CAO RECOMMENDATION Adopt a resolution denying the appeal, and concur with the action of the ARC to deny the exception (Draft Resolution No. 1) . DISCUSSION Background A bass drum with "The Drum Circuit Drum Shop" printed on it, was installed as a roof sign without a permit. After a complaint was filed, the applicant applied for an exception to the Sign Regulations to allow the drum roof sign to remain. On September 4, 1990, the Architectural Review Commission denied the request for a roof sign. The vote was 6 - 0; Commissioner Cooper was absent. However, the ARC did grant an exception to allow the drum sign to be mounted as a projecting sign with the condition that an existing wall sign at the corner of the building be removed. The applicant is appealing the ARC decision to relocate the drum sign as a projecting sign and the condition that the wall sign be removed. (See attached letter to applicant stating ARC's action.) Consequences of Not. Takina the Recommended Action If the council upholds the appeal, the existing roof sign will be allowed to remain. Council may uphold the condition that the wall sign at the corner of the building be removed or recommend any other condition(s) deemed appropriate to this situation. Possible conditions are included in draft resolution 12. Unusual Site Conditions: The Drum Circuit occupies approximately 1000 square feet of a one story commercial building. The irregularly shaped building is located on a triangular lot at the intersection of Buchon, Archer, and High Streets. The applicant notes that he has had difficulty making his business location clearly visible because of. unusual site conditions and the relatively high speed at which traffic passes. In granting an exception to allow a projecting sign at this location, the ARC acknowledged the difficulties posed by an unusual building design and lot configuration. A projecting sign mounted at the southwestern corner of the Buchon Street frontage would be no less effective visually than the existing roof sign. It would in fact be located at nearly the same height. 2. Sign Area: The area of the drum sign is less than 5.5 square feet. 3. Total Area of Signs on Site: A maximum of 200 square feet is allowed unless exceptions are approved. The total area of all existing signage is less than 30 square feet. 4. Wall Signs: In the C-S zone one wall sign is allowed on each frontage or building face having a public entrance (Section 15.40.150 D.1) . Currently there is a wall sign (2.5'x 31 ) at the corner of Buchon and Archer Streets, which the ARC has required to be removed. There is also a wall/door sign (2 ' x3 ') , which is visible only to traffic travelling northeast on Buchon. The condition that the wall sign on the corner of the building be removed reflects consideration for one of the stated objectives of the Sign Regulations, which is to protect commercial districts from sign clutter (Section 15.40.020 Q . Staff had originally suggested that both the wall sign and the sign on the door be reduced in size. 5. Projecting Signs: In the Commercial-Service zone, projecting signs are not allowed unless the ARC approves an exception. Other Concerns: During architectural review, commissioners expressed concern about setting an unwanted precedent by allowing a roof sign. Roof signs are not allowed in any land use zone within the City. Other pre-existing, nonconforming roof signs exist in the vicinity of this site (along Higuera Street) which are the focus of current abatement proceedings. CONCURRENCES The Building Division sees no problem with mounting the drum sign as a projecting sign, but will need more details from the applicant prior to issuing a construction permit. Comments were not requested from other departments regarding this application. ALTERNATIVES 1. Adopt a resolution to uphold the appeal (Draft Resolution No. 2) . If Council upholds the appeal, the existing roof sign would remain. Other signage for the business may be allowed to remain or be subject to modifications by the Council. 2. Continue the appeal with direction to the applicant/appellant. RECOMMENDATION Adopt a resolution denying the appeal and concurring with ARC action on the application (Draft Resolution No. 1) .
