Kenny, upervising Civil Engineer/� SUBJECT: Final Map approval for Tract No. 1261, a 7-lot residential subdivision at 133 Rosita Street (Brown Family Estate Trust, Subdividers) RECOMMENDATION: Adopt resolution approving the final map for Tract No. 1261. DISCUSSION: The tentative map for this tract was approved on April 2, 1985 per Resolution No. 5651 (1985 Series) . (Attachment 4) Subsequent time extensions were granted to extend the tentative map until April 2, 1990. The subdivider complied with all of the required conditions prior to that expiration date. This tract creates 7 lots from 3 existing parcels of record. Six (6) residences already exist within the tract boundaries. The net effect will be only one (1) additional future residence. The public and private improvements required per the above-mentioned resolution have all been installed. They included frontage improvements, pavement, a fire hydrant, street lighting, public utility conduits and under- grounding of certain overhead wire services and demolition and/or modifications to existing structures. The final map has been checked and found to be satisfactory and in substantial conformity with the approved tentative map. All conditions per Resolution No. 5651 (1985 Series) have been met. All fees have been paid as noted on the Fee and Bond List (Attachment 5) and there is no subdivision agreement. SIGNIFICANT IMPACTS: None CONSEQUENCES OF NOT TAKING THE RECOMMENDED ACTION: If all conditions are not considered to have been met, the subdivider would be required to file a new tentative map. C.ir. CONCURRENCES: The Community Development Director and City Attorney concur with the recommended action. Clearances have been obtained from other affected departments. FISCAL IMPACT: Normal maintenance of completed public improvements and street light energy costs. ALTERNATIVES: Option 1: Adopt resolution approving the final map for Tract No. 1261. Option 2 : Deny approval of the final map if the Council finds that any conditions have not been satisfactorily met. RECOMMENDATION: j Adopt resolution approving the final map for Tract No. 1261. (1990 SERIES) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO APPROVING THE FINAL MAP FOR TRACT NO. 1261 LOCATED AT 133 ROSITA STREET (BROWN FAMILY ESTATE TRUST, SUBDIVIDERS) WHEREAS, the City Council made certain findings concerning Tract No. 1261 as contained in Resolution No. 5651 (1985 Series) , and WHEREAS, all conditions required per said resolution have been met, and WHEREAS, the final map is in substantial compliance with the approved tentative map. NOW THEREFORE BE IT RESOLVED that the final map for Tract No. 1261 is hereby approved. Findings. That this council, after consideration of the tentative map of Tract 1261 and the Planning Ca -nission's recommendations, staff recommendations and reports thereon, makes the following findings: 1. In accordance with state and city environmental review guidelines, an initial environmental study (ER 1-85) has been prepared and a negative declaration was approved by the Director February 13, 1985. 2. The tentative map is consistent with the general plan. 3. The site is physically suitable for the proposed type and density of development allowed by the R-1 zone. 4. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. 5. The design of the subdivision and the type of improvements are not likely to cause public health problems. 6. The design of the subdivision and the type of improvements will not conflict with easements for access through or use of property within the proposed subdivision. 7. Certain exceptions are granted subject to these findings: A. That the property to be divided is of such size and shape that it is impractical or undesirable to conform to the strict application of city regulations; and B. That cost to the subdivider of strict or literal compliance with the regulations is not the stile reason for granting the modification; and C. That the modification will not be detrimental to the public health, safety, and welfare, or be injurious to other properties in the vicinity; and D. That granting the modification is in accord with the intent and purposes of these regulations, and is consistent with the general plan. R 5651�� Resolution No. 5651 (1985 Series) Tract 1261 Page 2 Section 2. Exceptions. That the approval of the tentative map for Tract 1261 shall be subject to the following exceptions: 1. The areas of lots 1 and 2 are 5,000 square feet each, instead of a minimxn 6,000 square feet. 2. The area of lot 3 is 6,000 square feet instead of the minimum 6,900 square feet. 3. The depth-to-width ratios of lots 4 and 5 are 3.2:1 instead of the maximum 3:1. 4. The longest dimensions of lots 4 and 5 are oriented perpendicular to south, rather than within 30 degrees of south. 5. The width of sidewalk (four feet instead of six feet) and roadway (32 instead of 40 feet) of Rosita Street are less than standard. SECTION 3. Conditions. That the approval of the tentative map for Tract 1261 be subject to the following conditions: 1. Applicant shall remove storage building, sheds, and garages as noted on the tentative map. 2. Applicant shall remove or relocate. outside of required setbacks the shed an lot 1. 3. Applicant shall rermve the garage on lot 3. 4. Applicant shall provide off-street parking as required by the Zoning Regulations for lots 1, 21 3, and 6. 5. Subdivider shall pay water frontage and acreage fees as determined by the City Engineer, with credit for existing services. 6. Subdivider shall install individual water and sewer laterals for each lot. Existing water laterals and meters shall be relocated as needed to meet current standards. 7. Subdivider shall provide a private drainage easement along the east property line of lots 4, 5, and 7 to Foothill Boulevard. 8. Subdivider shall provide_ for undergrounding of new utility services to the subdivision (except those on Cerro Ranauldo and Foothill U Boulevard) to the approval of the utility companies and the City Engineer. Subdivider shall install or reconstruct frontage improvements along Cerro Ranauldo; Rosita Street; and Foothill Boulevard (including handicap rags in both curb-returns at Foothill Boulevard) and one-half street improvements on Cerro Romauldo and paving on Rosita Street to meet the new gutter grade, all to the approval of the City Engineer. 10. Final map shall include the following notes: A. "The parts of lots 6 and 7 within fifty feet of Foothill Boulevard are subject to traffic noise which exceeds city standards for outdoor residential use. B. "Houses constructed on lots 6 and 7 shall be sound-proofed consistent with thegeneral plan Noise Element to provide interior sound levels not to exceed 45 dB(A) ." C. "on lots 6 and 7, for any new houses or for remodelling of the existing house involving more than 50% of its replacement value, measures to reduce outdoor noise to acceptable levels for active use areas shall be provided to the approval of the C=minity Development Department." On motion of Councilman Settle seconded by Councilman Dunin and on the following roll call vote: AYES: Councihm_nbers Settle, Dunn; Dovey; Griffin and Mayor Billig NOES: None.
