BACKGROUND: At its March 20, 1990 meeting, Council unanimously approved the introduction to print of Ordinance (#1165) . The new ordinance will amend section 10.64.040 (Disposition of Fines and Forfeitures) of the Municipal Code whereby effective July 1, 1990, all fines and forfeitures paid to the city will be deposited into the Parking Fund. No additional comments were received by anybody opposing the amendment to the Municipal Code, therefore it is staffs recommendation to give final passage to Ordinance (#1165) . ALTERNATIVES: 1. Give final passage as recommended. 2. Reject final passage. PROS AND CONS 1. Passing the ordinance change will help reduce the parking program's current negative cash flow without raising parking fees or fines. The General Fund will have to make-up the loss of revenue from parking citation monies. city of San .UIS OBISpo 11iiNCOUNCILAGENOAREPOF" Council Agenda Report Page Two 2 . By rejecting the ordinance change, the parking program will continue to face the full $400,000 deficiency and would have to identify other sources of revenue to offset the negative cash flow. The General Fund would continue to receive one-half of parking citation monies. FISCAL IMPACT: Depositing all revenues from the collection of parking citations into the Parking Fund will substantially reduce the current financial short-fall of the parking program. The projected figure of $160,000 represents 40% of the current deficiency and can be accomplished without raising fees or fines. This action will represent a $160, 000 loss to the General Fund. CONCURRENCES: The Parking Management Committee and Finance Department recommend that all parking citation monies should be deposited into the Parking Fund. CONSEQUENCES OF NOT TAKING RECOMMENDED ACTION: If parking citation monies continue to be split between the Street Improvement Fund and the Parking Fund, the parking program will continue to face an ongoing deficiency which will have to be offset by higher parking rates. Section 10. 64 . 040 of the Municipal Code is hereby amended to read as follows: 10. 64 . 040 Disposition of fine and forfeitures. All fines and forfeitures collected upon conviction or upon forfeiture of bail of any person charged with a violation of any of the provisions of this title, shall be paid into the city treasury and 100% shall be deposited into the "parking fund. " "Parking fund" moneys shall be distributed for the purposes described in Section 10. 64. 010. (Ord. 1100, Sec. 2 , 1987 : prior code Sec. 3217. 3) SECTION 2 . This Ordinance, together with the ayes and noes, shall be published once in full, at least three (3) days prior to its final passage, in the Telegram-Tribune, a newspaper published and circulated in said City and the same shall go .into effect at � ,, the expiration of thirty (30) days after its said final passage..
