CITY O F SAN LUIS OBISPO FROM: John Mandeville, Community Development Director Prepared By: Phil Dunmore, Senior Planner SUBJECT: CORRECTION TO PRE-ZONING EXHIBIT FOR ORCUTT AREA ANNEXATION (ANNX, R 81-10). RECOMMENDATION Approve a minor correction to the pre-zoning exhibit that is part of the approved pre-annexation ordinance adopted for the Orcutt Area Specific Plan (GASP). DISCUSSION Situation On September 21, 2010, the City Council approved an ordinance to pre-zone the property within the Orcutt Area Specific Plan along with a resolution of intent to annex the entire Orcutt Area, (Attachment 1, Ordinance 1554). The annexation will be considered by LAFCO at a public . hearing on April 21, 2011. As part of the LAFCO application to annex the Orcutt area, a pre-zoning exhibit is required. In review of the pre-zoning exhibit that was adopted with Ordinance 1554, staff noticed that the General Plan designations are noted in the exhibit, but not the zoning designations. The General Plan designations describe each zone with a description such as Low Density Residential, Medium Density Residential etc. while the Zoning designations describe each designation as R- 1-SP, R-2-SP etc. (the SP designation is added to note the Specific Plan). These designations were inadvertently left out of the exhibit. The map and all other components of the Ordinance are correct and need not be amended. Attachment 2 is the corrected version of the exhibit. CONCURRENCES All City departments with responsibility for providing services to the proposed annexation areas have been involved in the development of the Plan for Services and the Specific Plan that includes development standards for this area. City staff has been working closely with LAFCO staff regarding preparation of the formal annexation application. FISCAL IMPACT Fiscal impacts of the annexation were discussed at the time of the annexation resolution and are not a component of the consideration for the exhibit correction. The exhibit correction does not have fiscal impacts and no changes are proposed to the Ordinance. C8-1 Orcutt Area Annexation Page 2 ALTERNATIVES 1. As this action only applies to a correction of the exhibit, no alternatives are available unless the Council chooses to recommend the adoption of a new ordinance for the annexation. The adoption of a new ordinance will delay the annexation process which has now been scheduled for an April 21 LAFCO hearing. ATTACHMENTS: Attachment 1: Ordinance 1554 Attachment 2: Resolution with corrected Exhibit for Ordinance 1554 C8-2 "Attachment 1 ORDINANCE NO. 1554(2010 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO ESTABLISHING PRE-ZONING FOR LAND WITHIN THE ORCUTT AREA,CONSISTENT WITH THE ORCUTT AREA SPECIFIC PLAN ANNR/ER 81-10 (Citywide) WHEREAS,the City Council of the City of San Luis Obispo conducted a public hearing in the Council Chamber of City Hall, 990 Palm Street, San Luis Obispo, California, on September 21, 2010, for the purpose of considering Planning Application ANNX/ER 81-10, a project to annex and pre-zone the Orcutt Area,consistent with the Orcutt Area Specific Plan;and WHEREAS,the City Council of the City of San Luis Obispo conducted a public hearing in the Council Chamber of City Hall, 990 Palm Street, San Luis Obispo, California, on October 19,2010,to consider a second reading of the Pre Zoning ordinance;and WHEREAS, pre-zoning this land is a necessary component of the annexation process; and WHEREAS,the General Plan designations and anticipated development in the area were reviewed with the Orcutt Area Specific Plan and the specific plan EIR,which were approved by Council on March 2;2010; and WHEREAS, the City Council considered the Initial Study and Negative Declaration of Environmental Impact (ER 81-10) for the annexation and pre-zoning project, and determined that the document adequately addresses the potential environmental effects of the proposed project;and WHEREAS,the City Council has duly considered all evidence,including the testimony of the applicant,interested parties, and the evaluation and recommendations by staff,presented at said hearing. NOW,THEREFORE, BE IT ORDAINED by the City Council of the City of San Luis Obispo as follows: Section 1. Environmental Review. The City Council does hereby adopt a Negative Declaration for the project. Section 2. Action. The City Council does hereby approve pre-zoning to apply to land within the Orcutt Area as shown in Exhibit A. Section 3. Summary. A summary of this ordinance, approved by the City Attorney, together with the names of the Council members voting for and against it, shall be published at least five days prior to its final passage, in the Tribune, a newspaper published and circulated in this City. (2011 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO AMENDING EXHIBIT A OF ORDINANCE 1554 TO PREZONE THE ORCUTT AREA SPECIFIC PLAN AREA WHEREAS, the Council adopted the Orcutt Area Specific Plan on March 2, 2010 following extensive public hearings by the Planning Commission and Council; and WHEREAS, the Council adopted an ordinance to pre-zone the specific plan area on September 21, 2010; and WHEREAS, the adopted ordinance 1554 provides an exhibit(Exhibit A)which illustrates the zoning designations consistent with the approved Orcutt Area Specific Plan; and WHEREAS, Exhibit A listed the General Plan designations for each zone but did not describe the associated zoning designations in the exhibit; and WHEREAS, no amendments to the ordinance language or the zoning map are required, only the legend of the map exhibit requires a clerical correction to list zoning designations. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo that the attached Exhibit A will replace the Exhibit A currently attached to Ordinance 1554. SECTION A.
