SUBJECT: Installation of two transit passenger shelters on Johnson
Avenue.
CAO RECOMMENDATION:
By motion, authorize the Mayor to sign a Use Permit with the
County of San Luis Obispo for the placement of two transit
passenger shelters on Johnson Avenue.
BACKGROUND:
The Council adopted Short Range Transit. Plan contains a bus stop
improvement component.
Staff has received numerous requests for shelters at existing bus stops
on Johnson Avenue near Bishop Drive, from frail and sick transit
passengers requiring protection from the elements. The locations are
across Johnson Avenue from each other, and on County property, one in
front of General Hospital and the other by Mental Health. The shelters
are located behind the public right-of-way and thus require permission of
the adjoining property owner. Because, in this case, the property owner
is the County, a County Use Permit is required.
Fund`s are budgeted to implement that plan. Transit passenger shelters at
both General Hospital and at Mental Health on Johnson Avenue are needed.
There will be no cost for this permit.
Transit staff has made an application for the Use Permits from County
General Services for the installation of these shelters. General
Services requires City Council approval and the Mayor's signature on the
Use Permit, prior to approval by the County.
FISCAL IMPACT:
This activity is contained in the current fiscal year budget (fund #530-
9001-552-550) and sufficient funding has been provided to complete the
project from Transportation Development Act funds. The cost of each
shelter installed is approximately $5,000.
CONCURRENCE:
Community Development Department "minor and incidental project" sign off
is attached.

Dear Harry:
I have reviewed your plans for two bus shelters at 2180 and 2191 Johnson Avenue and have
determined that they are minor. Consequently, it will not require review by the Architectural
Review Commission. Your project is approved as submitted.
My action is final unless appealed within 10 days of the date of this letter. Anyone may appeal
the action by submitting a letter to the Community Development Department within the time
specified. Appeals will be scheduled for the first available Architectural Review Commission
meeting date. If an appeal is filed, you will be notified by mail of the date and time of the
hearing.
Keep in mind that you still need to secure necessary building permits prior to construction.

USE PERMIT'
FOR PASSENGER WAITING SHELTERS -
This Use Permit is entered into by and between the County of
San Luis Obispo, hereinafter referred to as "County", and the City
of San Luis Obispo, hereinafter referred to as "City".
County and City hereby mutually covenant and. agree as follows:
1. Premises: County hereby authorizes City to use those
certain areas, hereinafter referred to as "premises", as generally
shown on Exhibit "A", attached hereto and incorporated herein by
reference, described as no more than one hundred eight square feet .
of land approximately 6 feet wide x 18 feet in length on a portion
of the real property owned by County and commonly known as the San
Luis Obispo General Hospital and Mental Health Department located
at 2180 and 2191 Johnson Avenue respectively, San Luis Obispo,
California.
2. use: City is hereby authorized and granted the exclusive
and conditional use of the premises for the purpose of constructing
and maintaining one passenger waiting shelter at each location
specified above in accordance with the general design and
specifications set forth in Exhibit 'B", attached hereto. City may
not use the premises for any other purpose. County reserves the
right to require that City, at City's sole cost and expense,
completely restore the premises to original condition upon
termination of this Use Permit.
3. Term: The term of the this Use Permit shall commence
April 15, 1993, and shall continue in full force and effect until
either party provides at least sixty (60) days written notice of
their intent to terminate this Use Permit.
4. Providing of Services: City is hereby required to submit
plans and specifications relative to use of the premises for prior
written approval by the County Director of General Services in each
instance. County reserves the right to approve or disapprove any
use of the premises for any reason including, but not limited to,

the , design, manner, method, character or presentation of the
proposed use. City, at City's sole cost and expense, expressly
agrees at all times during the term of this Use Permit to maintain
and operate the premises and the passenger waiting shelters in a
clean, safe, wholesome and sanitary condition.
S. Assignment: Assignment or transfer by City of this Use
Permit or any of the privileges given hereunder isnot permitted.
6. County Reservation: County reserves the right to do any
and all work of any nature necessary .for preservation, maintenance,
operation and improvement of the San Luis Obispo General Hospital
or Mental Health Department Buildings or property and adjacent
areas under County control. City shall be given reasonable notice
when such work may become necessary within the premises and City
will adjust its operations in such a manner that County may proceed
expeditiously.
7. Compliance: City agrees and promises to comply with and
observe any and all statutes, ordinances, rules and regulations of
the Federal, State, County or other public authority, ane as
amended. County reserves the right at any time to make such
reasonable rules and regulations as in its judgment may from time
to time be necessary for the safety, care, and cleanliness, of the
premises, and for the preservation of good order therein, and City
hereby agrees to strictly comply therewith.
a, Indemnity: City shall defend, indemnify and save
harmless the County of San Luis Obispo, its officers, agents .and
employees from any and all claims, demands, damages, . costs,
expenses, or liability occasioned by the performance of the
provisions hereof, or in any way arising out of this Use Permit,
including, but not limited to, inverse condemnation, equitable
relief, or any wrongful act or any negligent act or omission to act
on the part of the City, or of agents, employees, or independent
contractors directly responsible to the City; providing further
that the foregoing shall apply to any , wrongful acts, or any
actively or passively negligent acts or omissions to act, committed
jointly or concurrently by the City, the City's agents, employees,

or independent contractors and the County, its agents, employees,

or independent contractors.
9. Damages: City hereby waives any and. all claims for
damages that may be caused by County in re-entering and taking
possession of the premises as herein provided, and all claims for
damages that may result from the destruction of or injury to the
premises thereby, and 'all claims for damages to or loss of such
property belonging to the City as may be in or upon the premises at
the time of such re-entering. City hereby also waives any and all
claims against the County for loss or damages to any property of
City from any cause arising at any time.
10. Insurance:
a) City shall obtain and maintain in full force and
effect at all times during the term hereof, personal and bodily
injury insurance, including death resulting therefrom, and property
damage insurance with an insurance carrier satisfactory to County.
This comprehensive general liability insurance shall include, but
shall not be limited to, protection against claims arising from
bodily and personal injury, including death resulting therefrom and
damage to property, resulting from any accident occurring on or
about the road, driveways, or other public places used by City in
the operation hereunder, caused 'or arising out of any act or
failure to act of City, or resulting from any act or failure to act
of City pursuant to this Use Permit.
The above mentioned comprehensive general liability insurance
shall provide single limit coverage applying to bodily and personal
injury liability, including death resulting therefrom, property
damage or a combination of these in an amount of not less than
$500, 000.
The following provisions shall apply on all of the above
mentioned policies:
(1) If the insurance policy covers on an "accident"
basis, it must be changed to "occurrence".
(2) The Liability policy must cover personal injury
as well as bodily injury.

(3) The Liability policy shall include a
cross-liability or severability of interest endorsement.
(4) Broad form property damage liability must be
afforded.
(5) County of San Luis Obispo, its officers, agents
and employees,. shall be named additional insureds under any policy,
and the policy shall stipulate that this insurance will operate as
primary insurance and that no other insurance effected by the
County or other named insured will be called upon to contribute to
a loss covered thereunder.
b) The following requirements apply to all insurance to
be provided by City:
(1) A Certificate of Insurance shall be furnished
to County upon. execution of this Use Permit by City.
(2) Certificates and policies shall state that the
policy shall not be cancelled or reduced in coverage without thirty
(30) days written notice to the County of San Luis Obispo. -
(3) Any failure to.maintain required insurance will
be sufficient cause for termination of this Use Permit.
(4) Insurance required shall be placed in a company
or companies authorized to do business in the State of California
and accessible to the County and have policyholder surplus of at
least ten (10) times the amount or limit of liability afforded by
the insurance company.
(5) Approval of the insurance by County shall not
relieve or decrease the extent to which the City may be held
responsible for payment of damages resulting from its operations.
11. Notices: All notices shall be in writing, either
personally served or delivered by U.S. Mail Postage prepaid and
addressed to County at 'Department of General Services, County
Government Center, San Luis Obispo, CA 93408 ATTN: Property
Manager or City at 990 Palm Street, San Luis Obispo, CA 93401,
Attn: City Administrator.

12. Status: City shall during the entire term of the Use
Permit, be construed to be a grantee of a use permit, and •shall in
no event be construed to be an employee, agent or representative of
County.
IN WITNESS WHEREOF, County and City agree to all of the terms
and conditions hereinabove set forth.

SPECIFICATIONS PASSENGER WAITING SHELTERS
ROOF:
Structural panel with baked enamel finish, white on top, bronze or
white under. (Circle One) . Roof shall be capable of supporting 40
pounds per square foot. Minimum thickness will be .027".
FASCIA/GUTTER:
Shall be a one piece extruded aluminum member a minimum of 61• in
height with a built in gutter that shall have an area of not less than
4 square inches. Alloy of aluminum shall be 6063-T6. Connections at
corners shall be with internal corner angles, fastened with 3/16"
aluminum pop rivets. There will be no exposed fasteners on exterior
face of fascia. Open spans of fascia/gutter will be capable of
supporting 500 pounds at midspan without permanent deformity. Drain
holes shall be located on a custom basis to prevent water from running
through shelter.
ANCHORAGE:
Arkhor bases shall be supplied for each vertical column. Bases shall
be one piece cast aluminum with a minimum thickness of 1/4" . Bases
shall be designed with a leveling capability of up to 3" . Base
flanges shall have pre-punched holes to accept the 5/6" x 3" concrete
anchors supplied with shelter.
. FAStENERS:
All fasteners 1/4" or smaller shall be aluminum or stainless steel.
Larger than 1/4" shall be zinc or cadmium plated.. No hex head or nut
and bolt type exposed fasteners shall be used.
:. SHIPPING s
All components of shelters shall be " pallatized for quick unloading
with a forklift.
OPTIONS
ROOF:
Molded acrylic skylight dome. Thickness of acrylic shall be 3/16" .
nominal. Color shall be translucent white or solar control
bronze, (Circle One) .Dome shall be Basketed and sealed to be completely
water tight. ,Dome shall be removable without removing facia/gutter.
ROOF:
Honeycomb sandwich panel opaque and condensation proof. Top and
bottom to be laminated with .021" textured aluminum with a white baked
