SUBJECT:
Final Map approval for Tract No. 1846, a 5-Unit Industrial
Airspace Condominium Conversion at 2930 McMillan Avenue
(Troy and Colleen West, Subdivider)
RECOMMENDATION:
Adopt resolution approving the final map for Tract No. 1846.
DISCUSSION:
The tentative map for this tract was approved on January 16, 1990 per
Resolution No. 6749 (1990 Series) .
This tract creates 5 airspace condominium units within an existing
industrial building on a common lot. The public and private
improvements required per the above-mentioned resolution have all been
installed.
The final map has been checked and found to be satisfactory and in
substantial conformity with the approved tentative map. All conditions
per Resolution No. 5651 (1985 Series) have been met and the subdivider
has asked for final map approval. All fees were previously paid and
there is no subdivision agreement. CC&R's have been approved and will
be recorded with the final map.
SIGNIFICANT IMPACTS: None
CONSEQUENCES OF NOT TAKING THE RECOMMENDED ACTION:
Subdivider would not be able to sell the units.
CONCURRENCES:
The Community Development Director and City Attorney concur with the
recommended action. There are no other affected departments.
FISCAL IMPACT:
None.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
APPROVING THE FINAL MAP FOR TRACT NO. 1846 LOCATED AT
2930 McMILLAN AVENUE (TROY WEST, SUBDIVIDER) .
WHEREAS, the City Council made certain findings concerning
Tract No. 1846 as contained in Resolution No. 6749 (1990 Series) ,
and
WHEREAS, all conditions required per said resolution have been
met, and
WHEREAS, the final map is in substantial compliance with the
approved tentative map.
NOW THEREFORE BE IT RESOLVED that the final map for Tract No.
1846 is hereby approved.

GA RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO GRANTING APPROVAL OF TENTATIVE TRACT NO. 1846
LOCATED AT 2930 MCMILLAN AVENUE
BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
SECTION 1., Findings. That this council, after consideration of the
tentative map of Tract 1846 and the Planning Commission's recommendations,
staff recommendations, and reports thereof makes the following findings:
1. The design of. the subdivision is consistent with the general plan.
2. The site is physically suited for the type and density of development
allowed in the M zone.
3. The design of the subdivision is not likely to cause serious health
problems, substantial environmental damage or substantially and'
unavoidably injure fish or wildlife or their habitat.
4. The design of the subdivision will not conflict with easements for
access through (or use of property within) the proposed subdivision.
S. The Community Development Director has determined that the proposed
O . subdivision will not have a significant effect on the environment and
has granted a negative declaration.
6. The. City of San Luis Obispo has identified through its Circulation
Element studies that deficiencies exist on an adjacent, major arterial
street (Orcutt Road) which may, in the future, require an assessment
district to finance necessary improvements.
SECTION 2. Conditions. The approval of the tentative map .for Tract
1846 be subject to the following conditions:
1. Subdivider shall submit a final map to the city for review, approval and
recordation.
2. Subdivider shall provide individual water services for each unit.
Meters shall be clustered, at the back of the sidewalk at property
frontage to the approval. of the City Engineer.
3. Subdivider shall provide individual gas and electrical services and
metering for each unit to the approval of affected public utility
agencies and the City Engineer.
4, Final map shall note a blanket easement over the common lot area, except
under structures, for underground public utilities serving the site, to
the approval of the City Engineer and affected utility companies.

Subdivider shall prepare covenants, Conditions, and Restrictions (CC
&R's) to be approved by the City Attorney and Community Development
Director prior to final map approval. CC&R•s shall contain the
following provisions:
a. Property owners association created to enforce the CC&R•s and
provide for professional, perpetual maintenance of common areas
including, but not limited to driveway, parking lot, landscaping,
utilities and building exteriors, and-trash/waste pick,-up and
disposal.
b. Rights shall be granted to the city to maintain common areas if
property owners association fails to do so, and assess said
association for expenses incurred.
C. All parking spaces provided in the project shall be available for
use by all of the individual owners.
d. No change in city regulated provisions of the CC&R?s shall be
allowed without prior approval of the Community Development
Director and City Attorney.
