Laguna Lake Park Improvements
CAO RECOMMENDATION:
By Motion:
1) Approve and authorize the Mayor to execute a contract with Whitaker
Contractors, Inc. in the amount of $137,318 for improvements to
Laguna Lake Park, City Plan No. N-59Y;
2) Appropriate $144,000 from the Parkland Development Fund (Park-in-
Lieu Fees) to cover construction costs and contingencies.
BACKGROUND:
In the development of the 1989-91 Financial Plan, one of the objectives
of the Council's Work program was to improve and expand playgrounds in
existing City parks. At that time, plans were already completed for some
improvements to Laguna Lake Park. Because of the close tie between the
Council objective and the proposed park improvements, the addition of the
playground was made to the project.
In addition to the expansion of the playground, the project includes
additional parking, expanded multi-use area surrounding the playground,
a large group gathering area for family or daycamp use and a volleyball
court. The original plans and specifications approved by Council on
December 12, 1989 included lake bank stabilization for a windsurfing i
take-off and landing area and a canoe launching beach. Due to delays in
receiving a permit from the Army Corps of Engineers to work at the Lake
edge, staff determined it would be best to proceed with the other
improvements at this time.
Alternatives:
1) Award contract to lowest bidder and proceed with the park
improvements.
2) Do not award contract at this time and await development of a Master
Plan of the entire park. This action would keep any development of the
park on hold for at least two years and place an approved Federal Grant
and a portion of a State Assistance Grant in jeopardy of being revoked.
FISCAL IMPACTS:
Budget: None (see explanation below)

The 1987/89 financial plan (page E-14) designated $16,000 for project
study and design and estimated that construction would cost $168,000 in
1989/90. The parks and recreation CIP project detail in the 1989/91
financial plan (page E010 and E011) does not designate any money for
construction. $18, 000 was designated for playground improvements at this
site (page E-16 of the 1989-91 Financial Plan) out of a $170,000 total
set aside for six different parks. To correct this oversight, staff
recommends that the Council designate an additional $126,000 from the
Parkland Development Fund , which has a projected uncommited Fund balance
of approximately $630, 000, for the construction phase. State and federal
grants will reimburse $75,000 of the construction cost for a net impact
of $51, 000 on City fund balances.
RECOMMENDATION:
By Motion:

WITNESSETH:
That the Owner and the Contractor for the consideration stated herein agree as follows:
ARTICLE 1, SCOPE OF WORK The Contractor shall perform everything required to be performed, shall
provide and furnish all of the labor, materials, necessary tools, expendable equipment, and all utility and
transportation services required to complete allthe work of construction of

in strict accordance with the plans and specifications therefor, including any and all Addenda, adopted by the
Owner, in strict compliance with the Contract Documents hereinafter enumerated.
It is agreed that said labor, materials, tools, equipment, and services shall be furnished and said work
performed and completed under the direction and supervision and subject to the approval of the Owner or
its authorized representatives.
ARTICLE II, CONTRACT PRICE: The owner shall pay the Contractor as full consideration for the faithful
performance of this Contract, subject to any additions or deductions as provided in the Contract Documents,

Should any dispute arise respecting the true value of any work omitted, or of any extra work which the
Contractor may be required to do, or respecting the size of any payment to the Contractor, during the
performance of this Contract, said dispute shall be decided by the Owner and its decision shall be final, and
conclusive.
