Jona , Community Development Director ' PREPARED BY: Ken Bruce, Senior Planner 0 SUBJECT: Noticing Requirements for Development Review CAO RECOMMENDATION: Adopt resolution amending policy for noticing consideration of applications by the Architectural Review Commission (ARC) . BACKGROUND: Recently, the City Council and the Architectural Review Commission had a joint meeting. One of the issues discussed was city noticing policy for projects going before the Architectural Review Commission. The City Council and ARC agreed that some changes were needed. They are noted below. Attached to the draft resolution is a table that summarizes the noticing procedures for each type of development review. The changes proposed here involve only architectural review, and include: • ARC projects will now involve individual written notice to all property owners and tenants within 300 feet of the site, ten days before the hearing. • A newspaper legal ad will be published ten days before hearings. Noticing procedures were first adopted by the City Council in December 1988 by resolution. The city policy is to notify the public of all hearings on all development projects, even though not required to do so by law. SIGNIFICANT IMPACTS: These changes will require significantly more staff time. The preparation of the additional mailings will require an additional five staff hours per week. Most of this work is performed by interns and clerical staff, and is estimated to represent about $4000 of staff time per year. This is staff time only; postage costs will also be significant. Staff intends to recover some of the additional costs by requiring applicants to prepare property owner lists as part of their application packets. Staff would continue to prepare tenant lists. While this practice is not unusual, it has not been required for architectural review projects in San Luis Obispo until now. Further, additional notice is likely to result in more continuances and appeals. The impact is not so important in terms of the budget as it is in terms of the availability of staff time for other projects. CONSEQUENCES OF NOT TARING THE RECOMMENDED ACTION: If the council chooses to not adopt the proposed changes, the current noticing procedures will be followed.
