HomeMy WebLinkAbout02/06/1990, 5 - CURB, GUTTER AND SIDEWALK IMPROVEMENTS WHERE MORE THAN 50% OF THE BLOCK IS ALREADY IMPROVED h4EEnNs DarE: all City Of San Luis OBISPO ETBRUARY NUMBER CONL AGENDA REPORT MMUCI � FROM: David Romero, Public Works Director SUBJECT: Curb, gutter and sidewalk improvements where more i than 50% of the block is already improved- CRO mprovedCAO RECOMMENDATION: By motion, after making desired modifications, direct staff to proceed BACKGROUND: Resolution No. 6031 (1986 Series) (attached) calls for the staff to bring to Council attention those properties where more than 50% of the frontage of a block has been improved, thereby meeting 1911 Act criteria for completion of improvements within a block. A staff survey of sidewalk improvements within the community resulted in the list shown on Exhibits A & B. Provisions of the 1911 Act call for the property owners to construct said improvements after the Superintendent of Streets has given notice to construct. Further provisions of the Act call for a public hearing, when the legislative body will hear and pass upon objections or protests raised by the property owner or other interested parties. At that public hearing, the Council may make those adjustments it feels are appropriate, then direct staff to proceed, following provisions of the 1911 Act. This evening's meeting is held in response to the City Council concern, that it be notified prior to start of an action which will affect a number of citizens. If the Council- feels that any of the blocks listed (Exhibits A & B) are inappropriate, it should inform staff prior to beginning of formal notification proceedings. FISCAL IMPACT: Approval to proceed implies only expenditure of staff time until the Protest Hearing is held in several weeks. At that time, the Council may exempt certain or all properties. Those not exempted would be obligated for certain improvements. If all of the 22 separate blocks remain on the list, cost for improvements is estimated at $138,723. Past experience is that approximately 70% of owners either have the work done or pay their costs in cash. The City could expect to finance approximately $42,000 of property owner obligatedwork and approximately $8,000 for City owned property.
