SUBJECT: SAN LUIS GARBAGE COMPANY INTERIM YEAR SOLID WASTE
RATE ADJUSTMENT APPLICATION.
RECOMMENDATION
Adopt a resolution increasing solid waste rates by 4.62% for interim year 2011 effective on
November 1, 2011; provided there is not a majority protest against such increase.
DISCUSSION
Background
On June 24, 2011 San Luis Garbage Company(the garbage company) submitted its interim year
rate application (Attachment 2) per the procedures in the Rate Setting Process and Methodology
Manual for Integrated Solid Waste Management Rates, adopted by the City Council in 1994.
The application reflects the rate adjustment for changes in the consumer price index, landfill
tipping fees, and using green waste as alternative daily cover at Cold Canyon Landfill (which was
approved by the City Council at its July 19, 2011,meeting).
Solid Waste Rate Setting Methodology Overview
An integral part of the solid waste, recycling, and green waste collection franchise agreements is
the solid waste rate setting methodology. The procedures in the Rate Setting Process and
Methodology Manual for Integrated Solid Waste Management Rates (Rate Setting Manual),
adopted by Council in 1994,have ensured stable and competitive rates for the community.
The Rate Setting Manual provides a process and schedule for rate application review and binds
the contractor and the City to a method of determining revenue adequacy for the contractor while
ensuring the community is receiving quality service at reasonable rates.
Under the methodology, base year applications are prepared in year one of a three year cycle.
Base year applications require a detailed submittal and review of past, current, and estimated
future operating expenses. Less detailed interim year applications are required in years two and
three of the cycle. Interim year applications are intended to adjust for the prior year's consumer
price index changes and changes to the landfill tipping fees (which are considered pass through
costs).
The current three year rate setting cycle began with the submittal of the 2010 base year
application. This application recommended no rate increase based on the formulas and policies in
the rate setting methodology. The application being presented to the City Council is an interim

year rate adjustment request. There has not been an increase in the solid waste rates since January
2009.
Key Factors in 2011 Interim Year Application

at Cold Canyon Landfill. This equates to 2.64% of the 4.62%rate increase being requested by the
garbage company.
2. Consumer Price Index
The figure used to factor inflation into increases in solid waste rates is the Bureau of. Labor
Statistics' Consumer Price Index for Urban Consumers based on the All U.S. City Average. A
twelve month CPI is used to determine the weighted average change in controllable costs in the
rate adjustment application being considered. The CPI used in the rate application is from the
November 2010 Bureau of Labor statistics which was 1.03%. The reason for using this period
(instead of a more current number) is the garbage company submitted a preliminary application
for a proposed rate increase using this CPI number late last year. It turned out that several issues
needed to be resolved before proceeding with the application review including the green waste
processing question and the County's pending approval of the landfill tipping fee. While the most
current CPI is 3.8%, the garbage company opted to stay with the original CPI submitted with the
preliminary application late last year.
3. Green Waste Process as Alternative Daily Cover
With the closure of the green waste composting facility at Cold Canyon Landfill, per its contract,
the garbage company submitted two alternative methods for dealing with green waste processing
to the City. At its July 19, 2011 meeting, the City Council selected using the green waste for
alternative daily cover. The percentage of the rate increase associated with this change is 0.95%.
Survey of Solid Waste.Services and Rates–Other Cities
As part of the rate setting process, the garbage company is required to conduct and report the
results of a survey of residential solid waste rates in other communities in San Luis Obispo
County. Attachment 3 shows the results of the survey submitted by the garbage company.
It is important to note that there are many variables that make up the solid waste rates in different
communities. The variables include franchise fees, AB 939 fees, tipping fees, and levels of
service (i.e. curbside recycling, green waste collection, etc.). Because of the variability of factors,

it is difficult to compare rates from other jurisdictions on an "apples to apples"basis. Taking this
information into account, the survey indicates that the current rates charged by the garbage
company are in the low-range of cost when compared to other local jurisdictions. The services
reflected in the City's rates include weekly automated solid waste collection (at a prescribed
level), curbside recycling service (64 gallon container) and curbside green waste recycling (96
gallon container).
Proposition 218 NoticinE
Although there is no explicit legal requirement to do so, City staff elected to follow Proposition
218 noticing and hearing requirements for the proposed solid waste rate increases to ensure the
legal validity of those rates. Per the Proposition 218 notification requirements, notices were
mailed at least 45 days in advance of the public hearing to both property owners and customers.
The protest must be submitted in writing and received by the City Clerk before the close of the
public hearing on October 18, 2011. The person signing the protest must either be the property
owner or the customer of record. In the event that a protest is submitted by the owner and also by
the tenant responsible for payment of the bill, one valid protest is counted for the parcel.
If valid written protests are filed by a majority, the applicable proposed rate may not be imposed.
As of October 4, 2011, a total of 7 written protests were received by the Office of the City Clerk.
Of the 7 written protests received, 5 protests are valid. During the public hearing the City Clerk
will be asked by the Mayor to make a statement indicating the number of protests received and
indicate whether there are enough to prevent the rate increase..
Summary
The adoption of the 2011 solid waste rates as recommended will ensure the garbage company
receives the necessary operating revenues, including profit, within the prescribed levels set by the
City's solid waste rate setting policies. Therefore, it is staff's recommendation that the City
Council adopt the rate increase requested by the garbage company.

Commercial Solid Waste Services
There are numerous alternatives for commercial solid waste services. These are identified in
Exhibit A to Attachment 1. Though the rate increase will impact the cost of providing solid
waste services to City facilities, staff anticipated and estimated a 5% rate increase for fiscal year
2011-2012 as part of developing solid waste services line item budgets in the 2011-2013
Financial Plan. Since the requested rate increase is for 4.62% and is lower than the estimated
5%, there are adequate funds budgeted to cover the requested rate increase.
ALTERNATIVES
As previously discussed the Rate Setting Manual provides a process and schedule for rate
application review and binds the contractor and the City to a method of determining revenue
adequacy for the contractor while ensuring the community is receiving quality service at
reasonable rates. Since interim year applications are to adjust rates for pass through costs and
increases in CPI, the Council could choose to not to approve the requested rate increase if it is
believed that any of the factors identified are inaccurate or inflated. Based on staff s evaluation
of the Interim Year Rate Application, the information provided is accurate and reasonable
therefore would recommend approving the requested rate increase.

A RESOLUTION OF THE COUNCIL
OF THE CITY OF SAN LUIS OBISPO
ESTABLISHING INTEGRATED SOLID WASTE RATES
WHEREAS, on June 21, 1994, the City Council of the City of San Luis Obispo approved
the Rate Setting Manual Process and Methodology Manual for Integrated Solid Waste
Management Rates;
WHEREAS, notices regarding the requested rate increase were sent on September 1,
2011 to all property owners and customers;
WHEREAS, sufficient protests were not received to prevent the rate increase; and
WHEREAS, a review of San Luis Garbage Company's 2011 interim year solid waste rate
application has been completed in accordance with the adopted solid waste rate setting policies.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo
as follows:
SECTION 1. Resolution No. 10039 (2008 series) is hereby rescinded as of 11:59 p.m.,
October 31, 2011.
SECTION 2. The rates set forth in Exhibit A shall be effective at 12:00 a.m. November
1, 2011.

Commercial customers can choose from a 32, 64, or 96 gallon blue waste wheeler for commingled recycling.
White office paper can be commingled with the other recyclables in the blue waste wheeler.
Polystyrene(Styrofoam,.Plastic#6) is no longer collected for recycling and should be thrown away as trash.
Greenwaste is recycled in a special green waste wheeler and is picked up once a week at no additional charge.
