA grant process. FISCAL EMPACT: The total funds available through Section 9 are $1,521,878. The grant application totals $1,376,986. The balance of $144,892 (which remains designated for the City) will be carried over to next year's apportionment. The amount of required City matching funds is $529,986 and includes varying matching requirements of 50% for operating; 20% for capital; and 10% for Americans with Disabilities Act enhancement. projects. Sufficient funds will exist in the form of Transportation Development Act allocations for FY 1993-94 to provide the match requirement. The City's FY 1993-94 budget will program the capital projects and the operating budget, dependent upon grant approval. (See attached Program of Projects and Budget). These projects are also contained in the Council of Governments proposed Federal Transportation Improvement Program (FTIP), as required by the Section 9 application process'. The "stimulus" funding is part of the currently proposed Federal economic stimulus package. Recent Congressional action defeated portions of the "stimulus" package. The status of remaining portions, including transit, remains in doubt with strategies now in development to implement the program on an incremental basis. It is proposed to leave the "stimulus" funding in the grant application on the chance that something may get approved and the City thus receive at least partial funding. Should the funding not be forthcoming, the application can and will be amended to use the non-claimed amount toward the bus wash facility and other non-funded capital projects. 4-a 1gjQ I jjjP1111f j city Of San L.JS OBISPO COUNCIL AGENDA REPORT UWA Page Three FINAL APPLICATION: The actual grant application, with all of its certifications, Disadvantaged Business Enterprise (DBE)Plan, and submissions, is nearly 100 pages in length and will be available for review in the City Clerk's office. The capital components in the grant include expansion buses for both SLO Transit and Regional Transit, replacement of seven obsolete wheelchair lifts, an external bus wash/water recycle facility, an additional maintenance bay, bus stop improvements, a Federal match to the City's bus rehabilitation program and operating assistance. ttachments: Draft resolution Program of Projects & Budget UMAW1 vj ' � 1 RESOLUTION NO. (1993 Series) A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO AUTHORIZING THE FILING OF APPLICATION WITH THE DEPARTMENT OF TRANSPORTATION, UNITED STATES OF AMERICA, FOR A GRANT UNDER THE URBAN MASS TRANSPORTATION ACT OF 1964, AS AMENDED, AND AUTHORIZING THE CITY ADMINISTRATIVE OFFICER, OR HIS DESIGNEE, TO EXECUTE AND FILE. APPLICATIONS ON BEHALF OF THE CITY WHEREAS, the Secretary of Transportation is authorized to make grants for amass transportation program of projects and budget; WHEREAS, the contract for financial assistance will impose certain obligations upon the applicant, including the provision by it of the local share of the project costs in the program and substantial reporting requirements; WHEREAS, it is required by the U.S. Department of Transportation, in accord with the provisions of Title VI of the Civil Rights Act of 1964, that in connection with the filing of an application for assistance under the Urban Mass Transportation Act of 1964, as amended, the applicant give an assurance that it will comply with Title VI of he Civil Rights Act of 1964 and the U..S. Department of Transportation requirements thereunder; and WHEREAS, it is the goal of the applicant that minority business enterprise be utilized to the fullest extent possible in connection with these projects,, and that definite procedures shall p 7 be established and administered to ensure that minority business shall have the maximum construction contracts, supplies, equipment contracts, or consultant and other services; NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of San Luis Obispo: SECTION 1.. That the City Administrative Officer, or his designee, is authorized to execute and file applications on behalf of the City of San Luis Obispo with the U.S. Department of Transportation to aid in the financing of planning, capital, and operating assistance projects pursuant to Section 9 of the Urban Mass Transportation Act of 1964, as amended. SECTION 2. That the City Administrative Officer, or his .designee, is authorized to execute and file with such applications an assurance or any other document required by the U.S. Department of Transportation effectuating the purpose of Title VI of the Civil Rights Act of 1964. SECTION 3. That the City Administrative Officer, or his designee, is authorized to furnish such_.additional information as the U.S. Department of Transportationmay require in connection with the application for the program of projects and budget.
