SUBJECT: Request to waive architectural review fees for an application for an apartment to be built on lot that contains a residence, on the southeast corner of Pismo and Toro Streets. CAO RECOMMENDATION Waive the $650 Architectural Review application fee. DISCUSSION Background The applicants want to add a one-bedroom apartment to a site that contains a one-bedroom dwelling. The Architectural Review Commission (ARC) reviewed the project on February 16, 1993 , and on March 15, 1993 , and granted final approval. Neighbors of the site appealed the approval, citing concerns with the height and bulk of the new building. The City Council approved the appeal, denying the project, on May 4, 1993 . Councilmembers voting in favor of the motion also indicated a concern about the potential for converting the proposed multipurpose and storage rooms into an additional bedroom. On .May 11, 1993 , the applicants, their representative, three of the appellants, a. City staff representative, and Councilmember Roalman met at the site to discuss how to proceed from here. Appellants and applicants were able to come to an agreement on a design that would mitigate the neighbors' concerns. The applicant's representative is now preparing plans for a resubmittal to the ARC. At the May 11 City Council meeting, Councilmember Roalman requested a waiver of fees for the resubmittal, given the applicants' cooperation with the neighbors on this project. OTHER DEPARTMENT COMMENTS The requested fee waiver affects only architectural review activities, administered by the Community Development Department. Other departments have not been consulted. FISCAL IMPACTS The fee requested to be waived is $650. The . presumed "pre- approval" by the neighbors should result in smooth, quick processing of the new project, and will likely avoid further appeals, which, although free to the appellant, are costly to the City. SUBJECT: Water Reclamation Facility Hazardous Materials Building, Specification No. 93-18. CAO RECOMMENDATION: By Motion, Approve Plans and Specifications for Water Reclamation Facility Hazardous Materials Building, Specification No. 93-18, and Authorize Soliciting of Bids and Contract Award by CAO if the Lowest Responsible Bid is Within the Engineer's Estimate. DISCUSSION: The Water Reclamation Facility, in accordance with local fire codes, is required to provide for proper storage of its hazardous materials. These include lubricants, gasoline and pesticides necessary for plant operation. This project will provide the Facility with two storage areas. The storage areas will be large enough to accommodate existing materials as well as increases of materials stored, expected as a result of the Facility expansion_ CONCURRENCES: The. Planning Department has given this project a categorical exemption as long as the building maintains the required twenty foot creek setback. FISCAL IMPACT: The engineer's estimate for the project is $25, 000. The CIP for 1992/93 (page E-7) includes funds for System Improvements. Adequate funds are available in that account to support this project. The City Council at the June 30th meeting determined that Utility CIP projects go forward based on their independent funding. staNrpAsttsadv L4-a
