SUBJECT :ACCEPTANCE OF SUBDIVISION IMPROVEMENTS FOR TRACT 2969 ,
1310 FOOTHILL BOULEVARD (TR 200-07 )
RECOMMENDATION
Adopt a resolution accepting the public improvements, certifying completion of the required privat e
subdivision improvements, and releasing the securities for Tract 2969 at 1310 Foothill Boulevard .
DISCUSSION
Backgroun d
The tentative subdivision map for Tract 2969 (TR 200-07) was approved by City Council o n
September 16, 2008, by Resolution No . 10026 (2008 Series). The tentative map authorized creatio n
of a one-lot condominium subdivision for the purpose of creating 16 residential condominium units .
(See Attachment 1 for vicinity map and Attachment 2 for site plan .) The final map and Subdivisio n
Agreement for Tract 2969 were approved by City Council on August 7, 2012, by Resolutio n
No . 10389 (2012 Series).
Accepting the Public Improvements and Certifying Completion of Private Improvement s
Public improvements for this project include replacing the existing sidewalk, curb, and gutter alon g
Foothill Boulevard with new sidewalk, curb and gutter ; installing a new driveway approach an d
trash enclosure ramp ; and installing new water services to the meters . The remaining subdivisio n
improvements are private improvements including but not limited to the on-site drive aisle an d
parking spaces, trash enclosure, on-site utility services, sewer main, storm drain improvements ,
landscape improvements and a pedestrian connection to Campus Way .
The subdivision improvements, as required in the Subdivision Agreement, have been completed an d
inspected under the building permit and encroachment permit processes to the satisfaction of th e
City.
The subdivider recently requested final acceptance of the subdivision improvements by the City an d
release of the respective securities . The Subdivision Agreement authorizes release of the Faithfu l
Performance and Labor & Materials securities upon Council's acceptance of the subdivisio n
improvements and receipt of a guarantee of ten percent of the cost of the subdivision improvements .
The ten-percent guarantee is to insure that the subdivider will remedy any defects in th e
improvements arising from faulty workmanship or materials or defective construction of sai d
improvements for a period of one year . The total cost of the subdivision improvements wa s
estimated to be $675,700, so the ten-percent security to be retained will be in the amount o f
$68,000 .

(Attachment 3). This resolution also authorizes the Public Works Director to release the ten-percen t
security upon completion of the one-year warranty period to the satisfaction of the City .
FISCAL IMPAC T
The public improvements constructed with this proposed subdivision will result in a minor increase i n
maintenance costs for the water services . At this time, the Utilities Department Water Division will no t
need additional resources to maintain these new services . However, cumulative increases i n
infrastructure eventually require additional resources to maintain . When required, these additiona l
resources would be requested as part of the Financial Plan process, consistent with City policy .
CONCURRENCE S
The Community Development and Utilities Departments concur with the recommended action .
ALTERNATIV E
Do not accept the public improvements or certify completion of the private improvements .I f
some of the required subdivision improvements have not been completed, then Council can
continue this item until such time as the improvements have been completed to the satisfaction o f
the City . Staff does not recommend this alternative because all of the subdivision improvement s
have been completed in accordance with the approved plans and specifications and modification s
thereof.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISP O
ACCEPTING THE PUBLIC IMPROVEMENTS AND CERTIFYING COMPLETION O F
THE PRIVATE IMPROVEMENTS FOR TRACT 296 9
(1310 FOOTHILL BOULEVARD, TR 200-07)
WHEREAS, the City Council made certain findings concerning Tract 2969, a s
prescribed in Resolution No . 10026 (2008 Series); and
WHEREAS, the City Council approved the final map for Tract 2969 pe r
Resolution No . 10389 (2012 Series); and
WHEREAS, the subdivider has satisfactorily completed the public improvements fo r
Tract 2969 in accordance with City standards and specifications and has requested acceptance o f
the public improvements for maintenance and operation by the City ; an d
WHEREAS, the subdivider has satisfactorily completed the private improvements for
Tract 2969 in accordance with City standards, specifications and the approved plans, and ha s
requested that the City certify completion of these private improvements ; and
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Lui s
•Obispo as follows :
SECTION 1 . The City Council hereby accepts the public improvements for Tract 2969 .
SECTION 2 .The City Council hereby certifies completion of the private improvement s
for Tract 2969 .
SECTION 3 .The Faithful Performance and Labor & Materials securities may b e
released upon submittal of a security in the amount of $68,000, which is ten percent of the cos t
of the total subdivision improvements, as required in the approved Subdivision Agreement fo r
Tract 2969 .
SECTION 4 . The Public Works Director is hereby authorized to release said $68,00 0
security upon completion of the one-year warranty period to the satisfaction of the City, a s
required in the Subdivision Agreement for Tract 2969 .
